AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS,
AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF
THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP
APPLIES TO APPROXIMATELY 7 2498 ACRES OF LAND, MORE OR LESS, AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
The Zoning Classification and Use designation of the following
described tracts of land, to -wit
TRACT ONE -BEING a tract of land situated in the John McGowan
Survey, Abstract No 797, Denton County, Texas and being more
particularly described follows
BEGINNIING at a point situated in the intersection of the southerly
line of Loop 288 (a variable right-of-way) and the easterly line
of Interstate Highway No 35-E (a variable right-of-way),
THENCE along the southerly line of said Loop 288 and departing
said Interstate Highway No 35-E the following
North 42027128" east a distance of 41 80 feet to a point
of curvature to the right,
Along said curve to the right having a central angle of
020148106" a radius of 3740 00 feet, and an arc lenqth of
182 88 feet a point for corner,
THENCE south 34042100" east departing said Loop 288 a distance
of 307 00 feet to a point for a corner,
THENCEi south 64045100" east a distance of 65 87 feet to a point
for a corner,
THENCE south 05049103" west a distance of 95 00 feet to a point
for a corner,
THENCE south 86043112" west a distance of 90 00 feet to a point
for a corner,
THENCE south 42033100" west a distance of 145 00 feet to a point
situated in the easterly line of said Interstate Highway No 35-E,
THENCE along the easterly line of said Interstate Highway No 35-E
the following
north 42000159" west a distance of 90 60 feet to a point for
a corner,
north 34042100" west a distance of 226 60 feet to a point
for corner,
north 01041120" west a distance of 70 71 feet to the point
of beginning and containing 2 280 acres of land, more or less
TRACT TWO -BEING a tract of land situated in the John McGowan
Survey, Abstract No 797, Daniel Lambert Survey, Abstract No 784,
and the J S Taft Survey, Abstract No 1256, Denton County, Texas
and being more particularly described follows

The Zoning Map of the City of Denton, Texas, adopted the 14th
day of January, 1969, as an Appendix to the Code of Ordinances of
the City of Denton, Texas under Ordinance No 69-1, be, and the
same is hereby amended to show such change in District Classifica-
tion and Use, with the conditions specified
SECTION II
That the City Council of the City of Denton, Texas hereby
finds that such change is in accordance with a comprehensive plan
for the purpose of promoting the general welfare of the City of
Denton, Texas, and with reasonable consideration, among other
things for the character of the district and for its peculiar
suitability or particular uses, and with a view to conserving the
value of the buildings, protecting human lives, and encouraging
the most appropriate uses of land for the maximum benefit to the
City of Denton, Texas, and its citizens
SECTION III
That this ordinance shall be in full force and effect
immediately after its passage and approval, the required public
hearings having heretofore been held by the Planning and Zoning
Commission and the City Council of the City of Denton, Texas,
after giving due notice thereof

AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR THE
APPROVAL OF AN AMENDED DETAILED PLAN FOR 4 96 ACRES OF LAND
LOCATED ON THE SOUTH AND EAST SIDE OF LOOP 288, BETWEEN COLORADO
BOULEVARD AND INTERSTATE HIGHWAY 35, AS MORE PARTICULARLY
DESCRIBED HEREIN, AND BEING A PORTION OF THAT PLANNED DEVELOPMENT
DISTRICT (PD-28) AS ESTABLISHED BY ORDINANCE NO 82-13, PROVIDING
FOR A PENALTY IN THE MAXIMLM AMOUNT OF $2,000 00 FOR VIOLATIONS
THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, by Ordinance No 82-13, the City Council approved a
planned development district (PD-28) and site plan for 7 2 acres
of land located on the south and east side of Loop 288, between
Colorado Boulevard and Interstate Highway 35, as more
particularly described therein (presently known as Denton Town
Center), and
WHEREAS, Henry S Miller Management Corp has applied for
approval of an amended detailed plan covering 4 96 acres of the
district to provide for the redesign of the existing parking lot
and to establish parking space requirements, and,
WHEREAS, after a public hearing, the Planning and Zoning
Commission recommended approval of the amended detailed plan, NOW
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That for the 4 96 acres of land located within
the planned ——development district established by 82-13, there is
hereby approved an amended detailed plan, said land and detailed
plan being respectively described in Exhibit "A" and "B",
attached hereto and incorporated by reference, so that hereafter
the property shall be constructed, used, and maintained in
accordance with the amended detailed plan herein approved,
subject to the following condition
The detailed plan provides for 390 parking spaces based
upon projected land uses as follows
Retail 52,379 square feet (68%)
Restaurant 14,279 square feet (18%)
Office 9,518 square feet (12%)
Medical Office 1,470 square feet (02%)
Although the maximum permitted square footage of the
respective land uses shown above may vary, the total
square footage of all land uses at any one time shall
not create the need for more than 483 spaces, based upon
number of parking space required for those uses as
specified in Appendix B - Zoning To administer and
enforce this provision, a copy of the then currently
leased area must be provided with each request for a
building permit or certificate of occupancy
SECTION II That a copy of this orindance shall be attached
to Ordinance -13, showing the amendment herein made
SECTION III Any person who shall violate a provision of this
ordinance, or fails to comply therewith or with any of the
requirements thereof, or of a permit or certificate issued
thereunder, shall be guilty of a misdemeanor punishable by a fine
not exceeding Two Thousand Dollars ($2,000 00) Each such person
shall be deemed guilty of a separate offense for each and every
day or portion thereof during which any violation of this
ordinance is committed, or continued, and upon conviction of any
such violations such person shall be punished within the limits
above
SECTION IV That this ordinance shall become effective
fourteen ays from the date of its passage, and the City
Secretary is hereby directed to cause the caption of this
ordinance to be published twice in the Denton Record -Chronicle,
the official newspaper of the City of Denton, Texas, within ten
(10) days of the date of its passage
