AN ORDINANCE OF THE CITY OF DENTON, TEXAS AUTHORIZING THE
EXPENDITURE OF FUNDS FOR THE PURPOSE OF PAYMENT BY THE CITY FOR
WATER QUALITY ASSESSMENT FEES FOR THE TEXAS NATURAL RESOURCES
CONSERVATION COMMISSION (TNRCC) AS PER SENATE BILL 818 EFFECTIVE
JUNE 1991; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, in order to comply with Texas Natural Resources
Conservation Commission (TNRCC) requirements, the City of Denton is
required to pay Water Quality Assessment Fees; and
WHEREAS, the City Manager has reviewed and recommended that
the Council approve the payment of such fee; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I. That the expenditure of funds in the amount of
$28,140.00 to be paid to Texas Natural Resources Conservation
Commission (TNRCC), is hereby authorized.
SECTION II. That this ordinance shall become effective
immediately upon its passage and approval.

SUBJECT: CHECK REQUISITION -TEXAS NATURAL RESOURCES CONSERVATION
COMMISSION (TNRCC) - $28,140.00
RECOMMENDATION: We recommend this check request to TNRCC be approved in
the amount of $28,140.00.
SUMMARY: This check request is for payments of $12,006.00 for Water Quality
assessment fees for FY 94 and $16,134.00 for Water Quality Assessment fee for FY
95. Total payment is $28,140.00. This fee is based upon permitted waste water flow
limits effective on September 1 of each year.
BACKGROUND: Check Request dated April 24, 1995, Invoice from TNRCC, TNRCC
Literature explaining the fees.
PROGRAMS DEPARTMENTS OR GROUPS AFFECTED: Utilities, Water Reclamation
Plant.
FISCAL IMPACT: Funds for fee payments to TNRCC will come from 1994-95 budget

FY 1995 Fees For Wastewater Permits

(Regional Water Quality Assessment Program)
Why Is This Fee Assessed?
Senate Bill 818, which went into effect in June, 1991,
requires a comprehensive water quality assessment (evalua-
tion) in each river basin in Texas. In most cases, the
assessment is done by a river authority, or another desig-
nated local government, in cooperation with the Texas
Natural Resource Conservation Commission (TNRCC,
Previously the Texas Water Commission).
Senate Bill 818 requires the Commission to recover the
reasonable costs of the assessment program from wastewater
permit holders and water right holders. Commission rules
(TAC, Sections 320.21-.22) established the fee calculation
method described beIow.
• Flow amounts are taken as the daily average flow limit
in the permit; where the permit does not specify a daily
Average flow limit, the charge is based on 50 percent of
the daily maximum flow limit, The fee per facility is
the sum of the following:

When & How Are The Fees
Calculated & Bills Sent?
Previous bills for wastewater permits for this program were
sent in February. 1992, March, 1993 and May, 1994,

The fee calculation method is as follows:
• The fee is based on the permitted flow limits and
traditional pollutant limits without regard to the actual
amount or quality of the discharge for the permitted
facility. Fees are calculated from the permit limits in
effect on September 1.
What Are The Definitions
Of Those Terms?
The following definitions will help understand the fee
calculation method;
• Uncontaminated Flow: Non -contact cooling water or
mixed flows which contain at least 90 percent non -
contact cooling water and not more than i MGD of
Process wastewater.
• Contaminated Flow: Sanitary sewer wastewater,
Process wastewater, or mixed wastewater containing
more than 10 percent process wastewater.

What Is The "FY"?
What Does It Mean?
The "FY" is the "Fiscal Year" of the Commission. It is the
time period from September 1 through August 31, which is
also the period that the fee assessment and payment covers.
What If The Fees Shown On The Bill
Are Not Correct?
Any request for recalculation of fees must be submitted
In writing, and the amount not in question must be paid
by due date. Please refer to the back of the bill for
additional information, including the telephone number

If 1 Am Not Able To Pay The Fee
By The Due Date, Will MY Permit Be
Cancelled Or Another Action Taken?
When a wastewater permit comes up for renewal, it will be
delayed until your delinquent fees are paid. However,
permit renewal will not be delayed if a request for recalcula-
tion of the fee was properly submitted but has not yet been
processed by TNRCC staff. Also, please note: there is
now a provision in the rules for Interest penalties for
delinquent fees.
Do 1 Send Part Of The Bill With
The Payment?
The payment coupon (top part of bill) must be sent with the
payment to assure credit to the proper account.
if I Have A Wastewater Permit
And A Water Use Permit, Will I
Be Billed For Both? When Are
Bills Sent For Water Rights?
Where a municipal or industrial water right is for use in
association with a facility or operation for which there is also
a wastewater permit, that municipal or industrial water use
authorization is exempt from these fees. Other water rights,
except those for irrigation, will be billed soon after this
wastewater billing.

Permit, Or Of The Fee Rules?
A copy of your permit maybe obtained by contacting
TNRCC's Record Services at 512/239-0900. There is a
small fee for copying.
For information on where to obtain copies of fee rules (TAC.
Sections 320.21-12) for this program, contact the TNRCC
Publications Unit at 512/239-0028 and request a copy of
C90-09, Obtaining the Rules.
If you have a PC and modem, you can dial 51223M700 to
reach the TNRCC OnLine Bulletin Board System (BBS).
The BBS contains information about the TNRCC and the
environmental services the agency provides. It supports up
to 14,400 baud modems and follows most common commu-
nication settings: NO parity, 8 databits, 1 s'topbit, FWI
duplex (N,8, IX). If you should have trouble accessing the
BBS, call 5121239-0911.
If My Permit Has Expired, Do I Still
Owe The Fee?
If your permit expired before September 1, 1995, the fee is
not Owed.
More Is The Wastewater
Treatment facility Located?
The authorized location of the wastewater treatment facility
(W WTF) is described on the front page of your permit. The
Permitted parameters are included in the body of the permit,
usually beginning on the second page.
Now Much Time Do 1 Have To Pay
The Fee?
This fee is due 30 days after the invoice date shown on
the invoice.
