AN ORDINANCE AMENDING THE 1986-87 BUDGET OF THE CITY OF DENTON,
TEXAS BY APPROPRIATING THE SUM OF TWO HUNDRED FIFTEEN THOUSAND
AND FIVE HUNDRED DOLLARS ($215,500) FROM 1HE UNAPPROPRIATED
BALANCE OF THE GENERAL FUND AND VARIOUS OTHER ACCOUNT FUNDS,
AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH FLOW MEMORIAL
HOSPITAL TO PROVIDE FUNDING FOR THE HOSPITAL, AND DECLARING AN
EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS

Texas is hereby amended by appropriating the sum of $95,000 from
the street construction fund account 100-020-0033-8303 to the
following fund account

That the Mayor is hereby authorized to execute an agreement
between the City of Denton and Flow Memorial Hospital relating
to the provisions of funding for the hospital, a copy of which
is attached hereto and incorporated by reference herein, and the
expenditure of funds pursuant to said agreement is hereby
authorized
SECTION VI
That entry into such agreement shall in no way constitute an
admission that the City of Denton has a legal obligation to
provide funding to Flow Memorial Hospital, the City expressly
denies any such obligation
SECTION VII That this ordinance shall become effective
imme lately upon its passage and approval

WHEREAS, Flow
requested that the
FLOW, and
AGREEMENT BETWEEN THE CITY OF
DENTON AND FLOW MEMORIAL HOSPITAL
Memorial Hospital ("FLOW") has previously
City of Denton ("CITY") provide funding to
WHEREAS, the CITY has not been furnished information that the
hospital is seeking funding for care that has been provided to
individuals who meet the residency and financial eligibility
requirements prescribed by statute,
WHEREAS, there exists a controversy as to the legal
obligation of the CITY to provide funding to FLOW, and
WHEREAS, the parties recognize that the Denton County
Commissioners Court has recently authorized counsel to initiate an
action for declaratory judgment to determine the responsibilities
and obligations of the owners of FLOW, and
WHEREAS, CITY wishes to provide funding for FLOW to allow
necessary health care assistance to be provided to eligible resi-
dents during the time required for the CITY, County and FLOW to
resolve the dispute regarding funding obligations, and
WHEREAS, if it is judicially determined that the CITY has a
legal obligation to provide funding for the provision of indigent
health care, CITY and FLOW wish to provide that any payments made
would be credited toward the satisfaction of any funding obliga-
tion, NOW, THEREFORE, in consideration of the foregoing and of
mutual covenants and arguments contained herein, the parties
hereto covenant and agree as follows
SECTION I
The CITY hereby agrees to appropriate $200,000 to FLOW for
the sole purpose of allowing FLOW to provide health care
assistance to eligible individuals during the time required for
the City, County and Flow to resolve the dispute regarding
funding obligations Both CITY and FLOW agree that such
appropriation in no way constitutes an admission that CITY has
any legal obligation, statutory or otherwise, to provide funding
for the indigent health care needs of Denton and/or Denton County,
which obligation is expressly denied
SECTION II
In the event that it is judicially determined that the CITY
does have a legal obligation to provide funding for indigent
health care, the parties agree that the payment provided for in
this agreement shall be credited towards the fulfillment of any
such obligation
