ORDINANCE NO.
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM ONE -FAMILY (SF-7) TO PLANNED DEVELOPMENT (PD) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR 1.068 ACRES OF LAND LOCATED
AT THE NORTHWEST CORNER OF AVENUE A AND UNDERWOOD STREET; PROVIDING
FOR THE APPROVAL OF A DETAIL PLAN; PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF; PROVIDING FOR
PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Zeta Tau Alpha Housing Corporation has applied for a
change in zoning for 1.068 acres of land from SF-7 to Planned
Development District; and
WHEREAS, on April 13, 1994, the Planning and Zoning Commission
recommended approval of the requested change in zoning; and
WHEREAS, the City Council finds that the change in zoning will
be in compliance with the Denton Development Plan; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I. That the zoning district classification and use
designation of the 1.068 acres of land described in Exhibit A,
attached hereto and incorporated into this ordinance by reference,
is changed from One -family (SF-7) to Planned Development (PD)
zoning district classification and use designation under the
comprehensive zoning ordinance of the City of Denton, Texas.
SECTION II. That Exhibit B, attached hereto and incorporated
into this ordinance by reference, is approved as the Detail Plan
for the district in accordance with Division 2 of Article IV of
Chapter 35 of the Code of Ordinances.
SECTION III. That the City's official zoning map is amended to
show the change in zoning district classification.
SECTION IV. That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000.00. Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense.
SECTION V. That this ordinance shall become effective fourteen
(14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record -Chronicle, the official
newspaper of the City of Denton, Texas, within ten (10) days of the
date of its passage.

COUNTY OF DENTON; WHEREAS We Zeta Tau Alpha National housing
Capitation are the owners of that certain lot trap or parcel of land situated In the
E. Puchalsid Survey Abstract Number 996, in the City and County of Denton,
Texas, being a pan of that certain tract conveyed by deed from Jess Burch, at al to
Alfred Dooley and wife Ruth Dooley recorded In Volume 312, Page 636, Deed
Records, Denton County, Texas, and being all that certain tract of land described
in abandonment of right-of-way by ordinance 90-005, recorded in Volume 2741.
Page 704. Real Property Records, Denton County, Texas, and being more
particularly described as follows:,
BEGINNING at an iron rod found for corner to the west line of Avenue A. a public
roadway having a proposed right-of-way of 60.0 feet, said point being the
southeast cornet of L X 1, of Block 2, of the Ewing Addition, an Addition to the City
of Denton, Denton County, Texas, according to the Plat thereof recorded in
Volume 75. Page 77 of Deed Records of Denton County, Texas, said point also
being the northeast comer of said Dooley tract;
THENCE S 00418' 15' W. pass at 60.08 foot an iron rod found for southeast
corner of that certain tract of land conveyed by deed from Alfred Dooley to Donald
Dooley on September 14, 1953, a total distance of 158.65 feet with said west line
of said Avenue A, to an iron rod set for corn(, said point being the most northerly
point of that certain (called) 611 square feet trap of land described in Quitclaim
deed from the A. P. Dooley Estate to the City of Demon, Texas, recorded in
Volume 2741. Page 709, Real Property Records, Denton County, Texas;
THENCE along the arc of a curve to the right, having a central angle of 14' 43' 32'
a radius of 277.50 fact, an arc length of 71.32 feet whose chord bears S 17' 01'
45' W. 71.12 feet with said west line of said Avenue A to an iron rod found for
corner in the original north line of Underwood Street, a public roadway having a
right-of-way of 60.0 foot;
THENCE S 88' 52' 27' W, 8.34 feet with said original north line of said
Underwood Street to an iron rod set for corner, said point biting the northeast
corner of said tract of land described in abandonment of rightof-way;
THENCE along ffe arc of a curve to the right having a central angle of 18'05' 31',
a radius of 270.00 to", on arc length of 85.26 feet, whose chord bears S 34' 12'
00' W, 64.90 feet wildt the east line of said abandonment and with said west line
of said Avenue A to an iron rod set for corner;

THENCE N 00' 12' 5W E, pass at 0.46 feet the southeast corner of that certain
(called) 0.511 acre tract conveyed by deed from J. T. Campwl and wife Mary L.
Campbell to O. T. Morris, recorded in Volume 278, Page 289, Deed Records,
Denton County. Texas, a total distance of 230 36 foot with the west line of said
Mofns tract to an iron rod found for corner, said pant being the northeast corner of
