DEVELOPMENT (PD-57) ZONING DISTRICT CLASSIFICATIONS AND USE DESIGNATIONS TO A NEW PLANNED DEVELOPMENT (PD) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR A 1 059 ACRE TRACT LOCATED IN THE NORTHEAST CORNER OF THE INTERSECTION OF CARROLL BOULEVARD AND FORT WORTH DRIVE, APPROVING A DEVELOPMENT PLAN FOR THE DISTRICT, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Dennis J Koop has applied for a change in zoning for a 1 059 acre tract of land located in the northeast corner of the intersection of Carroll Boulevard and Fort Worth Drive from Office (0) and Planned Development zoning classifications and use designations to a new Planned Development District (PD) zoning classification and use designation, and WHEREAS, on December 13, 1995, the Planning and Zoning Commis- sion recommended approval of the requested change in zoning, and WHEREAS, the City Council finds that the change in zoning will be in compliance with the Denton Development Plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning district classification and use designation of the 1 059 acres of land legally described as shown in Exhibit A, attached hereto and incorporated herein by reference, is changed from Office (0) and Planned Development (PD-57) zoning classifications and use designations to a new Planned Development District (PD) zoning district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas SECTION II That Exhibit B, attached hereto and incorporated into this ordinance by reference, is approved as the Detailed Plan for the new district, in accordance with Division 2 of Article IV of Chapter 35 of the Code of Ordinances SECTION III That all conflicting ordinances, including without limitation Ordinance 83-69, are hereby repealed to the extent of any such conflict SECTION IV That the City's official zoning map is hereby amended to show the change in zoning district classification SECTION V That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION VI That this ordinance shall become effective four- teen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, the official news- paper of the City of Plat Records, THENCE South 00 Degrees 52 Minutes 02 Seconds West with the East line of said Lot 2 Carroll Park Addition and the West line of said Myrtle Addition a distance of 89 82 feet to a 1/2"
