ORDINANCE NO `7 -,R
AN ORDINANCE VACATING CERTAIN PUBLIC UTILITY EASEMENT LOCATED ON
LOT 1, BLOCK 1 OF LONDONDERRY ADDITION AS RECORDED IN THE PLAT
RECORDS OF DENTON COUNTY, TEXAS AT CABINET F, PAGE 334, AND PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS, the City of Denton has received a request for the abandonment of a certain
public utility easement, and
WHEREAS, the Planning and Zoning Commission of the City of Denton, Texas
reviewed the requested abandonment and recommended approval, and
WHEREAS, the Council of the City of Denton, Texas has determined that the public
utility easement being vacated is no longer needed for public use, and
WHEREAS, the process for (1) conveying, selling or exchanging the property interests of
the City of Denton in the street nght-of-way being abandoned and vacated herein and (2)
determining fair market value, as applicable, pursuant to TEX LOC GOV'T CODE §272 001
relating to the conveyance of right-of-way to abutting property owners who own the underlying
fee simple, shall be followed in effectuating this abandonment, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That the portion of the public utility easement located on Lot 1, Block 1 of
Londonderry Addition and further described in Exhibit "A", attached hereto and incorporated
herein by reference, and recorded in Cabinet F, Pages 334 of the Plat Records of Denton County,
Texas, is permanently vacated and extinguished as a public easement, to the extent described in
said exhibit
SECTION II That by reason of such vacation the City of Denton's property interest in
the vacated portion of said easements shall, by operation of law, revert to the owner or owners
abutting the easements herein abandoned, and the City of Denton releases any and all claims to
the use of the vacated portion of said property as public easements
SECTION III That this ordinance shall become effective immediately upon its passage
and approval

EXHIBIT "A"
ALL that certain lot, tract or parcel of land lying and being situated in the
Alexander I Hill Survey, Abstract No. 623, and in the S. C. Hirams Survey,
Abstract No. 616, and being part of a tract conveyed to Karl A. Sweetman,
D.D.S , by deed recorded under Clerk's Pile Number 97-R0065632 of the Real
Property Records of Denton County, Texas, said tract also being part of Lot 1,
Block 1, of Londonderry Addition, an Addition to the City of Denton, Denton
County, Texas, as recorded in Cabinet 8, Page 334 of the Plat Records of Denton
County, Texas, and being more particularly described as followsa
BEGINNING,at a point at the intersection of the north line of said Lot 1 with
the east line of an existing 20-foot utility easement, said 20-foot easement
conveyed by deed to the City of Denton as recorded in volume 702, Page 121 of
the Deed Records of Denton County, Texas, said point bearing North 880 21' 29"
East, a distance of 15.21 feet from the northwest corner of said Lot 1, Block
1 of Londonderry Addition;
THENCE North 880 21, 29" East, with the north line of said Lot 1, a distance of
110.03 foot to a point for corner;
THENCE South 000 37' 46" East, a distance of 281 85 feet to a point for corner;
THENCE South 440 22' 140 West, a distance of 141 33 feet to a point for corner;
THENCE South 450 37. 460 East, a distance of 138 22 feet to a point for corner;
THENCE South 000 37' 46" East, a distance of 208.99 feet to a point for corner
in the north line of Londonderry Lane, and the beginning of a curve to the left
having a central angle of 030 57, 021, a radius of 236.28 feet, a chord bearing
North 870 36. 56" East and a chord distance of 16.29 feet;
THENCE Northeasterly, with the said north line of Londonderry Lane and along
the arc of said curve to the left, an are distance of 16.29 feet to a point for
corner;
THENCE North 000 37, 46" West, a distance of 201.77 feet to a point for corner;
THENCE North 450 37, 46" West, a distance of 127.51 feet to a point for corner
in the east line of said 20-foot utility easement;
THENCE North 000 49' S1" West, with the said east line of said 20-foot utility
easement, a distance of 27.77 feet to a point for corner;
