AN ORDINANCE AMENDING THE ZONING ORDINANCE, APPENDIX B, ARTICLE 23,
SUBSECTION C(1) OF THE CODE OF ORDINANCES OF THE CITY OF DENTON,
TEXAS, RELATING TO THE APPEAL PROCEDURE BEFORE THE BOARD OF
ADJUSTMENT, PROVIDING FOR A FILING FEE AND DECLARING AN EFFECTIVE
DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAR, HEREBY ORDAINS
SECTION I
That Appendix B, Article 23, Subsection C(1) of the Code of
Ordinances of the City of Denton, Texas, is hereby amended so that
the same shall hereafter read as follows
APPENDIX B, ARTICLE 23C
(1) Appeals to the board of adjustment can be
taken by any person aggrieved, or by an officer, depart-
ment or board of the municipality affected by the
decision of the building inspector Such appeal shall
be taken with fifteen (15) days after the decision has
been rendered by the building inspector, by filing with
the officer from whom the appeal is taken and with the
board of adjustment, a notice of appeal specifying the
grounds thereof Such notice of appeal shall be accom-
panied by a filing fee in the amount of Fifty ($50 00)
Dollars, provided, however, that the board may waive
such filing fee when it appears to the board that the
particular property is adversely affected by circum-
stances created by the City of Denton, not by the
appellant, and that a special exception to the zoning
regulations be granted. The officer from whom the
appeal is taken shall forthwith transmit to the board
all the papers constituting the record upon which the
decision of the officer was based
SECTION II
That Appendix B, Article 23, Subsections C(2) and C(3) of
the Code of Ordinances of the City of Denton, Texas, shall remain
unchanged
SECTION III
This ordinance shall become effective from and after its date
of passage and approval (�
