APPROXIMATELY 470 7 ACRES OF LAND LYING AND BEING SITUATED IN THE COUNTY OF DENTON, STATE OF TEXAS AND BEING IN THE S WILLIAMS SURVEY, ABSTRACT NO 1279, D CULP SURVEY, ABSTRACT NO 287, J COLTART SURVEY, ABSTRACT NO 288, AND THE S MCCRACKEN SURVEY, ABSTRACT NO 817, DENTON COUNTY, TEXAS, CLASSIFYING THE SAME AS AGRICULTURAL "A" DISTRICT PROPERTY, AND DECLARING AN EFFECTIVE DATE WHEREAS, the request for annexation was introduced at a regular meeting of the City Council of the City of Denton, Texas, on the petition of the City of Denton, Texas, and WHEREAS, an opportunity was afforded, at a public hearing held for that purpose on November 3, 1981 in the Council Chambers for all interested persons to state their views and present evidence bearing upon the annexation provided by this ordinance, and WHEREAS, an opportunity was afforded, at a public hearing held for that purpose on November 17, 1981 upon the property hereinafter described in this annexation ordinance for all interested persons to state their views and present evidence bearing upon the annexation provided by this ordinance, and WHEREAS, this ordinance has been published in full at least one time in the official newspaper of the City of Denton, Texas, prior to its effective date, and after the public hearings, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the hereinafter described tract of land be, and the same is hereby annexed to the City of Denton, Texas, and the same is made hereby a part of said City and the land and the present and future inhabitants thereof shall be entitled to all the rights and privileges of other citizens of said City and shall be bound by the acts and ordinances of said City now in effect or which may hereafter be enacted and the property situated therein shall be subject to and shall bear its prorata Z-1512-ANNEXATION-PAGE 1 part of the taxes levied by the City The tract of land hereby annexed is described as follows, to -wit All those certain lots, tracts and parcels of land lying and being situated in the County of Denton, State of Texas, and being part of the S Williams Survey, Abstract No 1279, the D Culp Survey, Abstract No 287, the J Coltart Survey, Abstract No 288, and the S McCracken Survey, Abstract No 817 and being more particularly described as follows BEGINNING at a point in the existing Denton city limits line as established by Ordinance No 65-43, said point of beginning being the intersection of the east boundary line of the C Carter Survey, Abstract No 275, same being the west boundary line of the S Williams Survey, Abstract No 1279, and the north right of way line of the Texas and Pacific Railroad, THENCE north 69023'48" east along the existing Denton city limits line same being the north right of way line of the Texas and Pacific Railroad, a distance of 1,558 91 feet to a point for a corner, said point being perpendicular to and 600 0 feet east of the centerline of the proposed extension of State Highway Loop 288, THENCE north 0047148" east, 600 0 feet east of and parallel to said centerline of Loop 288 a distance of 907 42 feet to the beginning of a curve to the left whose central angle is 48008'04" and whose radius is 4,419 72 feet, THENCE northwesterly along said curve to the left, 600 0 feet east of and parallel to said centerline of Loop 288, said curve having a chord bearing of north 23016114" west and a chord length of 3,604 80 feet a distance of 3,713 03 feet to a point, THENCE north 47020116" west, 600 0 feet northeast of and parallel to said centerline of Loop 288 a distance of 2,872 59 feet to the beginning of a curve to the left whose central angle is 9051'09" and whose radius is 6,329 58 feet, THENCE northwesterly along said curve to the left, 600 0 feet northeast of and parallel to said centerline of Loop 288, said curve having a chord bearing of north 52015'50 5" west and a chord length of 1,087 08 feet a distance of 1,088 43 feet to a point, THENCE north 57011125" west, 600 0 feet northeast of and parallel to said centerline of Loop 288 a distance of 1,944 63 feet to a point for a corner in the existing Denton city limits line as established by Ordinance No 74-36, said point being perpendicular to and 500 0 feet southeast of the centerline of State Highway 428 (Sherman Drive), THENCE south 28037' west, along the existing Denton city limits line 500 0 feet southeast of and parallel to the centerline of State Highway 428, a distance of 2,675 0 feet, more or less, to a point for a corner, said point lying in the northeast boundary line of Cambridge Square Subdivision, THENCE south 35030' east, along the existing Denton city limits line as established by Ordinance No 66-7, a distance of 231 57 feet to a point, a distance of 738 58 feet to the beginning of a curve to the left whose central angle is 52016' and whose radius is 101 91 feet, THENCE southeasterly along said curve to the left same being the existing Denton city limits line a distance of 93 40 feet to a point, THENCE south 87046' east, along the existing Denton city limits line a distance of 96 53 feet to a point for a corner same being the northeast corner of Lot 11, Block E of the Cambridge Square Subdivision, THENCE south 2014' west, along the existing Denton city limits line a distance of 189 0 feet to a point for a corner in the south right of way line of Kings Row, THENCE east along the existing Denton city limits line as established by Ordinance No 60-40, same being the south right of way line of Kings Row, a distance of 1310 0 feet to a point for a corner in the west boundary line of the D Culp Survey, Abstract No 287, said line being the east boundary line of a tract of land conveyed to Nette Shultz by Deed dated March 12, 1935 and recorded in Volume 250, Page 339 of the Deed Records of Denton County, Texas and also being the west boundary line of a tract of land as conveyed to Denton Development Company by Deed dated June 22, 1953 and recorded in Volume 390, Page 92 of the Deed Records of Denton County, Texas, THENCE northeasterly with an angle in the south right of way line of Kings Row, same being the existing Denton city limits line a distance of 198 0 feet to a point for a corner, THENCE east along the south right of way line of Kings Row same being the existing Denton city limits line to a point in the east boundary line of the aforementioned Denton Development Company Tract, THENCE south 86055'10" east along the south right of way line of Kings Row