Home My WebLink About1984-022NO 2 CAL AN ORDINANCE PROVIDING FOR THE ABANDONMENT OF A PORTION OF A TRACT OF LAND DEDICATED FOR UTILITY AND STREET RIGHT-OF-WAY WITHIN THE CITY OF DENTON AND AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED CONVEYING ALL RIGHT, TITLE AND INTEREST OF THE CITY IN SAID LAND TO THE OWNER OF THE ADJACENT TRACT OF LAND, AND DECLARING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Denton, Texas acting pursuant to law, and upon the request and petition of the grantee herein, deems it advisable to abandon and convey the hereinafter described tract of land to grantee and is of the opinion that said portion of land is not needed for public use and that same should be abandoned and quitclaimed to E W Belcher, et ux WHEREAS, the City Council of the City of Denton is of the opinion that the beat interest and welfare of the public will be served by abandoning and conveying the same to E W Belcher, et ux, for the consideration hereinfter more fully set forth, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS SECTION I That the following described tract of land in the City of Denton, Texas be and the same is hereby abandoned, vacated and closed insofar as the right, title and interest of the public are concerned All that certain tract or parcel of land that is situated in the Alex Robertson Addition to the City of Denton, said addition being situated in the A Hill Survey, Abstract No 623, Denton County, Texas, said tract or parcel being a portion of Ruth Street as dedicated, and being more fully described as follows BEGINNING at the northwest corner of the intersection of Ruth Street and Cook (Ross) Street, THENCE south 004147" east along the west right-of-way line of Cook (Ross) Street a distance of 50 00 feet to an iron pin, THENCE south 88056'14" west along the south right-of-way line of Ruth Street a distance of 204 01 feet to an iron pin, THENCE north 005'0" west along the west end of Ruth Street a distance of 50 00 feet to an iron pin, THENCE north 88056'14" east along the north right-of-way line of Ruth Street a distance of 204 01 feet to the point of beginning and containing 10199 1 square feet of land SAVE AND EXCEPT the City of Denton retains a 16' utility easement across the north portion of this tract of land SECTION II That the Mayor and City Secretary are hereby authorized to execute and deliver that certain quitclaim deed attached hereto and incorporated herein conveying said tract of land described therein to E W Belcher, et ux SECTION III That portion of the tract of land herein described being vacated, abandoned, and closed is made subject to all existing zoning regulations and deed restrictions, if any, and subject to all existing easement rights of others, if any, whether apparent or not SECTION IV This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained PASSED AND APPROVED this the y of 984 1 'Je7z�4 CIT ATTEST OF DE TON, TEXAS CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS THE STATE OF TEXAS, I COUNTY OF DENTON KNOW ALL MEN BY THESE PRESENTS That The City of Denton, Texas, a Municipal Corporation of the County of Denton and State of Texas , for and in consideration of the sum of -
