HomeMy WebLinkAbout1988-1392422L AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AS AMENDED, AND AS SAID MAP APPLIES TO 174 ACRES OF LAND LOCATED APPROXIMATELY 350 FEET NORTH OF U S HIGHWAY 380 NEAR THE ELM FORK OF THE TRINITY RIVER, AS IS MORE PARTICULARLY DESCRIBED HEREIN, TO PROVIDE FOR AN AGRICULTURAL "A" DISTRICT CLASSIFICATION AND USE DESIGNATION, PROVIDING$2,000 00 FOR VIIOLAT ONSFOR THEREOF, ANDYPROVI INGIN AAFOR AN EFFECTIVE DATE WHEREAS, the City of Denton has applied for a zoning designation of an agricultural "A" district classification for 174 acres of land located approximately 350 feet north of U S Highway 380 near the Elm Fork of the Trinity River, and WHEREAS, on July 13, 1988, sion held a public hearing on approval thereof, NOW, THEREFORE, the Planning and Zoning Commis - the application and recommended THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the Zoning Classification and Use designa- tion ap��e to the property described in Exhibit Al attached hereto and incorporated herein by reference, is hereby zoned Agricultural "A" District Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas SECTION II The Zoning Map of the City of Denton, Texas, adopted-t-R—e-14-th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, as amended, is hereby amended to show such designation in District Classification and Use SECTION III That the City Council of the City of Denton, Texas, ere y nds that such designation is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable considers for districts and formong other its peculiar suitability hcharacter f, itability forparticular uses and with a view to conserving the value of the buildings, pro- tecting human and encouraging the most eois landfr the maximumbenefittte Cityof appropriate and its citizens SECTION IV Any person who shall violate a provision of this or nance, or fails to comply therewith or with any of the requirements thereof, or of a permit or certificate issued thereunder, shall be guilty of a misdemeanor punishable by a fine not exceeding Two Thousand Dollars ($2,000 00) Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of this ordinance is committed, or continued, and upon conviction of any such violations such persons shall be punished within the limits above SECTION V That this ordinance shall become effective fourteen days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage (� - PASSED AND APPROVED this the 1�day of 1988 INV ATTEST ivznat /. _%//mlf AMER APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY BY 22 t/W 1 Z-88-012/Page 2 EXHIBIT "A" BEGINNING at a point lying in the present city limits as described in Ordinance 74-36 Tr II, said point lying 350 feet north of and perpendicular to the centerline of U S Highway 380, said point also lying in the east boundary line of said W Dabbs Survey, same being the west boundary line of the J Williamson Survey, Abstract No 1418, s, 350 ofENCE westerly and parallel too thecenterlinecenaid terlines ofitsaidi USS Highway feet north sa distance of 500 0 feet to a point for corner, THENCE north 500 feet west of and parallel to the east boundary line of said Dabbs Survey, passing the north boundary line of said Dabbs ing West Survey, a distance same etance of10esouth boundary for corner, te J THENCE westerly 109060 feet north of and parallel with the said present city limits to a point for corner in the east boundary line of a tract of land conveyed to Bill Lynch by deed and recorded in Volume 6079 Page 526 of the Deed Records of Denton County, Texas, THENCE north along the east boundary line of said Lynch tract a 10,S60cfeet north ofeat nd opear pendicular torthe,saidd presenticity limits, THEN cityClimitsetoy a pointfeet north for corner, £sand id parallel lying inthe thpresent 10,560 the east boundary line of the West Survey, same being the west boundary line of the A.
