ORDINANCE NO.
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM GENERAL RETAIL (GR) TO PLANNED DEVELOPMENT (PD) ZONING
DISTRICT CLASSIFICATION AND USE DESIGNATION FOR APPROXIMATELY 8.278
ACRES OF LAND KNOWN AS CARRIAGE SQUARE SHOPPING CENTER AND BOUNDED
BY EAGLE DRIVE, INTERSTATE 35-E, AVENUE C AND COLLIER STREET;
PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR
VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Mayse & Associates, Inc., in behalf of Westdale Asset
Management, has applied for a change in zoning from General Retail
(GR) to the Planned Development (PD) Zoning District Classification
and Use Designation and for approval of a detailed plan for
residential uses; and
WHEREAS, on February 23, 1994, the Planning and Zoning Commis-
sion, after a public hearing, recommended approval of the requested
change in zoning and approval of the detailed plan; and
WHEREAS, the City Council finds that the change in zoning and
approval of the detailed plan will be in compliance with the Denton
Development Plan; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I. That the zoning district classification and use
designation of the 8.278 acres of land described in Exhibit "A",
attached hereto and made a part hereof for all purposes, is changed
from General Retail (GR) to planned development (PD) zoning
district classification and use designation under the comprehensive
zoning ordinance of the City of Denton, Texas.
SECTION II. That Exhibit "B", attached hereto and made a part
hereof for all purposes, is approved as the Detailed Plan for the
district.
SECTION III. That the city Is official zoning map is amended to
show the change in zoning district classification.
SECTION IV. That the district shall be subject to the
following conditions:
1. Compact car parking spaces, not to exceed ten percent of the
required spaces, may be provided at any location within the
parking lot.
2. The eleven (11) parking spaces shown along the rear loading
docks near Collier Street are allowed, not required, to be
paint -striped. All other parking spaces shall be striped.
SECTION IV. That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000.00. Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense.
SECTION V. That this ordinance shall become effective fourteen
(14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be pub-
lished twice in the Denton Record -Chronicle, the official newspaper
of the City of Denton, Texas, within ten (10) days of the date of
its passage.

BEING all of Block 1 of Golden Triangle Subdivision as
recorded in Volume 4, Page 28, Mop Records of Denton County,
Texas:
BEGINNING at a 1/2 inch iron rod in the north right—of—way
of Interstate Highway 35E and the east right—of—way of
Avenue C:
THENCE N902'30"W along the east right—of—way of Avenue C
a distance of 995.0 feet to a 1/2 inch iron rod found for
corner, said corner also being in the south right—of—way
of Eagle Drive;
THENCE S89'54'00"E, leaving the east right—of—way of
Avenue C and along the south right—of—way of Eagle Drive a
distance of 332.0 feet to a set 'PK' nail set in concrete for
corner;
THENCE south, leaving the south right—of—way of Eagle Drive
and along the west right—of—way of Collier Street a distance
of 1160.5 feet to a set PK nail for corner;
THENCE N89'53'20'W leaving the west right—of—way of
Collier Street a distance of 43.0 feet to o set PK nail for
corner, said corner being in the north right—of—way of
Interstate 35E;
THENCE in a northwesterly direction along the north
right—of—way of Interstate 35E along a curve to the left
whose tangent bears N58'48'3eW having a radius of 7740.0
feet, a central angle of 2'27'46', and arc distance of 332.69
feet to the POINT OF BEGINNING and CONTAINING 8.278 acres of
land more or less.
