HomeMy WebLinkAbout1998-374ORDINANCE NO AN ORDINANCE CANVASSING THE RETURNS AND DECLARING RESULTS OF A SPECIAL MUNICIPAL ELECTION HELD IN THE CITY OF DENTON ON NOVEMBER 3, 1998 REGARDING THE EXTENDED HOURS FOR THE SALE OF ALCOHOLIC BEVERAGES, AND PROVIDING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I. The City Council finds and declares that the November 3, 1998 special municipal election was duly ordered for the purpose of determining whether an ordinance would be adopted establishing a standard hours area for the sale of mixed beverages, beer, and wine, which would effectively repeal the current extended hours for the sale of alcoholic beverages ordinance, that proper notice of said election was duly given and election officials appointed, that the election was duly held and the returns of the election officials have been delivered to the Council, all in accordance with the laws of the State of Texas and the Charter and ordinances of the City of Denton SECTION II. The official returns of the election officials having been opened, examined, and canvassed, and the Council hereby finds and declares that 13,315 ballots were cast at the election, and that the votes cast for or against the ordinance and the proposition set forth below were as follows THE ADOPTION OF AN ORDINANCE ESTABLISHING A STANDARD HOURS AREA FOR THE SALE OF MIXED BEVERAGES, BEER, AND WINE ON PREMISES WITHIN THE INCORPORATED LIMITS OF THE CITY OF DENTON, SAID HOURS TO BE BETWEEN 7 00 A M AND MIDNIGHT ON ANY DAY, EXCEPT SUNDAY ALCOHOLIC BEVERAGE SALES ARE PERMITTED BETWEEN MIDNIGHT AND 100 AM AND BETWEEN 10 00 A M AND MIDNIGHT ON SUNDAYS, EXCEPT THAT AN ALCOHOLIC BEVERAGE SERVED TO A CUSTOMER BETWEEN 10 00 A M AND 12 00 NOON ON SUNDAY MUST BE PROVIDED DURING THE SERVICE OF FOOD, PURSUANT TO APPLICABLE PROVISIONS OF CHAPTER 105 OF THE TEXAS ALCOHOLIC BEVERAGESCODE TOTAL EARLY VOTES CAST FOR THE ORDINANCE 1,738 votes AGAINST THE ORDINANCE 2,476 votes TOTAL ELECTION DAY VOTES CAST FOR THE ORDINANCE 3,262 votes AGAINST THE ORDINANCE 5,839 votes TOTAL VOTES CAST FOR THE ORDINANCE AGAINST THE ORDINANCE 5,000 votes 8,315 votes SECTION III, The Council finds and declares that, as a result of the election, the ordinance establishing a standard hours area for the sale of mixed beverages, beer, and wine on premises within the incorporated limits of the City of Denton is hereby declared to be defeated and repealed, and the current Ordinance No 96-014 establishing extended hours for the sale of mixed beverages, beer, and wine shall remain in full force and effect SECTION IV, That this ordinance shall become effective immediately upon its passage and approval ih PASSED AND APPROVED this the I — day of 1998 ATTEST JENNIFER WALTERS, CITY SECRETARY HERBERT L PROUTY, CITY ATTORNEY WON \\CHLGL\VOLI\SHARHD\DHPI\LGL\Ow Iloc..Ut 0,ds...\98 me id alwh.l,.bev.4..Iw, ndoc Page 2
