AN ORDINANCE OF THE CITY OF DENTON, TEXAS, DESIGNATING THE PROPERTY
LOCATED AT 1004 WEST OAK STREET AS A HISTORIC LANDMARK UNDER
SECTION 35-215, ARTICLE V OF CHAPTER 35 OF THE CODE OF ORDINANCES;
PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR
VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Historic Landmark Commission and the Planning and
Zoning Commission of the City of Denton have recommended that the
property herein described be designated as a historic landmark in
the City of Denton; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I. That the property located at 1004 West Oak Street,
being more particularly described in Exhibit A attached hereto and
incorporated herein by reference, is hereby designated as a
historic landmark under Section 35-215, Article V of Chapter 35 of
the Code of Ordinances of the City of Denton, Texas.
SECTION II. That said property herein described shall be indi-
cated upon the zoning map of the City of Denton as a historic land-
mark by the letter "H", and the property herein described shall be
subject to all the terms, provisions and requirements of Section
35-215, Article V of Chapter 35 of the Code of Ordinances of the
City of Denton, Texas, and such designation shall be in addition to
any other use designation established in the City's zoning ordi-
nance applicable to such property.
SECTION III. That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000.00. Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense.
SECTION IV. That this ordinance shall become effective
fourteen (14) days from the date of its passage, and the City
Secretary is hereby directed to cause the caption of this ordinance
to be published twice in the Denton Record -Chronicle, the official
newspaper of the City of Denton, Texas, within ten (10) days of the
date of its passage.

FIELD NOTES to all that certain tract of land situated in the E.
Survey Abstrac.t Number 996, City of Denton, Denton.Count and being
that part of Lots 2 and 3 of the W.H. Mounts Addition as�shown ap and being
thereof recorded in Volume 35, Page 381 of the Deed Records of Denton tCouoty,
Texas described in the Deed from H. J. Talley at ux to H, W, Lantrip at ux
recorded In Volume 316, Page 314 of the said Deed Records; the subject tract
being more particularly described as. follows:
BEGINNING for the Southeast Corner of the herein described tract at the
Southeast Corner of the Lantrip Tract in the North Line of Nest Oak Street at a
1/2 inch iron rod found pt the Southwest Corner of the tract described in the
Deed from Mylrafn House to Ray Moyers at ux recorded in Volume 1211, Page 360
of the Real Property Records of Denton County, Texas, and being called feet West of the Southeast Corner of Lot 2 of the Mounts Addition; to be 65
THENCE North 89 Degreea 04 Minutes 30 Seconds Oak Street, West with the North Line of Neat
passing at 46 feet the -Southwest Corner of Lot 2 and the Southeast
Corner of Lot 3 and continuing along the came course, in all, a total distance
Of 115.56 teat to a 1/2 inch Iron rod set for the Southwest Corner of the
Lantrip Tract and the Southwest Corner of the tract described in the Deed from
-George Hopkins to Delta Sigma Phi Fraternity recorded in Volume 816, Page 394
Of the said Deed Records and being East 0.4 feet from the edge of a concrete
retaining wall;

Street, passing the Northeast Corner of Lot 3 and the Northwest Corner of Lot 2
and continuing along the same course, is all, a total distance of 115.56 fact
to a 1/2 inch iron rod found at the Northeast Corner of the said Moyers Tract;
THENCE South 01 Degrees 13 Minutes 10 Seconds West severing Lot 2 along an
established hedge a distance of 194.2 feet to the PLACE OF BEGINNING and
enclosing 0.51 of an acre of land.
