HomeMy WebLinkAbout1971-029AN ORDINANCE PROHIBITING MOBILE SERVICE UNITS WITHIN THE CITY OF DENTON, DEFINING SAME, PROVIDING A pENALTY, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS PART I That the Code of the City of Denton, Texas, ~s hereby amended by adding new Section 10-9 to Chapter Ten, Article I, of sa~d Code, which shall hereafter read as follows CHAPTER 10 FIRE PREVENTION Article I In General Section 10-9 Mobile Service Un~ts Prohibited (a) It shall be unlawful for any person, firm or corporation to sell or d~spense fuel from a mobile service unit ~n the C~ty of Denton, or to operate the same as a service station, ~nclud~nq self service (b) A Mobile Serv~c~ Un~,~, as used ~n th~s section, shall mean and include any vehicle, tank, tank truck, or other movable device from which flammable l~qu~ds used as fuel may, as an act of retail sale, be dispensed ~nto the fuel tank of a motor vehicle It ~s the ~ntent of this section to prohibit mobile aasol~ne filling stations which e~ther park or roam around on off street parking lots and from which the dr~ver or attendant makes sales of gasoline to persons whose vehicles are parked on such lots Th~s section shall not apply to the delivery of l~quefled petroleum gas to lawful recipients having proper containers other than motor vehicles, or to the emerqency de- livery of motor fuel to a stalled vehicle PART II The violation of any provision of th~s ordinance shall be punished by a fine of not exceed~nq Two Hundred ($200 00) Dollars, and Section 1-5 of the Code of Ordinances is ~ncorporated here~n and made a part hereof PART III Tha% if any section, subsection, paraqraph, sentence, clause, phrase or word in th~s ord3nance, or application thereof to any person or c3rcumstances is held ~nval3d by any court of competent 3ur~sd~ction, such holding shall not affect the val3d3ty of the rema~n3ng portions of th3s ordinance, and the City Counc31 of the C3ty of Denton, Texas, hereby declares 3t would have enacted such remaining portions despite any such ~nvalld~ty PART IV That th3s ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary 3s hereby d3r- ected to cause the capt3on of this ordinance to be published twice 3n the Denton Record-Chron3cle w~th~n ten (10) days of the date of ~ts passage ~ ~ PASSED AND APPROVED this the , day of ' A D 1971 ~EEXAN~ER M FiN~A~F, ~ ,/~u~ CITY OF DENTON, TEXAS N~ F :~~', TEXAS /~O~"K~ HOLT, ~ APPROVED AS TO LEGAL FORM T J~'- Q BAR , /~Y OF DENTON, TEXAS
