AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A CHANGE FROM THE
AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO
THE PLANNED DEVELOPMENT 162 (PD-162) ZONING DISTRICT CLASSIFICATION AND
USE DESIGNATION BY APPROVING A DEVELOPMENT PLAN FOR A 77 6 ACRE TRACT
LOCATED ON THE EAST SIDE OF LILLIAN MILLER, APPROXIMATELY SEVEN
HUNDRED FIFTY (750) FEET NORTH OF ROBINSON ROAD, PROVIDING FOR A
PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Mr James Haddock, on behalf of the James R Harris Company, initiated a
change in zoning by applying for approval of a development plan for a 77 6 acre tract of land which
would change such Agricultural (A) zoning district and use classification to the Planned Development
(PD) zoning district classification and use designation, and
WHEREAS, on May 28, 1997, the Planning and Zoning Commission recommended approval
of the change from the Agricultural (A) zoning district and use classification to the Planned
Development (PD) zoning distnct and use classification, and
WHEREAS, the City Council finds that a Planned Development (PD) District allowing for
single family lots with minimum lot sizes of seven thousand (7,000) square feet each and a detailed
plan providing for approval of a tree preservation plan would be an appropriate use of this property,
and
WHEREAS, the City Council finds that the change in zoning will be in compliance with the
Denton Development Plan, NOW THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zoning district classification and use designation of the 77 6 acres of
land described in Exhibit A is changed from the Agricultural (A) zoning district classification and use
designation to the Planned Development (PD) zoning district classification and use designation to
provide for (a) the adoption of the development plan, attached hereto and incorporated herein as
Exhibit B for all purposes, (b) single family lots with minimum lot sizes of seven thousand (7,000)
square feet each, and (c) a tree preservation plan to be included with the detailed plan for such
property, in accordance with the comprehensive zoning ordinance of the City of Denton, Texas
SECTION II That the City's official zoning map is hereby amended to show the change in
zoning district classification
SECTION IV That this ordinance shall become effective fourteen (14) days from the date
of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record Chronicle, the official newspaper of the City of Denton, Texas,
within ten (10) days of the date of its passage
