HomeMy WebLinkAbout1988-1292189L AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON BY ADDING TWO NEW SECTIONS 2-39 SECTIONAND PFOR COMPETITIVE SEALED PROPOSALSAND PROVIDING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Article III of Chapter 2 of the Code of Ordinances o the City of Denton, Texas is hereby amended by adding a new section, to be numbered Section 2-39 and Section 2-40, which shall read as follows Sec 2-39 Competitive Sealed Proposals In the case of high technology procurements requiring an expenditure exceeding $10,000, the City Manager may follow the com- petitive sealed proposal procedure as authorized by and in accordance with the requirement of Subchapter C of Chapter 252 of the Local Government Code (Vernon's Ann Codes) For purposes of this section, "high technology procurement" means the procurement of equipment, goods, or services of a highly technical nature, including but not limited to information processing equipment, soft- ware and firmware used in conjunction with information processing equipment, telecommunications equipment, radio and microwave systems, electronic distributed control systems (including building energy management systems) as well as technical services related to such equipment and goods Sec 2-40 Procedure for Competitive Sealed Proposals Quotations for competitive sealed proposals shall be solicited through a request for proposals The request for popoals price rands other shallspecify factors eand ithe ve awimportance award of the contract shall be made to the responsible offeror whose proposal is determined to be the most advantageous to the City taking into consideration the relative impor- tance of price and other evaluation factors set forth in the request for proposals The City Manager or his designee may conduct discussions with offerors who submit ualifiedrforsals and the awardhofare thedcontractd Of be reasonably q Offerors shall be treated in accordance with the require- ments of Chapter 252, as amended SECTION II All ordinances or parts of ordinances in force when t-He--p—r0-V-f sions of this ordinance become effective whichrevisions are inconsistent or in conflict with the terms or p containedin this ordinance are hereby repealed to the extent of any such conflict SECTION III That this ordinance shall become effective imme ate y upon its passage PASSED AND APPROVED this ATTEST and approval the e/ day of i�'�(�� 1988 RAY S ENS, AYOR J r E , I E�sEcxtT�Y APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY n I 1 I I 1 i I I 1 1 I 1 I 1 I I Ij II 1 II 11 I 1 I 1 I 1 11 1 1 1 1 I 1
