HomeMy WebLinkAbout1996-185Z-66 026 ORDINANCE NO "Il0 rf 8-5 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM THE AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO THE LIGHT INDUSTRIAL CONDITIONED (LI-C) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 7 352 ACRES OF LAND LOCATED ON THE SOUTH SIDE OF TEASLEY LANE, EAST OF HICKORY CREEK, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Mr Kent Key, on behalf of George and David Arthur, initiated a change in zoning for 7 352 acres of land from the Agricultural (A) zoning district classification and use designation to the Light Industrial Conditioned (LI[c]) zoning district classification and use designation, and WHEREAS, on August 28, 1996, the Planning and Zoning Commission recommended approval of the change from the Agricultural (A) zoning district and use classification to the Light Industrial Conditioned (LI-C) zoning district and use classification, and WHEREAS, the City Council finds that the change in zoning will be in compliance with the Denton Development Plan, NOW THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning district classification and use designation of the 7 352 acres of land described in Exhibit 1 is changed from the Agricultural (A) zoning district classification and use designation to the Light Industrial Conditioned (LI-C) zoning district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas SECTION II The property shall be subject to the following conditions a No structure shall be taller than two (2) stones b The uses listed within the list of prohibited uses attached hereto and incorporated herein as Exhibit 2 are expressly prohibited SECTION III That the City's official zoning map is hereby amended to show the change in zoning district classification SECTION IV That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION V That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the 3i day ofjUApjh1tt.i 1996 JAC"ILLER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY BY AP 4OVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY Page 2 FYNTTITT 1 aIs YA Y -- ante I's aA5$ Yg s�Y'y Ya;E: .1 3% eYzi <`YS �� s<y;•Bg ieba <_ �A♦y . i1 a%su•3 G�Lq �i �itt �§ WA.
