HomeMy WebLinkAbout1983-054NO AN ORDINANCE GRANTING A SPECIFIC USE PERMIT AND AMENDING IHE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 4 5 ACRES OF LAND IN THE CITY AND COUNTY OF DENTON, TEXAS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the following described property, to -wit All that certain 3 178 acre tract of land, or parcel of land situated in the Wm Daniels Survey, Abstract No 378, City and County of Denton, Texas, said tract being part of lands shown by deeds from Gibson to Welch as recorded in Volume 333, Page 397 and Volume 362, Page 169 of the Deed Records of Denton County, Texas, said tract being further described herein by metes and bounds as follows BEGINNING for the southeast corner of tract being described herein, at a right of way marker found at the northeast corner of tract described in deed to Rene Cassar as recorded in Volume 1081, Page 756 of the Deed Records of Denton County, Texas (locally known as part of Center Point Mobile Home Park), THENCE west 629 45 feet generally along fence to an iron pin found at angle point in fence line, THENCE north 89043109" west 198 58 feet to the southwest corner of aforementioned tract as shown by deed recorded in Volume 362, Page 169 of said Deed Records, THENCE north 1057124" west 25 0 feet to the most western northwest corner of said tract, THENCE south 89032126" east 198 59 feet to iron pin found at fence corner, THENCE north 1059129" west 224 36 feet to an iron pin found at fence corner THENCE south 89053143" east 459 0 feet to a point in north line of aforementioned Cassard tract, THENCE 4124146" east 248 2 feet parallel to the western line of U S Highway No 377 to a point, THENCE south 89053143" east 160 0 feet to a point in the western line of said U S Highway No 377, THENCE south 4*24146" east 114 2 feet to the place of beginning which is classified as Light Industrial "LI" District Llassifi- cation Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas is hereby changed and a Specific Use Permit is 5-164-W Y TUNNICLIFF-PAGE 1 hereby granted for the use of said property for an extension of a mobile home park known as Center Point Mobile Home Park to accommodate twenty (20) additional lots or stands, subject to the following conditions and restrictions to -wit 1 Plans for development and the development itself shall conform with the Mobile Home Park and Travel Trailer Ordinance and subdivision regulations of the City of Denton prior to the issuance of building permits and certificates of occupancy, 2 Development shall conform to approved site plan or plot plan, 3 A six foot (61) solid wooden fence shall be erected on all property lines that abut land uses that are not mobile home or travel trailer parks, 4 A ten foot (101) rear yard and side yard setback shall be observed The development of the property shall be in substantial compliance with the site plan attached hereto and made a part hereof for all purposes The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, be, and the same is hereby amended to show such change in District Classification and Use SECTION II That the City Council of the City of Denton, Texas hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION III That this ordinance shall be in full force and effect immediately after its passage and approval, the required public 5-164-W Y TUNNICLIFF-PAGE 2 hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the Lity of Denton, Texas, after giving due notice thereof PASSED AND APPROVED this the _L7day of 1983 VCITJ OF ll TON, TEXAS ATTEST L CHARLOTTE AN,SECRE CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS BY � S-164-W Y TUNNICLIFb-PAGE 1
