HomeMy WebLinkAbout1981-085NO )) - 2,O AN ORDINANCE BY THE CITY OF DENTON, TEXAS, DETERMINING AND ESTABLISHING THE MAXIMUM PRIMA FACIE SPEED LIMIT ON THAT CERTAIN PORTION OF DALLAS DRIVE BEGINNING AT A POINT APPROXIMATELY 900 FEET NORTH OF THE INTERSECTION OF DALLAS DRIVE AND TEASLEY LANE, THENCE IN A SOUTHERLY DIRECTION ON DALLAS DRIVE TO A POINT APPROXIMATELY 50 FEET NORTH OF ITS INTERSECTION WITH PIPING ROCK TO BE THIRTY- FIVE (35) MILES PER HOUR, DETERMINING AND ESTABLISHING THE MAXIMUM PRIMA FACIE SPEED LIMIT ON THAT CERTAIN PORTION OF DALLAS DRIVE BEGINNING AT A POINT APPROXIMATELY 50 FEET NORTH OF THE INTERSECTION OF DALLAS DRIVE AND PIPING ROCK, THENCE IN A SOUTHERLY DIRECTION ON DALLAS DRIVE TO A POINT APPROXIMATELY 500 FEET SOUTH OF ITS INTERSECTION WITH THE EAST FRONTAGE ROAD OF INTERSTATF HIGHWAY 35E TO BE FORTY-FIVE (45) MILES PER HOUR, PROVIDING A PENALTY OF A FINE NOT TO EXCEED TWO HUNDRED ($200 00) DOLLARS, REPEALING ORDINANCE NO 81-78, PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I Based upon an engineering and traffic investigation, the City Council hereby determines that the reasonable and safe prima facie maximum speed limit on that certain portion of Dallas Drive beginning at a point approximately 900 feet north of the intersection of Dallas Drive and Teasley Lane, thence in a southerly direction on Dallas Drive to a point approximately 50 feet north of its intersection with Piping Rock to be thirty-five (35) miles per hour SECTION II Based upon an engineering and traffic investigation, the City Council hereby determines that the reasonable and safe prima facie maximum speed limit on that certain portion of Dallas Drive beginning at a point approximately 50 feet north of the intersection of Dallas Drive and Piping Rock, thence in a southerly direction on Dallas Drive to a point approximately 500 Feet south of its intersection with the east frontaqe road of Interstate Highway 35E to be forty-five (45) miles per hour SECTION III An individual adjudged guilty of exceeding this speed limit, shall be guilty of a misdemeanor, and punished by a fine not to exceed Two Hundred ($200 00) Dollars SECTION IV That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION V That Ordinance NO 81-78 is hereby repealed SECTION VI That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secetary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the day of September, 1981 T WA, MAYOR CIT OF DE ON, TEXAS ATTEST �/� Z., oelo �7�z ROOK HOLT, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTOONN, TEXAS BY
