AN ORDINANCE AMENDING ARTICLE 12 AND ARTICLE 15 OF APPENDIX
B-ZONING OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS,
1966, AS AMENDED RELATING TO OFF-STREET PARKING, PROVIDING A
SEVERABILITY CLAUSE, PROVIDING FOR A PENALTY NOT TO EXCEED TWO
HUNDRED DOLLARS ($200 00), AND PROVIDING FOR AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, HEREBY ORDAINS
SE�TION I
That Article 12, A (24) of Appendix B-7oning of the Code of
Ordinances of the City of Denton, Texas, 1966, as amended, is
hereby amended to read as follows
"(24) OFF-STREET PARKING INCIDENTAL TO MAIN USE Off-
street parking spaces provided in accordance
with the requirements specified by ordinance and
located on the same lot or tract occupied by the
main use "
SECTION II
That Article 15, C ("Special off-street parking regula-
tions") of Appendix B-Zoning, of the Code of Ordinances of the
City of Denton, Texas, 1966, as amended, is amended by adding a
new Article 15, C (4) to read as follows
"(4) Off-street parking to serve a building or use of
land may be provided on a tract or parcel of land
other than on which the building or use being
served is located under the following conditions
a The tract or parcel of land on which the
building or use is located has been developed
so as to provide as much parking space thereon
as could reasonably be used for such purpose
b The building or use being served by any remote
off-street parking space which is necessary to
meet parking requirements shall not be
occupied or used until the owner of the parcel
or tract of land to be used for remote
off-street parking space has executed and
recorded a Declaration of Restriction, legally
binding, to restrict the use of the tract or
parcel of land used for remote off-street
parking space for parking purposes for so long
as the site being served shall require such
parking space
c Once any off-street parking space has been
provided to meet the requirements of any
zoning ordinance, such parking space shall not
thereafter be reduced, eliminated, or made
