HomeMy WebLinkAbout1997-240C �[AORDV uE ORDINANCE NO 7 ��O AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING ARTICLE V "PUBLIC AND SEMIPUBLIC SWRA IING POOLS" OF THE CODE OF ORDINANCES OF THE CITY OF DENTON BY AMENDING SECTION 14-112 "HEALTH OFFICER INSPECTIONS" AND SECTION 14-113 "PERMITS TO OPERATE," PROVIDING A PENALTY NOT TO EXCEED $2,000, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION, AND PROVIDING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Section 14-112 "Health Officer Inspections" of the Code of Ordinances of the City of Denton, Texas is hereby amended to read as follows Sec.14-112 Health Officer Inspections. The health officer is authorized to conduct such inspections as he deems necessary to ensure compliance with (a) all provisions of this article and of the Denton City Code relating to Swimming Pools, (b) all provisions of Article VI "Swimming Pool Code" of Chapter 28 of the Code of Ordinances of the City of Denton, Texas that relate to the maintenance and operation of pools, (c) all provisions of Texas Administrative Code Title 25 "Health Services" Part I Texas Department of Health Chapter 337 (Design Standards for Public Swimming Pool Construction), as amended, that relate to the maintenance and operation of pools, (d) all provisions of Health and Safety Code Title 5 Sanitation and Environmental Quality Subtitle A Sanitation Chapter 341 (Mimmum Standards of Sanitation and Health Protection), as amended, (e) all provisions of Health and Safety Code, Title 9 Safety Subtitle A Public Safety Chapter 757 (Pool Yard Enclosures), as amended and shall have the right of entry at any reasonable hour to the public or sermpublrc pool for this purpose If same be necessary, Chapters 337, 341 and 757 referenced above are hereby adopted and incorporated herein as if copied in full herein In case of conflict between paragraphs (a) - (e) of this section, the more restrictive regulation shall apply SECTION II That Section 14-113 "Permits To Operate" of the Code of Ordinances of the City of Denton, Texas, is hereby amended by adding subsections (c) and (d) to read as follows Sec. 14-113. Permits to Operate [See Denton City Code for (a) and (b)] (c) An annual fee is hereby established for the inspection of swimming pools in the amount of $190 00 for each pool (d) Aifee is hereby established for the certification course for a swmmung pool operator in the amount of $35 00 per student SECTION III That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense S CTION That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas hereby declares it would have enacted such remaining portions despite any such invalidity SECTION V That save and except as amended hereby, all the sections, sentences, and clauses of Article V, sections 14-112 and 14-113 of the Code of Ordinances of the City of Denton, Texas shall remain in full force and effect SECTION VI.
