69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 3 798 ACRES OF LAND, MORE OR LESS, OUT OF THE WILLIAM DABBS SURVEY, ABSTRACT NO 328 IN THE CITY OF DENTON, AND MORE PARTICULARLY DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use Designation of the following described property, to -wit All that certain 3 798 acre tract or parcel of land situated in the William Dabbs Survey, Abstract No 328, Denton County, Texas, said tract being part of a tract occupied on the ground as tract shown by deed to Joseph E Stockard, Trustee and recorded in Volume 871, Page 873 of the Deed Records of Denton County, Texas and being more particularly described as follows BEGINNING for the southeast corner of the tract being described herein at an iron pin set in the north line of U S Highway No 380 at the southeast corner of said Stockard Trustee Tract, THENCE westerly 679 61 feet with the arc of curve to left through a central angle of 060 40' 46" to the southwest corner of said Stockard Tract, THENCE north 000 27' 30" west with the west line of said Stockard Tract 251 0 feet to the north line of City Limit of Denton, Texas, THENCE easterly 644 15 with the arc of curve to right through a central angle of 060 04' 14" and a radius of 6079 64 feet, chord bearing north 870 36' 45" east 641 83 feet along said City Limits to its intersection with the eastern line of said Stockard Tract, THENCE south 080 29' 30' east 253 3 feet to the point of beginning and containing approximately 3 798 acres of land, more or less is hereby changed from Agricultural "A" District Classification Use to Planned Development "PD" District Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas subject to the following conditions and restrictions, to -wit 1 Access to said property shall be permitted from Riverside Drive only The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, be, and the same is hereby amended to show such change in District Classification and Use Z-1490-ELBERT HUGHES $ DEWAIN CAMPBELL SECTION II That the City Council of the City of Denton, Texas hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION III That this ordinance shall be in full force and effect immediately after its passage and approval, the required public hearings having heretofore been held by the f NOTICE OF PUBLIC HEARING Z-1490 This is the petition of Elbert Hughes and Dewain Campbell requesting a change of zoning from agricultural (A) to planned development (PD) zoning classification for commercial use on a tract approximately 3 7 acres in size located along the north side of highway 380 East beginning approximately 1500 feet east of Trinity Road The City Council will hold a public hearing on July 7, 1980 at 7 00 p m in the Council Chambers to consider this request � 1 Susan Wigand i Senior Secretary Planning Department Procedure for a Zoning Petition A zoning petition follows a two -stage review process that is designed to provide opportunities for citizen involvement and comment Following submission of an application for a zoning change, a public hearing is scheduled before the Planning and Zoning Commission This Commission is composed of seven members appointed by the City Council whose role is to make recommendations to the Council on zoning requests Property owners within two hundred feet of the site in the zoning petition are notified to participate at the public hearing The hearing follows an orderly procedure during which the petitioner explains his proposal and then Ts followed by other persons who have the opportunity to speak in support or in opposition to the request After the public hearing process is com- pleted, the Planning Commission votes to recommend either approval or denial of the request If the Planning Commission recommends approval, then the case is forwarded to the City Council for its consideration If the Planning Commission recommends denial, then the petitioner must file an appeal to have the case heard by the City Council Prior to the public hearing before the City Council, property owners within two hundred feet are
