AN ORDINANCE APPROVING THE PURCHASE OF A UTILITY EASEMENT FROM
WINNIE FERN SAULS, AUTHORIZING EXPENDITURE OF FUNDS AND PROVIDING
FOR AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That the City Council authorizes the acquisition
of the easement described in Exhibit "A" attached hereto, from
Winnie Fern Sauls
SECTION II. That the Council authorizes the expenditure of
funds in the amount of Sixty Thousand and no/100 Dollars
($60,000 00) for the purchase of said property
SECTION III That this ordinance shall become effective
immediately upon .its passage and approval

EXHIBIT "A"
TRACT ON
ALL that certain lot, tract, or parcel of land situated in Denton County,
Texas in the D Ground Survey A-489 and in the J Thomas Survey A-1240
and being part of a *ract described in a deed to F E Sauls and wife
Winnie Fern Sauls recorded in Volume 393, Page 211 Deed Records and also
part of a tract described in a deed to Wennie Fern and F E Sauls
recorded in Volume 801, Page 381 Deed Records and being more particularly
described as follows
BEGINNING at a point in the west boundary line of said Ground Survey at
the southwest corner of a 7 94 acre tract fully described in a certain
easement executed by Jess Sauls and wife to the State of Texas and shown
of record in Volume 240, Page 460 D.R D C T ;
THENCE in a northeasterly direction with the southeast right-of-way of
F M 428 the following five (5) courses and distances;
(1) North 450 19' 47• east 299 48 feett (2) North 410 53' 21" east
500 90 feet; (3) North 450 09' 00• east 771 0 feet; (4) North 450
23' 32" east 1,608.22 feet} (5) North 450 32' 260 east 1,515 25 feet;
THENCE leaving said right-of-way line the following seven (7) courses and
distances;
(1) South 010 38' 10" west 72 10 feet; (2) South 450 32' 260 west
1,463 24 feet; (3) South 450 23' 32" west 1,607 94 feet; (4) South
450 09' 00" west 771 16 feet; (5) South 410 53' 21" west 500 89 feet;
(6) South 450 19' 47" west 348.91 feet; (7) North 70.31 feet to the
Point of Beginning and containing 5.3863 acres of land which includes
0 3411 acres of the residence tract leaving a net acreage of 5.0452 acres
there being reserved a 20 feet wide construction easement along the
entire southeasterly line of the above easement.

ALL that certain lot, tract, or parcel of land situated in Denton County,
Texas in the J Thomas Survey A-1240 and being part of a tract described
in a deed to Wennie Fern and F E. Saule recorded in Volume 601, Page 381
Deed Records and being more particularly described as follows
BEGINNING at the intersection of the east line of the First Tract of said
Sauk deed with the northwesterly right-of-way of F M. 428;
THENCE south 450 24' 130 west with said right-of-way 103 48 feet;
THENCE north 10 38' lot east 72.29 feet;
THENCE north 450 24' 300 east 104 72 feet;
THENCE south 20 18' Soo west 73 18 feet to the Point of Beginning and
containing 0.1195 acres also reserved is a 20 feet wide construction
along the entire west side and the entire northwesterly side.
