HomeMy WebLinkAbout1997-294Z-97-024 ORDINANCE NO. 41 - AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE IN ZONING FROM SINGLE FAMILY - 7 ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO MULTIPLE -FAMILY - 1 ZONING DISTRICT CLASSIFICA TION AND USE DESIGNATION WITH CONDITIONS (MF-1-C) FOR A 2.158 ACRES OF LAND LOCATED ON THE EAST SIDE OF BERNARD AT GREENLEE; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Mr. Wayne Rodgers, on behalf of W. Rodgers Homes, Inc., initiated a change in zoning for a 2 158 acre tract of land from the Single Family - 7 (SF-7) zoning district classification and use designation to the Multiple -Family - 1 with conditions (MF- 1-c)zoning district classification and use designation; and WHEREAS, on September 10, 1997, the Planning and Zoning Commission recommended approval of the zoning change; and WHEREAS, the City Council finds that the change in zoning will be in compliance with the Denton Development Plan, NOW THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That the zoning district classification and use designation of the 2.158 acres of land described in Exhibit A is changed from the Single Family - 7 (SF-7) zoning district classifi- cation and use designation to the Multiple -Family - 1 with conditions (MF-1-c) zoning district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas. SECTION II. That the district shall be subject to the following conditions pursuant to Division 5 of Article III of Chapter 35 of the Code of Ordinances. 1. No parking spaces shall be allowed adjacent to Bernard Street. 2. The maximum height of any proposed building shall not exceed 2 1/2 stories, however, any buildings fronting on Bernard Street may not exceed 1 1/2 stories in height. 3. A minimum of twenty percent (20%) of the site shall be used for open space or recreational uses, and shall be located in areas not otherwise situated for front, side, or rear yards 4. Setbacks shall be as follows. Front yard (Bernard) - 25 feet Side yard (interior) - 10 feet Side yard (adjacent to single family residential fronting Bernard) - 15 feet Rear yard (10 feet except along the east property line for drainage purposes.) SECTION III. That the City's official zoning map is hereby amended to show the change in zoning district classification. SECTION IV. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION V. That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage. 11 PASSED AND APPROVED this the7�5 day of e r 1997 ATTEST: JENNIFER WALTERS, CITY SECRETARY BY: APPR *BD AS TO LEGAL FORM: HERBERT L.
