HomeMy WebLinkAbout1996-281Z-96-044 ORDINANCE NO q6- R V/ AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING THE DETAILED PLAN FOR PLANNED DEVELOPMENT NO 1 (PD-1) WITH RESPECT TO 0 4528 ACRES OF THE 4 8 ACRES THEREIN DEFINED, AS SHOWN IN THE ATTACHED DETAILED PLAN, THE SUBJECT PROPERTY BEING LOCATED ON THE WEST SIDE OF GAY STREET, 226 30 FEET NORTH OF UNIVERSITY DRIVE (US 380), PROVIDING A SAVINGS CLAUSE, PROVIDING FOR SUPERSEDURE OF ANY INCONSISTENT PROVISIONS OF ORDINANCES 88-167 AND 69-1, TO THE LIMITED EXTENT THAT THEY RELATE TO THE SUBJECT PROPERTY, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Mr Ray Croff, on behalf of International Business School, has applied for approval of a detailed plan for 0 4528 acres described in Exhibit A, and located within Planned Develop- ment 1 (PD-1), a planned development district established by Ordinance 69-1, and WHEREAS, on December 11, 1996, the Planning and Zoning Commission recommended approval of the requested detail plan, and WHEREAS, the City Council finds that this detailed plan will be in compliance with the Denton Development Plan, NOW, THERE- FORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Ordinance Nos 88-167 and 69-1, as they relate to Planned Development District 1 (PD-1), a planned development district comprising 4 849 acres of land, are hereby amended with respect to 0 4528 acres of land located therein, and more particularly described in the legal description attached hereto and incorporated herein as Exhibit A, by adopting a detail plan for said 0 4528 acre parcel, attached hereto and incorporat- ed herein as Exhibit B for all purposes SECTION II That the provisions of this ordinance, as they apply to the 0 4528 acres described by Exhibit A, govern and control over any conflicting provisions of Ordinance Nos 88-167 and 69-1, as they relate to the sub]ect property, but all the provisions of said ordinances as they apply to the remainder of the planned development district not herein amended shall contin- ue in force and effect and shall apply to the remainder of said district SECTION III That a copy of this ordinance shall be at- tached to Ordinance Nos 88-167 and 69-1, showing the amendment herein approved SECTION IV That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION V That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordi- nance to be published twice in the Denton Record
