Home My WebLink About1996-046ace-04c0 AN ORDINANCE CANVASSING ELECTION RETURNS OF THE BOND ELECTION HELD ON FEBRUARY 24, 1996 AND PROVIDING FOR AN EFFECTIVE DATE THE STATE OF TEXAS COUNTY OF DENTON CITY OF DENTON WHEREAS, the City Council of said City ordered an election to be held in said City on February 24, 1996 on the PROPOSITIONS hereinafter stated, and WHEREAS, said City Council has investigated all matters pertaining to said election, including the ordering, giving notice, officers, holding and making returns of said election, and WHEREAS, the election officers who held said election have duly made the returns of the result thereof, and said returns have been duly delivered to said City Council WHEREAS, it is hereby officially found and determined that the meeting at which this Ordinance was passed was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by the Texas Government Code, Chapter 551 THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS Section I That the City Council officially finds and determines that said election was duly ordered, that proper notice of said election was duly given, that proper election officers were duly appointed prior to said election, that said election was duly held, that due returns of the result of said election have been made and delivered, and that the City Council has duly canvassed said returns, all in accordance with law and the Ordinance calling said election Section II That the City Council officially finds and determines that the following votes were cast at said election on the submitted PROPOSITIONS by the resident, qualified electors of said City, who voted at the election PROPOSITION NO 1 /099 VOTES FOR THE ISSUANCE OF $11,112,000 OF STREET AND TRAFFIC CONTROL IMPROVEMENT BONDS 7D VOTES AGAINST /697' VOTES FOR &IVOTES AGAINST 9% VOTES FOR &&Q _ VOTES AGAINST PROPOSITION NO 2 THE ISSUANCE OF $7,238,000 OF DRAINAGE IMPROVEMENT BONDS PROPOSITION NO, 3 THE ISSUANCE OF $7,650,000 OF PARK IMPROVEMENT BONDS Section III That the City Council officially finds, determines and declares the result of said election to be that the PROPOSITIONS so submitted have received a favorable majority vote in all respects and have carried Section IV That the aforesaid bonds may be issued, as voted and as provided by law Section V That this Ordinance shall become effective immediately upon its passage and approval PASSED AND APPROVED this the 27th day of February, 1996 Bob Castleberry, Mayor ATTEST Jennifer Walters, City Secretary lull mg 1 APPROVED AS TO LEGAL FORM Herbert L Prouty, City Attorney e- O s r J 1 s r �O Y i 7 Y N (W ww o sm 11 ry�ry N O 00�0 0 U | , [ � 0B |E 6-1< § I 2! wo v! O 0 d w O SPO ftpNO 0 § � k(k §|; ■ @Sa a;s �—■a @ 2B !| §! §§sm� �§�` ACKNOWLEDGMENT OF NOTICE OF SPECIAL MEETING FOR ABSENTEES THE STATE OF TEXAS COUNTY OF DENTON CITY OF DENTON Each of the undersigned officers or members of the City Council of said City hereby acknowledges and certifies that he or she was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the Special Meeting of said City, which was held at the regular designated meeting place in said City on February 27, 1996, and that an ORDINANCE CANVASSING ELECTION RETURNS would be introduced and considered for passage at said Special Meeting, and that he or she consented in advance to the holding of said Special Meeting for such purpose SIGNED the CERTIFICATE FOR ORDINANCE THE STATE OF TEXAS COUNTY OF DENTON CITY OF DENTON We, the undersigned officers of said City, hereby certify as follows 1 The City Council of said City convened in SPECIAL MEETING ON THE 27TH DAY OF FEBRUARY, 1996, at the City Hall, and the roll was called of the duly constituted officers and members of said City Council, to wit Bob Castleberry, Mayor Jeff Krueger David Biles Jack Miller Eulme Brock Carl G Young, Sr Jerry Cott Jennifer Walters, City Secretary and all of said persons were present, except the following absentees 04;t6 thus constituting a quorum Whereupon, among other business, the f 1 wing Yas transacted at said Meeting a written AN ORDINANCE CANVASSING ELECTION RETURNS OF THE BOND ELECTION HELD ON FEBRUARY 24, 1996 AND PROVIDING FOR AN EFFECTIVE DATE was duly introduced for the consideration of said City Council and read in full It was then duly moved and seconded that said Ordinance be passed, and, after due discussion, said motion carrying with it the passage of said Ordinance, prevailed and carried by the following vote AYES All members of said City Council shown present above voted "Aye " NOES 2 That a true, full and correct copy of the aforesaid Ordinance passed at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate, that said Ordinance has been duly recorded in said City Council's minutes of said Meeting, that the above and foregoing paragraph is a true, full and correct excerpt from said City Council's minutes of said Meeting pertaining to the passage of said Ordinance, that the persons named in the above and fore- going paragraph are the duly chosen, qualified and acting officers and members of said City Council as indicated therein, that each of the officers and members of said City Council was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that said Ordinance would be introduced and considered for passage at said Meeting, and each of said officers and members consented, in advance, to the holding of said Meeting for such purpose, and that said Meeting was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by the Texas Government Code, Chapter 551 3 That the Mayor of said City has approved and hereby approves the aforesaid Ordinance, that the Mayor and the City Secretary of said City have duly signed said Ordinance, and that the Mayor and the City Secretary of said City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of said Ordinance for all purposes SIGNED AND SEALED the 27th day of February, 1996 I �1 - i A.'i. , �l%�..�.. �, fry (SEAL)
