HomeMy WebLinkAbout1998-186Z 9M34 ORDINANCE NO (/ � 00 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM THE AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO THE ONE FAMILY DWELLING, CONDITIONED (SF-7[C]) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION WITH TWO CONDITIONS FOR 32 745 ACRES OF LAND LOCATED ON THE NORTH SIDE OF HICKORY CREEK ROAD, APPROXIMATELY 1,500 FEET WEST OF F M 2181, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the Weatherford Company, on behalf of Joel Austin, initiated a change in zoning for 32 745 acres of land from the Agricultural (A) zoning district classification and use designation to the One Family Dwelling, conditioned, (SF-7[c]) zoning district classification and use designation, and WHEREAS, on May 27, 1998, the Planning and Zoning Commission recommended approval of a change from the Agricultural (A) zoning district classification and use designation to the One Family Dwelling, conditioned, (SF-7[c]) zoning district classification and use designation with two conditions, and WHEREAS, the City Council finds that the change in zoning will be in compliance with the Denton Development Plan, NOW THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning district classification and use designation of the 32 745 acres of land described in Exhibits A and B, attached hereto and incorporated by reference herein, is changed from the Agricultural (A) zoning district classification and use designation to the One Family Dwelling, conditioned, (SF-7[c]) zoning district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas, subject to the following conditions Individual lots adjacent to the western and eastern boundaries of the property shall be no less than 10,000 square feet and the balance of lots shall be a mimmum of 7,000 square feet, and A buffer yard shall be required along the western and eastern boundaries of the property, to include a fence, a minimum landscaped width of 10 feet and no less than one tree from the large and medium sized tree list and one tree from the small tree list of the City's Landscape Ordinance for every 25 feet of boundary SgCTION II That the City's official zoning map is amended to show the change in zoning district classification SSEECTION III That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record- Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the LAday of Qg&- JAeALLER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY �f L� 1 . -� APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY F \SHARED\DEPT\LGL\Our Documents\Ordinances\98\Z 97 034 doc _ EXHLBrF A FIELD NOTES p1.746 ACRFB BE"* on 0* certain K pad or parosi d land *wonted In tin 0..FN6M! 000im Abetted Number 104 garter Count', Tuna, bung a pmftdttmet certain paa� d land described In dead from Jd..
