HomeMy WebLinkAbout1987-0161669L i j AN ORDINANCE DESIGNATING AND ESTABLISHING A SCHOOL SAFETY SPEED ZONE ON PAISLEY DRIVE FROM A POINT APPROXIMATELY 200 FEET WEST OF ITS INTERSECTION WITH MACK DRIVE TO A POINT 130 FEET EAST OF MACK DRIVE, AND ON MACK DRIVE FROM THE SOUTHERN CURB LINE OF ITS INTERSECTION WITH LEE DRIVE TO THE SOUTHERN CURB LINE OF DOUBLE OAK STREET ITS INTERSTINTHE MAXIMUM PRIMA FACIE SPEED LIM OT FROMH THIRTY (30) TOMACK DRIVE,REDUCING TWENTY (20) MILES HOUR,EXCEED TWO HUNDREDEDOLLLARS ($0200DING 00),APROVIDINGPENALTYOA SEVERABILITY A FINE NOTOCLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I Based upon an engineering and traffic investigation, the City Council hereby designates and establishes a school zone on Paisley Drive from a point approximately 200 feet west of its intersection with Mack Drive to a point 130 feet east of Mack Drive, and on Mack Drive from the southern curb line of its intersection with Lee Drive to the southern curb line of Double Oak Street at its intersection with Mack Drive, and hereby determines that the reasonable and safe maximum prima facie speed limit on said portions of Paisley Drive and Mack Drive is twenty (20) miles per hour when school is in session between the hours of 7 30-9 00 A M and 2 30-4 00 P M SECTION II When signs are erected giving notice thereof and when school is in session at the Robert E Lee Elementary School, the reasonable and safe maximum prima facie speed limit on said portions of Paisley Drive and Mack Drive shall be reduced from thirty (30) to twenty (20) miles per hour SECTION III An individual adjudged guilty of exceeding this speed limit, when signs are erected giving notice thereof, shall be guilty of a misdemeanor, and punished by a fine not to exceed Two Hundred Dollars ($200 00) SECTION IV That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this theeqiO��day of , 1987 RAY ST P` NS, MAYOR CITY OF DENTON, TEXAS ATTEST J N S ACT G CIT SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY CITY OF DENTON, TEXAS L �: 4 /I11"M _.
