HomeMy WebLinkAbout1992-023Avine o Oo ORDINANCE NO ('713 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, ABANDONING AND VACATING A PORTION OF VINE STREET SOUTH OF WITHERS STREET AS A PUBLIC STREET, RESERVING A DRAINAGE AND UTILITY EASEMENT THEREIN, AND DECLARING AN EFFECTIVE DATE WHEREAS, the Planning and Zoning Commission has recommended that a portion of Vine Street be abandoned and vacated as a public street and WHEREAS, the City Council of the City of Denton has determined that the easement being vacated is no longer needed for public use, and WHEREAS, the fair market value of the easement has been deter- mined and received, as required by section 272 001 of the Local Government Code, NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That portion of Vine Street described in Exhibit A, attached to and incorporated into this ordinance by reference, is abandoned and vacated as a public street, provided, however, that there is expressly reserved and excepted from vacation and abandonment in the property described, a drainage and public utility easement for the purpose of constructing, reconstructing, repairing, and maintaining drainage and public utilities SECTION II That by reason of such vacation, the City of Denton's property interest in the easement shall by operation of law, revert to the owner or owners abutting the easement herein abandoned and the City of Denton releases any and all claims to the use of the property for street purposes SECTION III That this ordinance immediately upon its passage and appr Val PASSED AND
