AN ORDINANCE AMENDING THE SCHEDULES OF ELECTRIC RATES CONTAINED IN
ORDINANCE NUMBER 95-178 BY REPEALING THE THERMAL STORAGE INCENTIVE
(SCHEDULE TS); PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR
A SAVINGS CLAUSE, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, at its meeting of April 22, 1996 the Public Utility
Board recommended the elimination of the Thermal Storage Rate
because it is not cost effective for the purchase of load shift.
WHEREAS, the City Council deems it in the public interest to
amend Ordinance 95-178 to eliminate the Thermal Storage Rate; NOW
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I ordinance Number 95-178 adopted pursuant to
Chapter 26 of the Code of Ordinances of the City of Denton relating
to the electric rate schedules is hereby amended by repealing the
Thermal Storage Incentive (Schedule TS) found on page 41 of the
Ordinance.
SECTION II That if any section, subsection, paragraph,
sentence, clause, phrase or word in this ordinance, or application
thereof to any person or circumstance is held invalid by any court
of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance, and the City
Council of the City of Denton, Texas, hereby declares it would have
enacted such remaining portions despite any such invalidity.
SECTION III. That all provisions of Ordinance Number 95-178 of
the City of Denton in conflict with the provisions of this
ordinance are hereby repealed, and all other provisions of
Ordinance Number 95-178 of the City of Denton, not in conflict with
the provisions of this ordinance, shall remain in full force and
effect.
SECTION IV. That this ordinance shall become effective
immediately upon its passage and
