HomeMy WebLinkAbout1971-004 AN ORDINANCE PROHIBITING TWO-WAY VEHICULAR TRAFFIC ONN~ORTIONS OF THE SERVICE ROADS OF INTERSTATE HIGHWAY 35 AND 35E~THE DENTON STATE SCHOOL ROAD AND UNIVERSITY DRIVE, WHICH PORTIONS ARE FUR- THER DESCRIBED THEREIN IN FULL, AFTEP FINDING THAT THE PUBLIC SAFETY AND WELFARE REQUIRES ONE-WAY THEREUPON, PROVIDING A PEN- ALTY FOR VIOLATIONS THEREOF, PROVIDING THE INSTALLATION OF PRO- PER SIGNS AND MARKINGS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Clty Council hereby f~nds and determines that the public safety and welfare requires the termination of two-way trafflc up- on the street portions described below, and providing a one-way ve- hicular traffic pattern in lieu thereof, therefore, the following portions of streets known as service roads, access roads and front- age roads, are hereby declared to be for one d~rect~on vehicular traffio only, in accordance wlth the deslqn plan therefor as approv- ed by the State of Texas, to-wit a The east frontage (service) road of Interstate Highway 35E and 35, from the Denton State School Road to Uni- versity Drive, b The west frontage (service) road of Interstate Highway 35E from the Denton State School Road to Bonnie Brae Street, ¢ The west frontage (service) road of Interstate Hlghway 35 from Prairie Street to University Drive SECTION II It shall be unlawful for any person to drive or operate a vehicle upon any portion of street described above ~n a direction other than as posted or indicated, and all s~gns installed pur- suant hereto shall be official traffic control devices SECTION III The vlolatlon of any provision of this ordinance shall be punished by a f~ne of not exceeding two hundred ($200 00) dollars, and Section 1-5 of the Code of Ordinances is incorporated herein and made a part hereof SECTION IV That ~f any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or c~rcumstances, ~s held ~nval~d by any court of competent jurisdiction, such holding shall not affect the validity of the re- maining port~ons of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portlons desplte any such invalidity SECTION V That thls ordinance shall become effective on and after the ~ day of ~, 1971, and the City Secretary is hereby directed to cause the oapt~on of th~s ordinance to be published twice ~n the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, wlthln ten (10) days of the date of its passage and approval/~ PASSED AND APPROVED th~s the ~--day of A D CITY OF DENTON, TEXA~~ ATTE S T BROOk~ HOLT, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM AN ORDINANCE AMENDING ARTICLE II IN CHAPTER 5 OF THF CODE OF ORDIN- ANCES 0F THE CITY OF DENTON, WHICH SETS FORTH CERTAIN REQUIREMENTS WHICH MUST BE MET BEFORE A BUILDING PERMIT IS ISSUED, AMENDING APPEN- DIX "A" TO THE CODE OF ORDINANCES TO REQUIRE THAT NEW SUBDIVISIONS MEET C~RTAIN REQUIREMENTS, AMENDING CITY SPECIFICATIONS TO OUTLINE CERTAIN REQUIREMENTS GOVERNING THE DESIGN AND INSTALLATION OF WATER AND SEWAGE SYSTEMS, AND DECLARING AN EMERGENCY W~EREAS, the City Council finds it necessary that the City Building Code and the Subdivision Regulations comply with requIre- ments of the Federal program of flood insurance, and W~EREAS, the City Counclt desires the Code of Ordinances of the Clty of Denton be changed to effect sa~d compliance, now therefore, T~E CITY COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS I That Article II of Chapter 5 of the Code of Ordinances of the Clty of Denton be amended to require that a building permlt be ~ssu- ed onl~ after the Building Official has determined that the propos- ed bu~dlng slte as reasonably safe from flooding, or if a flood hazard~exlsts, any proposed new construction or substantial improve- ment (including prefabricated and mobile homes) must a be designed (or mod±fled) and anchored to prevent flota- taon, collapse, or lateral movement fo the structure, b. use construction materials and utallty equapment that are resistant to flood damage, and ct use construct~on methods and practices that wall man~mlze flood damage II That Appendix "A" to the Code of Ordinances be amended to re- quire that proposed subdlv~slons be reviewed to assure that a all such proposals are consistent w~th the need to mlnl- m~ze flood damage, b. all publlc utllltles and facIlities, such as sewer, gas, electracal, and water systems are located, elevated, and constructed to minimize or eliminate flood damage, and c adequate drainage is provided so as to reduce exposure to flood hazards
