AN ORDINANCE PROVIDING FOR THE EXPENDITURE OF FUNDS FOR EMERGENCY
PURCHASES OF MATERIALS, EQUIPMENT, SUPPLIES OR SERVICES IN ACCORDANCE
WITH THE PROVISIONS OF STATE LAW EXEMPTING SUCH PURCHASES FROM
REQUIREMENTS OF COMPETITIVE BIDS, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, state law and ordinance require that certain contracts requiring an expenditure or
paymentby the City in an amount exceeding $15,000 be by competitive bids, except in the case of
public calamity where it becomes necessary to act at once to appropriate money to relieve the
necessity of the citizens, or to preserve the property of the city, or it is necessary to protect the public
health or safety of the citizens of the city, or in case of unforeseen damage to public property,
machinery or equipment, and,
WHEREAS, the City Manager has recommended to the City Council that it is necessary to
purchase goods or services due to the following emergency conditions outlined in the memorandum
attached hereto as Exhibit "A", incorporated herein by reference, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
sECTION I That the City Council hereby determines that there is a public calamit} that makes
it necessary to act at once to appropriate money to relieve the necessity of the citizens, or to preserve
the property of the city, or to protect the public health of the citizens of the city, or to provide for
unforeseen damage to public property, machinery or equipment, and by reason thereof, the following
emergency purchases of materials, equipment, supplies or services, as described in the "Purchase
Orders" attached hereto, are hereby approved

SECTION II That because of such emergency, the City Manager or designated employee is
hereby authorized to purchase the materials, equipment, supplies or services as described in the
attached Purchase Orders and to make payment therefore in the amounts therein stated, such
emergency purchases being in accordance with the provisions of state law exempting such purchases
by the City from the requirements of competitive bids

SECTION III That this ordinance shall become effective immediately upon its passage and
approval

RFCOMMF.NDATION; We recommend this emergency purchase order to Greenville Transformer Co in
the amount of $25,200 00 be approved
SUMMARY. This emergency purchase is to repair the 3750 KVA transformer which operates and generates
the Lewisville Hydroelectric unit This unit represents a $7,000 00 a week power supply and there is also a
potential for flooding of the Hydro building Three vendors were contacted to find the lowest cost and the
fastest repair time Greenville was the lowest bidder and offered a 6-8 week turn around See the detailed

This purchase is exempt from the competitive sealed bid process due to the Public Safety hazard of this unit
if it remains on temporary low voltage auxiliary power

Re Request for emergency pumbase order- Lewisville power transformer
Dear Tom,
The Blectac Production Divistam requested an emergency p(acbsso order to fiord repairs to the
Lewisville Sydrodectric poorer transfner The transformer failed in service rendering the hydro inoperative
and without auxiliary power
Lewisville hydro is capable of prodttotng 2 mw of generation The power transformer counts the
4,160 volt Wro f3aorlity w7111 the 24,000 volt Brazos trenmmiaeion system. The transformer a required for
both generation andawahary power supply to the unit. With the ttansfom er failed and out of service, the unit
is mcapable of generating electdoity for the Denton system and the powerhouse is without auxthary power
Loss of the Lewisville generation rapments an inwentental power supply cost totaling over $7,000 per weak.
Additionally, the hydro site is without normal auxihaty power supply Under �this �� configuration, the pumping
systems are, moperative, A temporety auxiliary power hon has been mstallod tq permit essential low
voltage services for oommumcatton and alarms for the remote facility Thera is some risk associated with
maintaining the faoihty under these conditions as flooding of the powerhouse could result if abnormal leakage
were to occur.
For these reasons, vendors ware contacted for estimates and schedules to repair the transformer We
iecerved quptimm From several transformer repair facilities Granville Transformer Co provided the lowest
estimate for worst an repave, sad provided the quickest turn around repair time. The Greenville eider
totaled $25,200 with turrmamumd at 6-g weeks Tho next lowest vendor quoted $29.844 with 8-10 week
to naround.IQ otdtion for anew transformer totaled $37,106, with a 10-12 week turn around. Our
recommendation to repair is based on lowest coot and quickest turn around.
