HomeMy WebLinkAbout1979-080NO qq - 80 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR THE CLOSING AND VACATING ALL OF THE UTILITY EASEMENT DESCRIBED IN A CERTAIN EASEMENT DATED MAY 4, 1971, AND FILED OF RECORD IN VOLUME 621, PAGE 453 OF THE DEED RECORDS OF DENTON COUNTY, TEXAS FROM CRAWFORD BUILDING CORPORATION TO THE CITY OF DENTON, TEXAS,I PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND, AUTHORIIZING NECESSARY LEGAL DOCUMENTS TO BE PREPARED AND SIGNED, AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Denton, Texas, acting, pursuant to law, and upon the request and petition of the Grantee herein, deems it advisable to abandon and convey the heireinafter described utility easement to Grantee and is of the opinion that the original utility easement hereinafter described is not needed for public use, and WHEREAS, the City Council of the City of Denton is of the opinion that the best interest and welfare of the public will be served by abandoning and conveying the same back to Grantee in order to adopt a new easement for the benefit of the City and Grantee, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY1 ORDAINS SECTION I That the hereinafter described public utility easement be and the same is, hereby estinguished, vacated and permanently abandoned as an easement for public utilities insofar as the right, title and easement of the public are concerned All that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, and being ,part of the R Beaumont Survey, Abstract No 31, and being part of a tract of land conveyed by Jack Skiles to Crawford Building Corporation by Deed as recorded in Volume 374, P ge 191 of the Deed Records of Denton County, Texas, and more p:rticularly described as follows BEGINNING at a point in the south boundary line of said tract, said point of beginning lying in the north right of way line of State Highway 24 and being 236 0 feet east of the southwest corneriof said tract, I THENCE north 340 14' west, passing at 107 0 feet the northeast corner of a building and continuing north 320 14' west altotal distance of 111 0 feet to a point for a corner, THENCE south 790 26' west 4 0 feet north of and parallel with the north wall of said building, a distance of 57 0 feet to a point for a corner, THENCE north 100 34' west a distance of 16 0 feet to a point for a corner, THENCE, north 790 26' east 20 0 feet north of and parallel with the north wall of said building, a distance of 73 0 feet to a point for a corner, THENCE south 320 14' east a distance of 127 0 feet to a point for a corner in the south boundary line of said Crawford Building Corporation tract, said line also being the north right of way line of State Highway 24, THENCE south 710 01' west along the south boundary line of said boundary line of said Crawford Building Corporation tract, same being the north right of way line of State Highway 24, a distance of 16 0 feet to the place of beginning and containing 20944 0 square feet of land, more or less SECTION II That the abandonment and conveyance provided for herein shall extend to the right, title, easement and interest of the City of Denton, and shall be construed to extend only to that interest the governing body of the City of Denton may legally and lawfully abandon and vacate SECTION III That this abandonment and conveyance is made subject to all present zoning and deed restrictions, if the latter exist, the dedication of new easements, and is subject to all existing easement rights of others, if any, whether apparent or non - apparent, aerial, surface, underground or otherwise SECTION IV That the City Attorney is hereby authorized to prepare and deliver whatever legal documents are required with regard to the area abandoned and conveyed herein, should such be requested by Grantee hereunder, the same to be executed by the Mayor on behalf of the City of Denton, and attested by the City Secretary 11 �
