HomeMy WebLinkAbout1987-1281838L AN ORDINANCE ABANDONING AND VACATING A CERTAIN UTILITY EASEMENT AS DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Denton, Texas has determined that the hereinafter described utility easement, whether one or more, is no longer needed for public use, and WHEREAS, in accordance with the provisions of Texas Revised Civil Statutes, Article 5421c-12, an appraisal of the fair market value of said easement has been obtained, and WHEREAS, in accordance with State law, said easement is being abandoned and vacated in consideration of the receipt of the fair market value thereof, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the hereinafter described easement is abandone7a--a—nT vacated as an easement for public utilities, the easement being more particularly described below All that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, and being part of the J McGowan survey, Abst No 797, and being part of Lot No 4, Block A, of the JVS Addition, an addition to the City/County of Denton, and also being part of a tract of land as conveyed from Teasley Road Joint Venture to Reuel Yarbrough by deed dated 10-25-85 and recorded in Volume 1751, Page 777 of the Deed Records of Denton County, Texas, and more particularly described as follows BEGINNING for the southwest corner of the tract being described herein at a point in the west line of the said lot, said point being 10 12 feet from the southwest corner of said lot, THENCE north 100 00' 00" west with the west line of the said lot a distance of 6 07 feet to a point at the northwest corner of the said 16 foot utility easement, THENCE north 880 48' 32" east with the north line of the said easement crossing said lot a distance of 143 16 feet to a point in the east line of said lot at the northeast corner of the said easement, THENCE south lO 23' 42" east a distance of 6 0 feet to a point for the southeast corner of the herein described tract, THENCE south 880 48' 32" west with a line 6 feet south of and parallel with the north line of the said easement recrossing said lot a distance of 142 25 feet to the PLACE OF BEGINNING and enclosing 856 23 square feet of land SECTION II That said easement, whether one or more, is herein abandoned and vacated, and by operation of law, the City of Denton's property interest in said easement shall revert to the abutting property owner, whether one or more, and the City of Denton hereby releases any and all claims to the use of the property described in said easement referenced herein for the purposes therein described SECTION III That this ordinance shall become effective imme 'lately upon its passage and approval PASSED AND APPROVED this the cq/ — day of , 1987 i ATTEST 1101n NZ 75ER FL ER , ITY SEC TARY APPROVED AS TO LEGAL FORM DEBRA ADAM1 DRAYOVITCH, CITY ATTORNEY PAGE TWO afAl PROPERTY RECOR93 THE STATE. PAGE' AN ORDINANCE ABANDONING AND VACATING A CERTAIN UTILITY EASEMENT AS DESCRIBED HEREIN; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Denton,. No. 797, and bein- part of Lot No. 4, block A, of the JVS Addition, an addition to the City/County of Denton, and also being part of a tract of land as conveyed frum Teasley Road Joint Venture to l<euel Yarbrough by deed dated 10-25-85 and recorded in "Volume 1751, Page 777 of the Deed Records of Denton County, Texas, and more particularly described as follows: BEGINNING for the southwest corner of the tract being described herein at a point in the west line of the said lot, said point being 10.12 feet from the southwest corner of said lot; THENCE north 100 00' 00" west with the west line of the said lot a distance of 6.07 feet to a point at the northwest corner of the said 16 foot utility easement; THENCE north 880 48' 32" east with the north line of the said easement crossing said lot a distance of 143.16 feet to a point in the east line of said lot at the northeast corner of the said easement; THENCE south 10 23' 42" east a distance of 6.0 feet to a point for the southeast corner of the herein described tract; THENCE south 880 48' 32" west with a line 6 feet south of and parallel with the north line of the said easement recrossing said lot a distance of 142.25 feet to the PLACE OF BEGINNING and enclosing 856.23 square feet of land. 377 t 178 n5 t. .Aq VOL ti.PAGE519 SECTION II. That said easement, whether one or more, is herein abandoned and vacated, and by operation of law, the City of Denton'sproperty interest in said easement shall revert to the abutting- property owner, whether one or more, and the City of Denton hereby releases any and all claims to the use of the property described in said easement referenced hereinfor the purposes therein described.
