HomeMy WebLinkAbout1983-075AN ORDINANCE REPEALING AND REENACTING SECTIONS 24-134 AND 24-135 OF CHAPTER 24, ARTICLE V OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, RELATING TO PARKING NOR DISABLED PERSONS, PROVIDING FOR THE MARKING OF PARKING SPACES FOR DISABLED PERSONS, PROVIDING FOR THE EXCLUSIVE USE OF SUCH SPACES BY VEHICLES WITH SPECIAL LICENSE PLATE DEVICES OR IDENTIFICATION CARDS ISSUED BY 1HE TEXAS STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR DISABLED PERSONS, PROVIDING A PENALLY OF A FINE OF NOT LESS THAN FIFPY DOLLARS NOR MORE THAN TWO HUNDRED DOLLARS, PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENFON HEREBY ORDAINS SECTION I That Section 24-134 of Chapter 24, Article V of the Code of Ordinances of the City of Denton, Texas, is hereby repealed and reenacted in its entirety to hereafter as follows Section 24-134 DESIGNATION OF PARKING SPACES FOR DISABLED PERSONS (a) A person who owns or controls property used for parking may designate one or more parking spaces for the exclusive use of vehicles transporting temporarily or permanently disabled persons Such parking spaces shall be designated by posting immediately adjacent to and visible from each space a nonmovable sign that (1) has a notice of the penalty for a violation of Section 10, Article 6675a-5e 1, Vernon's Texas Civil Statutes, (2) is permanently mounted on a pole at least five feet in height, (3) has a profile view of a wheelchair with an occupant in white on a blue background, and (4) meets the design criteria established by the Texas State Department of Highways and Public Transportation (b) Illustrations of sign design criteria of the Texas State Department of Highways and Public transportation is depicted by Figures 1 as follows [Instructions to the Editor Insert Figure 1 attached hereto and incorporated herein by reference J SECTION II That Section 24-135 of Chapter 24, Article V of the Code of Ordinances of the City of Denton is hereby repealed and reenacted in it entirety ato hereafter read as follows Section 24-135 PARKING OF UNAUTHORIZED VEHICLES IN SPACES DESIGNATED FOR DISABLED PERSONS PROHIBITED, PENALTY (a) It shall be unlawful for any person, firm, or corporation to stop, stand, park or leave standing any vehicle not displaying a specially designed symbol, tab, or other device issued by the Texas State Department of Highways and Public Transportation affixed to the license plates of such vehicle indicating the operator thereof or a passenger therein is permanently disabled nor any vehicle not displaying an identification card issued by the Department indicating the operator of such vehicle or a passenger therein is temporarily disabled in any parking space designated as exclusive parking for disabled persons pursuant to Section 24-134 of this Article (b) Any person adjudged guilty of parking a vehicle in violation of this ordinance shall be guilty of a misdemeanor and punished by a fine of not less than Fifty Dollars ($50 00) nor more than Two Hundred Dollars ($200 00) SECTION III That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is PAGE 2 hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the � day of 1983 CIT OF D NTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS L-a 0 BY PA6E 3 9 Figure 1 NO. , SECTION 24-134 (b) ala ale — — — - — --- �y�, 1 112 a Z �---- 4 718 --�^ KvAPfCa t LS E F A �� #�__ 314 y ++i 3 7/8— ""-3 ( i2 R7-8 50-200 FINE 'YiTHQUT VEHICLE PERMIT 2C 1 2C 1 COLORS LEGE14D AND BOROCR-OMEN BACKGROW 0 WK-E WKTE 5"MSOL ON BLUE BACKGROM 6 �' (...( .�c a a�,d.t .curt .r•e-s W�OI Vs( AS ST.1W �A 1(;
