ORDINANCE NO
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM
PD-104 ZONING DISTRICT CLASSIFICATION TO AGRICULTURE (A) AND OFFICE (0)
ZONING DISTRICT CLASSIFICATIONS AND USE DESIGNATIONS FOR 18 008 ACRES OF
LAND LOCATED ON THE SOUTHEAST CORNER OF HOBSON LANE AND F M 1830
(COUNTRY CLUB ROAD), PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT
OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, David Vanderlaan, as Broker/Representative, on behalf of Charles N Davis, has
applied for a change in zoning for 18 008 acres of land from PD-104 zoning distnct classification and
use designation to Agriculture (A) and Office (0) zoning district classifications and use designations,
and
WHEREAS, on August 26, 1998, the Planning and Zoning Commission recommended
approval of the requested change in zoning, and
WHEREAS, the City Council finds that the change in zomng will be in compliance with the
1988 Denton Development Plan and the 1998 Denton Plan Policies, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zoning district classification and use designation of the 18 008 acre
tract of land described in the legal description attached hereto and incorporated herein as Exhibit A,
is changed from PD-104 zoning district classification and use designation to Office Conditioned
[O(c)] zoning district for the area of Lot I as described in Exhibit B which is attached and
incorporated herein, and the remainder is changed from PD-104 zoning district classification and use
designation to Agriculture (A) zoning district classifications and use designations, under the
comprehensive zoning ordinance of the City of Denton, Texas That the area zoned as Office
Conditioned [O(c)] shown as Lot 1 in Exhibit B is subject to the following conditions
Conditions of Office [O(c)] zoning classification,
1 That the uses described in Exhibit C shall be prohibited within this district, in
addition to those uses ordinarily prohibited by the Office (0) zoning district
classification
2 That the total floor area for all buildings on the 1 981 acres shall not exceed twenty
thousand (20,000) square feet
3 That no loading docks be permitted
4 That the exterior walls of all buildings shall be constructed of not less than seventy
percent brick or masonry materials
5 That no "off -premise" signs (as defined by section 33-2 of the Code of Ordinances
of the City of Denton) shall be permitted
6 That no direct off -site lighting shall be permitted
7 A bufferyard, measuring fifteen (15) feet wide and comprising of four (4) canopy and

eight (8) understory trees per each one hundred linear feet shall be installed on the
south and east property Imes abutting residential lots
8 That the maximum building height shall not exceed thirty-five (35) feet
9 No individual building shall exceed ten thousand (10,000) square feet
10 All buildings must have pitched roofs and a slope of no less than thirty (30)
percent
11 No parking shall be allowed in the front yard setback of any budding along
Country Club Rd or Hobson Lane
SECTION II That the City's official zoning map is amended to show the change in zoning
district classification
SECTION III That any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is
violated shall constitute a separate and distinct offense
SECTION IV That this ordinance shall become effective fourteen (14) days from the date
of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton,
Texas, within ten (10) days of the date of its passage
