HomeMy WebLinkAbout1982-029AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 44 ACRE OF LAND LOCATED ON THE WEST SIDE OF CARROLL BOULEVARD APPROXIMATELY 200 FEET NORTH OF THE INTERSECTION OF WEST OAK STREET AND CARROLL BOULEVARD IN THE CITY OF DENTON, AND MORE PARTICULARLY DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the following described property, to -wit All that certain lot, tract or parcel of land out of the William Neil Survey, Abstract No 971, in the City and County of Denton, Texas, and being a part of a tract of land conveyed by S J Carroll to Will Williams on December 31, 1906, recorded in Volume 104, Page 224, Deed Records of said County and being more particularly described as follows BEGINNING at the northeast corner of Tract 2 of the above - mentioned Williams Tract, said point being 3 feet west of the curb of the west line of Carroll Boulevard, THENCE south along the west line of Carroll Boulevard a distance of 123 0 feet to an iron pin for a corner, THENCE north 89038' west a distance of 156 0 feet to the west line of said Williams Tract an old fence post for a corner, THENCE north 0056121" west a distance of 122 02 feet along the west line of said Williams Tract to a fence line on the north side of said Williams Tract, THENCE east a distance of 158 0 feet to the place of beginning and containing in all 44 acres of land is hereby changed from Multi -Family "MF-1" District Classifi- cation Use to Planned Development "PD" District Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas, with the following specifications and conditions 1 The existing curb cut on Carroll Boulevard will be curbed and guttered and not used to serve the office development, 2 Development of the office site shall be consistent with submitted site plan (parking, driveways, set- backs, etc and must conform to the City of Denton Standards) The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, be, and the same is hereby amended to show such change in District Classification and Use Z-1529-RUSSELL TRAPP-PAGE ONE SECTION II That the City Council of the City of Denton, Texas hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION III That this ordinance shall be in full force and effect immediately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the City of Denton, Texas, after giving due notice thereof PASSED AND APPROVED this the 9th day of March, 1982 RICHARD 0 STEWART, M Y R CITY OF DENTON, TEXAS ATTEST O CHARLOTTE � , CITYITY SY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEX S BY /0' Z-1529-RUSSELL TRAPP-PAGE TWO
