HomeMy WebLinkAbout1978-073NO AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING CHAPTER 15 "PARKS AND RECREATION" BY ADDING A NEW SECTION 15-10 PROHIBITING POSSESSION OR CONSUMPTION OF ALCOHOLIC BEVERAGES WITHIN 100 FEET OF A PLAYING FIELD; DESIGNATING THE POSTING OF SIGNS, CALLING FOR ENFORCEMENT, DECLARING A PENALTY, PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS: SECTION I That Chapter 15 "Parks and Recreation" is hereby amended by adding a new Section 15-10 "Possession and Consumption of Alcohol Prohibited" which hereafter shall read as follows: "Section 15-10 POSSESSION AND CONSUMPTION OF ALCOHOL PROHIBITED (1) Within the limits of any public park within the City of Denton, it shall be unlawful for any person or persons to possess or consume any alcoholic beverage within 100 feet of any portion of any playing filld except if such possession or consumption is inside a motor vehicle located upon a designated parking area Playing field is hereby defined as a marked field area or the enclosure surrounding or setting apart a designated field area, including but not limited to a fence, for the purpose of conducting or engaging in an athletic game or activity Such activities would include but not be limited to football, baseball, softball, soccer, rugby, lacrosse, field hockey, tennis and basketball (2) The Director of Parks and Recreation shall cause signs to be erected at the playing fields within the various public parks notifying the public of the provisions of this ordinance (3) The Director of Parks and Recreation, Parks Attendants designated by the Director, and the Police Department, shall, in connection with their duties imposed by law, diligently enforce the provisions of this ordinance, and they shall have the authority to e3ect from the park any person acting in violation of this ordinance SECTION II Any person who violates any provision of this ordinance shall be deemed guilty of a misdemeanor, and, upon conviction, shall be punished by a fine not to exceed Two Hundred Dollars ($200 00) Each day such a violation shall continue or be permitted, shall be treated as a separate offense SECTION III That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION IV.