same being the existing Denton city limits line as established by Ordinance No 73-3 a distance of 1001 33 feet to a point, THENCE north 0008' east along the existing Denton city limits line as established by Ordinance No 79-5 a distance of 30 0 feet to a point for a corner in the centerline of Kings Row, THENCE south 87026' east along the centerline of Kings Row, same being the existing Denton city limits line a distance of 155 0 feet, more or less, to a point for a corner, THENCE southerly along the existing Denton city limits line a distance of 50 0 feet, more or less, to a point for a corner in the south right of way line of the aforementioned Loop 288, THENCE southeasterly along the existing Denton city limits line, with a curve to the right in said proposed south right of way line a chord distance of 245 0 feet to a point for a corner, THENCE southeasterly along the existing Denton city limits line, a distance of 418 0 feet to a point in the west line of a tract of land as conveyed by Jane H Sewell to Kingston Tract Joint Venture by Deed recorded in Volume 656, Page 645 of the Deed Records of Denton County, Texas, Z-1512-ANNEXATION-PAGE 3 THENCE south 11034' west along the existing Denton city limits line a distance of 565 0 feet to a point, THENCE south 10048144" west along the centerline of a public road, same being the existing Denton city limits line as established by Ordinance No 73-4 a distance of 1,119 88 feet to an angle point in said public road, THENCE south 10002118" east along the centerline of a public road, same being the existing Denton city limits line a distance of 264 60 feet to a point for a corner in the south boundary line of the D Culp Survey, same being the north boundary line of the C Carter Survey, Abstract No 275, THENCE east along the north boundary line of said C Carter Survey to a point for a corner same being the northeast corner of said C Carter Survey, THENCE south along the east boundary line of said C Carter Survey to the place of beginning and containing 470 7 acres of land, more or less SECTION II The above described property is hereby classified as Agricultural "A" District and shall so appear on the official zoning map of the City of Denton, Texas, which map is hereby amended accordingly SECTION III This ordinance shall be effective immediately upon its passage Introduced before the City Council on the 8th day of December, 1981 FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS BY Z-1512-ANNEXATION-PAGE 4 , I Y PLAN OF SERVICE FOR ANNEXED AREA CITY OF DENTON, TEXAS WHEREAS, Article 970a as amended requires that a plan of service be adopted by the governing body of a city prior to passage of an ordi- nance annexing an area, and WHEREAS, the City of Denton is contemplating annexation of an area which is bounded as shown on a map of the proposed annexation NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS Section 1 Pursuant to the provisions of Article 970a as amended, Texas Code Annotated, there is hereby adopted for the pro- posed annexation area the following plan of service I Basic Service Plan A Police (1) Patrolling, radio responses to calls, and other routine police services, using present personnel and equipment, will be provided on the effective date of annexation, (2) Traffic signals, traffic signs, street markings, and other traffic control devices will be installed as the need therefore is established by appropriate study and traffic standards B Fire (1) Fire protection b, t'^e present personnel and equip- ment of the fire fighting force will be provided on the effective date of annexation C Water (1) Water for domestic, commercial and industrial use will be provided at city rates from existing city lines on the effective date of annexation, and thereafter from new lines as e%tended in accordance with article 13 06 of appends, A of the code of the City of Denton, Te%as D S e- (1) Properties in the annexed areas will be connected to sewer lines in accordance with article 13 06 of appendi,c 4 of the code of the City of Denton, Texas I( E Refuse Collection (1) The same regular refuse collection service now pro- vided within the cit, will be e-,tended to the annexed area within one month after the effective date of annexation e Plan .ed Areas .e two 0 F Streets (1) Emergency maintenance of streets (repair of hazardous chuckholes, measures necessary for traffic flow, etc) will begin on the effective date of annexation (2) Routine maintenance on the same basis as in the present city, will begin in the annexed area on the effective date of annexation (3) Reconstruction and resurfacing of streets, installa- tion of storm drainage facilities, construction of curbs and gutters, and other such major improvements, as the need therefore is determined by the governing body, will be accomplished under the established policies of the city G Inspection Services (1) Any inspection services now provided by the city (building, electrical, plumbing, gas, housing, sanitation, etc ) will begin in the annexation area on the effective date of annexation H Planning and Zoning (1) The Planning and Zoning jurisdiction of the city will extend to the annexed area on the effective date of annexation City planning will thereafter encompass the annexed area I Street Lighting (1) Street lighting will oe installed in the substan- tially developed areas in accordance with the established policies of the city J Recreation (1) Residents of the annexed area may use all existing recreational facilities parks, etc on the where needed ci11 be installed within approximately 6 months after the effective date of annexation _e Plan Ked Areas .e three II Capital Improvement Program (CIP) The CIP of the City consists of a five year plan that is updated yearly The Plan is prioritized by such policy guidelines as (1) Demand for services as compared to other areas based partly on density of population, magnitude of problems compared to other areas, established technical standards and professional studies, and/ natural or technical restraints or opportunities (2) Impact on the balanced growth policy of the city (3) Impact on overall city economics The annexed area will be considered for CIP planning in the upcoming CIP plan, which will be no longer than one year from the date of annexation In this new CIP planning year the annexa- tion area will be judged accordingly to the same established criteria as all other areas of the city
