HomeMy WebLinkAbout1979-044NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS PROVIDING FOR THE ABANDONMENT AND SALE OF CERTAIN PROPERTY HERETOFORE PURCHASED FOR STREET RIGHT-OF-WAY PURPOSES, BUT NOT USED OR NEEDED FOR SUCH PURPOSES ANY LONGER, AUTHORIZING THE SALE OF SUCH PROPERTY TO THE HIGHEST BIDDER, AND DECLARING AN EMERGENCY WHEREAS, the City of Denton heretofore purchased a parcel of land bounded by West Prairie on the South and Carroll Blvd on the West consisting of 7,794 24 sq ft more or less, for street right-of-way purposes, and WHEREAS, the said property is not now suitable for street purposes and the Community Development Department of the City of Denton has recommended that such property not be used for street purposes because the same is not now useable or suitable, and WHEREAS, the City Council of the City of Denton desires to go on record as abandoning any intention of ever using such property for street purposes, and to evidence the fact that such property has not heretofore been used for street purposes and is not a part of the street system of the City of Denton, and that such property should be sold in order that the proceeds from the same might be used by the City of Denton for street purposes, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the following described property, to wit All that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, and being part of the Wm Loving Survey, Abstract #759, and being part of two tracts of land, hereinafter referred to as "tract two" being conveyed to City of Denton by Deed dated October 29, 1969 and recorded in volume 598, Page 27 of the Deed Records of Denton County, Texas and "tract two" being conveyed to City of Denton by Deed dated August 19, 1969 and recorded in volume 590, page 108 of the Deed Records of Denton County, Texas and more particularly described as follows BEGINNING at the southwest corner of said "tract one" said point of beginning lying in the north right-of-way line of Prairie Street, THENCE west along south boundary line of "tract one", same being the north right-of-way line of Prairie Street, a dis- tance of 61 feet to a point for a corner, THENCE north 1018143" east passing at 56 01 feet the north boundary line of said "tract one" same being the south boundary line of said "tract two" and continuing north 10 18143" east a total distance of 131 03 feet to a point for a corner in the north boundary line of said "tract two", THENCE east, along the north boundary line of said "tract two", a distance of 58 feet to a point for a corner, be- ing the northeast corner of said "tract two", THENCE south along the east boundary line of said "tract two", passing at 75 0 feet the southeast corner of said "tract two", same being the northeast corner of said "tract one", a total distance of 131 0 feet to the place of beginning and containing 7,794 24 square feet of land, more or less be, and the same is, hereby abandoned insofar as said property may be used for street purposes by the City of Denton SECTION II That the above described property, not being suit- able or useable for street purposes, and not having been used for street purposes, be, and the same is hereby declared to be, surplus property of the City of Denton, and upon recommendation of the Com- munity Development Department of the City of Denton should be disposed of as surplus and unuseable property in accordance with the Charter of the City of Denton and the laws of the State of Texas SECTION III That the City of Denton has officially advertised said property for sale and received sealed bids, and that such prop- erty be, and the same is hereby authorized to be, sold to the highest bidder, for the highest cash consideration SECTION IV That the funds received from the sale of such prop- erty, after deducting necessary expenses, may be used for street pur- poses only SECTION V The fact that the above described property is not needed or useable for street purposes and the Community Development Department of the City of Denton has recommended that it not be used for street purposes, because it is unsuitable for such purposes, and that such property should be sold in order to permit the proceeds from the sale to be used for streetlpurposes, creates an urgency and an emergency in the preservation of the public health, safety and welfare, and it requires that this ordinance shall take effect im- mediately from and after its passage, as the law in such cases pro- vides PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, on this the___.:2:— day of 441 — 1979 L fffLL NAS , MAIOR CITY OF DENTON, TEXAS ATTES KS HOLT, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM BURT R SOLOMONS, ASST CITY ATTORNEY, CITY OF DENTON, TEXAS '7 qi `F `f
