AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM ONE FAMILY DWELLING (SF-10) TO PLANNED DEVELOPMENT (PD) ZONING
DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 1 63 ACRES OF LAND
LOCATED ON THE EAST SIDE OF BONNIE BRAE, APPROXIMATELY 800 FEET
SOUTH OF WEST UNIVERSITY DRIVE, PROVIDING FOR APPROVAL OF A
DETAILED PLAN FOR THE DISTRICT, PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, Marilyn Rose Janke has applied for a change in zoning
for 1 63 acres of land from one family dwelling (SF-10) to planned
development (PD) zoning district classification and use designation
and for approval of a detailed plan for the district, and
WHEREAS, on December 11, 1991, the Planning and Zoning
Commission recommended approval of the requested change in zoning,
and
WHEREAS, the City Council finds that the change in zoning and
approval of the detailed plan will be in compliance with the Denton
Development Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zoning district classification and use
designation of the 1 63 acres of land described in Exhibit A,
attached to and incorporated into this ordinance by reference, is
changed from one family dwelling (SF-10) to planned development
(PD) zoning district classification and use designation under the
comprehensive zoning ordinance of the City of Denton, Texas
SECTION II That Exhibit B, attached to and incorporated into
this ordinance by reference, is approved as the Detailed Plan for
the district in accordance with Article IV of Chapter 35 of the
Code of Ordinances
SECTION III That the City's official zoning map is amended to
show the change in zoning district classification
SECTION IV, That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000 Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense
SSECTI0N V That this ordinance shall become effective fourteen
(14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record -Chronicle, the official
newspaper of the City of Denton, Texas, within ten (10) days of the
date of its passage

92-014 TO PROVIDE FOR A CHANGE IN THE DETAILED PLAN FOR PLANNED
DEVELOPMENT (PD) NO 144 ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION, AND IMPOSING A CONDITION FOR 1 63 ACRES OF LAND
LOCATED ON THE EAST SIDE OF BONNIE BRAE, APPROXIMATELY 800 FEET
SOUTH OF WEST UNIVERSITY DRIVE, PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, Gossett Construction, Inc , on behalf of Marilyn Rose
Janke, has applied for an amendment to the detailed plan set forth
in Ordinance 92-014 for 1 63 acres of land in planned development
(PD) no 144 zoning district classification and use designation and
agrees to the imposition of a condition for the district, and
WHEREAS, on February 24, 1993, the Planning and Zoning Commis-
sion, after a public hearing, recommended approval of the requested
changes, and
WHEREAS, the City Council finds that the amended detailed plan
will be in compliance with the Denton Development Plan, NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That Ordinance No 92-014, providing approval of
a planned development district for 1 63 acres of land as described
therein, is hereby amended by approval of a revised detailed plan
for planned development district no 144, as described in said
detailed plan attached hereto as Exhibit "A", incorporated herein
by reference The property therein described shall be constructed,
used, and maintained in accordance with the approved detailed plan,
and shall be subject to the following additional condition
1 The building identified as No 1 on the detailed plan
shall be guttered
SgCTION II That the provisions of this ordinance as they
apply to the 1 63 acres shown in the detailed plan herein approved,
shall govern and control over any conflicting provision of Ordi-
nance No 92-014, but all the provisions of Ordinance No 92-014 as
they apply to that remaining portion of the district not herein
amended, shall continue in force and effect and shall apply to the
remainder of said district
S�}CTION III. That a copy of this ordinance shall be attached
to Ordinance No 92-014, showing the amendment herein approved
SECTION IV. That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000 00 Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense
SECTION V. That this ordinance shall become effective

WHEREAS, on November 5, 1997, the Planning and Zoning Commission, after a public
hearing, recommended approval of the requested changes, and
WHEREAS, the City Council finds that the amended detailed plan will be in compliance with
the Denton Development Plan NOW THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That Ordinance Nos 92-014 and 93-051, providing approval of a planned
development district for 163 acres of land as described therein, is hereby amended by approval of a
revised detailed plan for planned development district No 144, as described in said detailed plan
attached hereto as Exhibit "A", incorporated herein by reference The property therein described shall
be constructed, used, and maintained in accordance with the approved detailed plan, and shall be
subject to the following additional condition
The budding identified as No 2 on the detailed plan shall be guttered to allow for
stormwater runoff in the same manner as the budding identified as No 1 on the
detailed plan
SECTION II That the provisions of this ordinance as they apply to the 1 63 acres shown in
the detailed plan herein approved, shall govern and control over any conflicting provision of
Ordinance Nos 92-014 and 93-051, but all the provisions of Ordinance Nos 92-014 and 93-051 as
they apply to that remaining portion of the district not herein amended, shall continue in force and
effect and shall apply to the remainder of the district
