HomeMy WebLinkAbout1996-003Z-95-030 ORDINANCE NO l& -OOZ AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM THE AGRICULTURAL (A) (WITH SUP 180) ZONING DISTRICT CLASSIFI- CATION AND USE DESIGNATION TO THE OFFICE CONDITIONED (O(C)) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 8 3271 ACRES OF LAND DESCRIBED AS LOT 1, BLOCK 1, OF THE YMCA ADDITION, LOCATED ON THE NORTHWEST CORNER OF RINEY ROAD AND WINDSOR DRIVE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the Denton Independent School District initiated a change in zoning, for 8 3271 acres of land described as Lot 1, Block 1, of the YMCA Addition from the Agricultural (A) (with SUP 180) zoning district classification and use designation to the Office Conditioned (O(c)) zoning district classification and use designation, and WHEREAS, on November 8, 1995, the Planning and Zoning Commis- sion recommended approval of the requested change in zoning, and WHEREAS, the City Council finds that the change in zoning will be in compliance with the Denton Development Plan, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning district classification and use designation of the 8 3271 acres of land described as Lot 1, Block 1, of the YMCA Addition, is changed from the Agricultural (A) (with SUP 180) zoning district classification and use designation to the Office Conditioned (O(c)) zoning district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas, subject to the following conditions 1 The uses described in Exhibit 1, attached hereto and incorporated by reference herein, are prohibited 2 The total amount of square footage for all buildings on the 8 3271 acres not exceed ten thousand (10,000) square feet SECTION II That the City's official zoning map is amended to show the change in zoning district classification SECTION III That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION IV That this ordinance shall become effective four- teen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this theePht'o day of , 1996 ATTEST JENNIFER WALTERS, CITY SECRETARY BY APP ED AS O LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY PAGE 2 EXHIBIT il PROHIBITED USES LOT 1, BLOCK 1, YMCA ADDITION Community Umt Development Dormitory, Boarding or Rooming House Hotel or Motel Art Gallery or Museum Church or Rectory College or Umvers~ty or Pnvate School Commumty Center (Pubhc) Day Nursery or K~ndergarten School Group Homes Halfway House Hospital (General Acute Care) Hospital (Chromc Care) Institutions of Rehglous or Phdanthrop~c Nature Pubhc L~brary Monastery or Convent Nursing Home or Residence Home for Aged Occasional Sales Park, Playground or Pubhc Commumty Center School, Private Primary or Secondary School, Public or Denominational School, Business or Trade Accessory Building Commumty Center (Private) Electrical Substation Electrical Transmission L~ne Temporary Field or Construcbon Office (Subject to approval and control by Budding Official) F~re Station or S~mdar Pubhc Safety Budding Gas Transmission L~ne and Metenng Station Home Occupation Sewage Pumping Station Private Swimming Pool Telephone, Bus~ness Office Telephone Line & Exchange Switching or Relay Stabon Water Reservoir, Water Pumping Station or Well Country Club (Pnvate) w~th Golf Course Public Golf Course Pubhc Park or Playground Pubhc Piayfleld or Stadium Sw~m or Tenms Club Railroad Track or R~ght-of-Way Studio for Photographer, Musician, Artist or Health Animal Clinic or Hospital (no ouside runs or pens) Farm or Ranch Cemetery or Mausoleum Fraternity, Sorority, Lodge or Civic Club Home for Care of Alcoholic, narcotic or Psychiatric Patients Public Building, Shop, Yard of Local, State, or Federal Government Radio and/or Television Microwave Tower Water Treatment Plant Airport Landing Field or Heliport Commercial Parking Lot or Structure Cafeteria Mortuary of Funeral Parlor Restaurant Scientific or Research Laboratories
