HomeMy WebLinkAbout1987-112FILE REFERENCE FORM 1 87-112 X Additional File Exists Additional File Contains Records Not Public, According to the Public Records Act Other FILE(S) Date Initials Amended by Ordinance No. 93-140 08/03/93 )R Amended by Ordinance No. 97-299 10/07/97 ) R Amended by Ordinance No. 2011-055 04/05/11 )R 1836L Note Amended by Ordinance No 97-299 NO 92_16Q� AN ORDINANCE AMENDING CHAPTER ONE OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, PRESCRIBING QUALIFICATIONS FOR MEMBERS OF BOARDS AND COMMISSIONS OF THE CITY, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Chapter 1 (General Provisions) of the Code of Ordinances of the City of Denton, Texas is hereby amended by adding article II, which said Article reads as follows ARTICLE II QUALIFICATIONS FOR BOARD AND COMMISSION MEMBERS Section 1-21 (a) Each member, in addition to qualifications prescribed by federal or state law or ordinance, shall be a qualified voter of the City of Denton, Texas and shall not be in arrears in the payment of any taxes or other liabilities due the City (b) The resolution of the City Council of the 24th day of June, 1987, concerning the residency of members of the Airport Advisory Board shall be controlling for purposes of residency requirements for Airport Advisory Board Section 1-22 No member of a Board or Commission of the City that has final decision making authority shall have a financial interest, direct or indirect, in any contract with the City or be financially interested, directly or indirectly, in the sale to or by the City of any land, materials, supplies or services For purposes of this section, Boards and Commissions which have final decision making authority include, but are not limited to, the Planning $ Zoning Commission, the Board of Adjustment, Civil Service Commisssion, and the Building Code Board Section 1-23 Should a board or commission member cease to meet the qualifications prescribed in Sec 1-21 or Sec 1-22, if applicable, hereof or should such member be convicted of a felony during his term of conviction, as the case may removal Section 1-24 service, such failure or be, shall be cause for The provisions of this Article shall not apply to task forces, ad hoc committees or other commissions established by the City Council from time to time to make recommenda- tions with respect to a particular subject or issue and which are not intended to be permanent in nature SECTION II That if any section, subsection, paragraph, sentence,cfause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION III That this imme iate y upon its passage and PASSED AND APPROVED this the ATTEST ordinance shall become effective apprgval �/ day of 1987 RAY IEN OR ER�,T-&,TERS, CITT SECRETARY APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY BY C_
