HomeMy WebLinkAbout1998-435FILE REFERENCE FORM 98-435 Additional File Exists Additional File Contains Records Not Public, According to the Public Records Act X Other Late inutats Document has been filed with the County Clerk's Office -original Countv document included with file but not imaeed I I JW ORDINANCE NO AN ORDINANCE PARTIALLY VACATING A PORTION OF A CERTAIN ALLEY EASEMENT RECORDED IN THE DEED RECORDS OF DENTON COUNTY, TEXAS AT VOLUME 318, PAGE 4, AS IT PERTAINS TO THE WEST HALF OF A 20-FOOT WIDE ALLEY IN BLOCK 12 OF THE COLLEGE VIEW ADDITION TO THE CITY OF DENTON, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Denton has received a request for the abandonment of a portion of an alley easement, and WHEREAS, the Planning and Zoning Commission of the City of Denton, Texas reviewed the requested abandonment and recommended approval, and WHEREAS, the Council of the City of Denton, Texas has determined that the portion of the alley easement being vacated is no longer needed for public use, and WHEREAS, the fair market value of the portion of the alley easement being abandoned has been determined and received, as required by Section 272 001 of the Texas Local Government Code, NOW THERFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the real property described in Exhibit "A", attached hereto and incorporated herem by referenced, being a portion of the alley easement recorded in Volume 318, Page 4 of the Deed Records of Denton County, Texas, as it pertains to west 10 feet of the existing 20-foot alley easement adjacent to Lots 1 and 2 of Block 12 of the College View Addition, an addition to the City of Denton, Denton, County Texas, is permanently vacated and extinguished as a public alley easement, to the extent described in said exhibit SECTION II The portion of the public alley described in Exhibit "A" is hereby vacated and abandoned as a public alley only and expressly reserving utility easement rights for access, drainage, and public utilities which are manifest in the dedication of a public alley SECTION III That by reason of such vacation the City of Denton's property interest in the vacated portion of said alley easement shall, by operation of law, revert to the owner or owners abutting the easement herein abandoned, and the City of Denton releases any and all claims to the use of the vacated portion of said property as a public easement SECTION III That this ordinance shall become effective immediately upon its passage and approval %/j��, PASSED AND APPROVED this the �/— day of 1998 JACI LER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY BY d, APPR D AS 0 LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY S \Our Documents\0rdmances\98Vesse Abandonment doe EXHIBIT "A" ALL that certain lot, tract or parcel of land lying and being situated in the J. Brock Survey, Abstract No. 55, in the City of Denton, Denton County, Texas, and being part of the west half of a 20-foot alley in Block 12 of College View Addition, an addition to the City of Denton, Denton County, Texas, according to the plat thereof recorded in Volume 318, Page 4 of the Deed Records of Denton County, Texas, and being more particularly described as follows: BEGINNING at a point in the north line of Bast McKinney Street, a public roadway having a variable width right-of-way, said point being the southeast corner of Lot 1, Block 12 of said College View Additions THENCE North, with the east line of said Lot 1, same being the west line of said 20-foot alley in said Block 12, passing at 135.80 feet the northeast corner of said Lot 1, same being the southeast corner of Lot 2, Block 12 of said College View Addition, and continuing with the east line of said Lot 2, same also being the west line of said 20-foot alley, a total distance of 185.80 feet to a point at the northeast corner of said Lot 2; THENCE North 890 49, 23H East, departing said east line of said Lot 2 and the went line of said 20-foot alley, a distance of 10.00 feet to a point in the center of said alley right-of-ways THENCE South, with said center of said 20-foot alley right-of-way, a distance of 185.90 feet to a point in the said north line of East McKinney Street; THENCE North 88° 59' 350 West, with the said north line of East McKinney Street, a distance of 10.00 feet to the POINT OF BEGINNING and containing 1,859 square feet of land.
