HomeMy WebLinkAbout1982-101NO -/0/ AN ORDINANCE PROVIDING THE ABANDONMENT OF A UTILITY EASEMENT WITHIN THE CITY OF DENTON AND AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED CONVEYING ALL RIGHT, TITLE AND INTEREST OF THE CITY IN SAID BASEMENT TO THE OWNER OF THE TRACT OF LAND CONVEYED BY SAID EASEMENT, AND DECLARING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Denton, Texas, acting pursuant to law, and upon the request and petition of the grantee herein, deems it advisable to abandon and convey the hereinafter described tract of land to grantee and is of the opinion that said utility easement is not needed for public use, and that same should be abandoned and quitclaimed to John R Fields and Birda L Chavers as hereinafter provided, and WHEREAS, the City Council of the City of Denton, Texas, is of the opinion that the best interest and welfare of the public will be served by abandoning and conveying the same to John R Fields and Birda L Chavers for the consideration hereinafter more fully set forth, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DENTON SECTION I That the following described tract of land in the City of Denton be and the same is hereby abandoned, vacated and closed insofar as the right, title and easement of the public are concerned Being a portion of Lot 14, Block D, Willowwood West, an Addition to the City of Denton, Denton County, Texas, according to the Replat recorded in Cabinet B, Page 13, Plat Records of Denton County, Texas, and Being the north six (6) feet of the west four (4) feet of a certain sixteen (16) foot by thirty (30) foot easement located in the southeast corner of said Lot 14, Block D, as shown on the plat thereof SECTION II That the Mayor and City Secretary are hereby authorized to execute and deliver that certain quitclaim deed attached hereto and incorporated herein conveying said utility easement described therein to John R Fields and Birda L Chavers PAGE ONE SECTION III That portion of the public utility easement herein described being vacated, abandoned, and closed is made subject to all existing zoning regulations and deed restrictions, if any, and subject to all existing easement rights of others, if any, whether apparent or not SECTION IV This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained PASSED AND APPROVED by the City Council of the City of Denton, Texas, this the 23rd day of November, 1982 IT OF DE TON, TEXAS CITY OFVDENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS BY T /' - - ---F- PAGE TWO Tal" ar".0m ►air of &XtB, Kum $611 ern bg par frratub: 900ft of DENTON That THE CITY OF DENTON, TEXAS Of the County of Denton and State of Texas for and in consideration of the sum of TEN AND NO/00 ($10 00) DOLLARS to it in hand paid by JOHN R FIELDS and BIRDA L CHAVERS of the County of Denton and State of Texas , the receipt of which is hereby acknowledged, do es , by these presents BARGAIN, SELL, RELEASE, AND FOREVER QUIT CLAIM unto the said JOHN R FIELDS and BIRDA L CHAVERS, their heirs and assigns, all its right, title and interest in and to that certain tract or parcel of land lying in the County of Denton , State of Texas, described as follows, to -wit Being a portion of Lot 14, Block D, WILLOWWOOD WEST, an Addition to the City of Denton, Denton County, Texas, according to the Replat recorded in Cabinet B, Page 13, Plat Records of Denton County, Texas, and Being the North six (6) feet of the West four (4) feet of a certain sixteen (16) foot by thirty (30) foot easement located in the Southeast corner of said Lot 14, Block D, as shown on the plat thereof, It is the intent of the grantor herein to abandon the above described portion of the said easement as the same is shown on the recorded plat of the Addition The mailing address of the Grantees herein is 1806 Highland Park Road, Denton, Texas, 76201 TO HAVE AND TO HOLD the said premises, together with all and singular the rights, privileges and appurtenances thereto in any manner belonging unto the said JOHN R FIELDS and BIRDIE L CHAVERS, their heirs and assigns forever, so that neither Grantor the said City of Denton, Texas, nor its successors, nor AkAk A��any person or persons claiming under it shall, at any time hereafter, have, claim, or demand any right or title to the aforesaid premises or appurtenances, or any part thereof WITNESS /the execuudtion heat eof Denton, Texas this 14 day of October A D 1982 Witness at request of Grantor CITY OF DENTON, TEXAS RI CHARD O STEWART, MAYOR DEPUTY CIT" SECRETARY-- , 3 , TO ALL @A ub is, to It t No is logo" C" 4qn ry�l P�£v I 46U* >r Sala � �n �Y Al r K ' i3 t ✓ M Y I 8 + t + I r v P�.,; %l' k } f f v I a 5 e i 1 aCy �"3 F t x t M f ari 'toll , r jit T N... l ..
