That Chapter 28, Section 28-28(4) of the Code of Ordinances of the City of Denton is hereby amended so that said section shall hereafter be and read as follows (4) Section 107 3 Plan Reviewfees Section 107 3 is amended to read as follows The applicant shall submit the applicable plan review fee as set by City Council by ordinance, and the fee schedule shall be available for public inspection at the offices of the Building Official and the City Secretary SECTION 111, That Chapter 28, Section 28-28(7) of the Code of Ordinances of the City of Denton is hereby amended so that said section shall hereafter be and read as follows (7) Section 108 8 Reinspections The fourth paragraph of section 108 8 is amended to read as follows To obtain a reinspection, the applicant shall pay the applicable remspection. fee as set by City Council by ordinance and then request an inspection in the manner prescribed by the building official The fee schedule shall be available for public inspection at the offices of the Building Official and the City Secretary SECTION IV, That Chapter 28, Sections 28-28(9)a and 28-28(9)b (1) — (7) of the Code of Ordinances of the City of Denton are hereby amended so that said section shall hereafter be and read as follows (9) Building Permit Fees a Building Permit Fees for Nonresidential Buildings and Additions and Repairs to Residential Buildings b Other Inspections Fees The City Council shall set a fee schedule for building permit fees and other inspections fees by ordinance and the fee schedules shall be available for inspection at the offices of the Building Official and the City Secretary SECTION V. That Chapter 28, Section 28-28(10) of the Code of Ordinances of the City of Denton is hereby amended so that said section shall hereafter be and read as follows (10) Permit Fee ScheduleforNew One- and Two -Family Dwellings The City Council shall set a fee schedule for new one and two-family dwellings by ordinance and the fee schedule shall be available for public inspection at the offices of the Building Official and the City Secretary SECTION VI. That Chapter 28, Sections 28-121(l) — (12) of the Code of Ordinances of the City of Denton is hereby amended so that said section shall hereafter be and read as follows See 28-121 Inspection fees The applicant shall submit the applicable electrical inspection fees as set by City Council by separate ordinance before the issuance of any permit required by this division The fee schedule shall be, available for public inspection at the offices of the Building Official and the City Secretary SECTION VII That Chapter 28, Section 28 210(f) of the Code of Ordinances of the City of Denton is hereby amended so that said section shall hereafter be and read as follows, and that Section 28-210(g) is hereby deleted (f) The applicant shall pay for each permit issued, at the time of issuance a plumbing permit fee as set by City Council by ordinance and the fee schedule shall be available for public inspection at the offices of the Building Official and the City Secretary SECTION VIII, That Chapter 28, Sections 28-252(9) and (10) of the Code of Ordinances of the City of Denton is hereby amended so that said section shall hereafter be and read as follows (9) Mechanical Permit Fees Table No I -A Mechanical Permit Fees is amended to read as follows The applicant shall submit the applicable mechanical permit fees as set by City Council by ordinance and the fee schedule shall be available for public inspection at the offices of the Building Official and the City Secretary (10) Table ]-A Other Inspections and Fees Table No I A is amended to read as follows The applicant shall submit the applicable inspections, reinspection, and plan review fees as set by City Council by ordinance and the fee schedule shall be available for public inspection at the offices of the Building Official and the City Secretary SECTION IX That Chapter 28, Section 28-297(3) of the Code of Ordinances of the City of Denton is hereby amended so that said section shall hereafter be and read as follows (3) Section 18 Schedule offees Section 18 is amended to read as follows The applicant shall submit the applicable fee for a swimming pool as set by City Council by ordinance and the fee schedule shall be available for public inspection at the offices of the Building Official and the City Secretary SECTION X. That chapter 28 of the Code of Ordinances, of the City of Denton, Texas is hereby amended by the addition of Section 28-32 to be hereafter read as follows See 28-32 Exemptions from fees Not withstanding any other provision of this Chapter or the Building Code, the City of Denton and any other political subdivision or agency of the State of Texas or the United States Government shall be exempt ftom payment of any fees required by this chapter SECTION XI, That Ordinances 83-129 and 90-161 of the City of Denton are hereby repealed SECTION XII ' That the Fee Schedules set forth in Exhibit 'A , containing Tables I A, I-B, 2, 3-A, 3-B, 3-C, 4, 5, and 6, attached hereto and made a part hereof for all purposes, is hereby adopted and authorized to be imposed for the filing of applications, review, approval grant or issuance of permits, inspections, licenses, certificates variances or designations required by the "Buildings and Building Regulations"and "Sign and Advertising Devices" as authorized by Chapters 28 and 33 respectively, of the Code of Ordinances of the City of Denton SECTION XHI That tins ordinance shall repeal every prior ordinance in conflict herewith, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections of the ordinance not in direct conflict herewith, this ordinance shall be and is hereby made cumulative except as to such prior ordinances or portions thereof as are expressly repealed hereby SECTION XrV. That if any provision of this ordinance or application thereof to any person or circumstance is held invalid by any court, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares that it would have enacted the remaining portions despite any such validity SECTION XV.
