RESOLUTION
~EEREA~, on this 26th day of January, 1960, the City Council
of the Oity of Denton, Texas,being the governing body of said
City,i did convene in regula~ sessioo, pursuant to law, with its
Mayor presiding, and with~the~ following duly elected members
present, constituting a quorum, to wit:
Tom Laney, Thomas E.~.Noel, G. F. Spuller, Walter S. Miller,
Jr., M.D., ~. F. Brooks, Raymond Pitts, Emery Taylor; and
~REA~, the following resolution was moved by ~¥ ,
and seconded by ~O~L_ ; now therefore
.BE IT RESOLVED, BY THE CITT COUNCIL OF ~E CITY OF DENTON,
TEXA~, that agreement between Missouri-Kansas-Texas Railroad
Company and the City of Denton, Texas, a copy of which is attached
as E~hibit "A" hereto and~ made a part hereof, for a pipe line
license, be and it is hereby approved and accepted, and that
Fran~ Barrow as Mayor and. W. D. Buttrill as City Secretary of
this!governing body, be and the7 are hereby authorized, empowered
and ~irected to execute said agreement and to do all things
nece~saz~y therefor, and that their acts in so doing are hereby
adopted, ratified and confirmed as the acts of said City of Denton,
Texa@, and of this governing body.

~tEREAS, Joe Sktles by dedication of Blocks D, E, S, and T
of the Brentwood Addition to the City of Denton, Texas, dated the
15th ~ay of May, A.D. 1956, as accepted by the City of Denton by
Ordinance No. 56-2~, dedicated a street known as Windsor Drive,
said street being ll0 feet in width; and
WHEREAS, Nette Shultz, et al, by instrument dated March 6,
1956, recorded in Volume 419, Page 534 of the Deed Records of
Denton County, Texas, dedicated to tho City of Denton, Texas, a
strip of land ll0 feet wide for street purposes, said street to
be known as Windsor Drive; and
WHEREAS, the City Council of the City of Denton, Texas, has
determined that a street 50 Feet in width within the said Brent-
wood Addition is sufficient to meet the seeds of the City; and
WHEREAS, the portion of the said Windsor Drive dedicated by
Nette Shultz, et al is outside of the limits of the City of
Denton, Texas, and therefore is not required For street purposes
at the present time; now therefore be it
RESOLVED BY THE CIT~ COUNCIL OF THE CITY OF DENTON, TEXAS:
,That the Mayor of the City of Denton, Texas, be and he is
hereby authorized to execute a Quit Claim Deed on behalf of the
City ,of Denton to Joe Skiles of the North 60 feet of Windsor Drive
as the same is shown in the plat of Blocks D, E, S and T of the
Breat'wood Addition to the City of Denton, Texas; and be it further
RESOLVED that the Mayor of the City of Denton, Texas, be
and he is hereby authorized to execute on behalf of the City
of Denton a Quit Claim Deed to Nette Shultz, Susie Beyette and
Callie R. Ratliff of that portion of Windsor Drive now lying
outside the limits of the City of Denton, Texas.

~HEREAS, by deed recorded in Vol. 418, Page 98 of the Deed
Records of Denton County, .Texas, the City of Denton, Tex~$,
pursuant to a resolution adopted January 11, 1955 and recorded
in Vo1. 15, Page 337 of the minutes of the City Commission of
the C~ty of Denton, and Denton County, Texas, pursuant to a
resolution adopted on January 17, 1955 and recorded in Vol. T,
Page 428 of the Commissioners' Court Minutes of Denton County,
Texasl, conveyed approximately 1.23 acres of land to the Gulf,
Colorado and Santa Fe Railway Company for right-of-way purposes;
and
WHEREAS, the said 1.23 acre tract of land crosses the
TexasI National Guard Armory site which originally contained 10
acre~; and
IWHEREAS, as consideration for the said 1.23 acre tract, the
Gulf, Colorado and Santa Fe Railway Company agreed to replace
the ~aid land in kind with additional land adjoining the said
Texas National Guard Armory site, said replacement to be sat is-
factory to the City of Denton, Denton County and the Texas
National Guard Armory Board; and
'1~tEREAS, the Gulf, Colorado and Santa Fe Railway Company
has ~ow reached a~ agreement with W. C. Potter and wife, Maydell
Wallace Potter wherein the said W. C. Potter and Maydell Wallace
Potter will convey approximately 1.0 acre of land adjoining the
Eastl side of the Texas National~ Guard Armory site to the City
of D~nton, Texas, and ~e~ton County, Texas, in fulfillment of
the ~ailway company,s original agreement; and
I ~EtEREAS, the said l~0 acre tract of land will provide access
to ~. S. HiEhway 35E along the entire frontage of the TexaS
Guard Armory site; now therefore be it
~ESOLVED BT THE CITY COUNCIL OF ~HE CITY OF DENTON, TEXAS,
that, subject to approval and acceptance by Denton County, Texas,
and the Texas National Guard Armory Board, the City of Denton,
Texas~ hereby accepts the~cnnveyance of approximately 1.O acre
of la~d from W. C. Potter and wife, Maydell Wsllace Potter, to
the City of Denton, Texas, and Denton County, Texas, said land

187, Deed Records of Denton County, Texas, said

RESOLVED, that the City Manager of the City of Denton,
Texasl, be and he is hereby authorized to enter into, execute
and dleliver on behalf of the City of Denton, Texas, a lease
of the aforesaid 1.0 acre,tract of land to the Texas National
Guard!Armor~y Board for and in consideration of the sum of
Ten Dollars for a term of years to expire with the original
leasehold of the Texas National Guard Armory Board.

~I{EREAS, by Ordinance No. 60-05 duly passed on February 9,
1960, Ithe City Council of the City of Denton, Texas, ordered the
pe~ma~e~ improvement of certain portions of public streets desig-
nated ltherein, by excavating, grading and paving the same, and
by th~ construction of curbs and gutters where required, in
accordance with plans and ~speci£icattons on file with and approved
by th9 City Council; and
WHEREAS, pursuant to said ordinance, the Clty Council ad-
vertised for bids for the const~uction of such improvements,
and b~ds were ~eceived and opened, all as provided by the Charter
of th~ City of Denton, Texas, and the laws of the State of Texas;
and
WHEI~A~, the bid of Public Constr~ction Company in the
amoun~ of $108,611.41, was the lowest and best mesponslb]~bid,
and the City Council has awamded the contract for the construction
of such improvements to Public Construction Company; and
WHEREAS, the contract £o~m and contract documents, including
the perfommanne bond ~equimed by the agreemest and by law, have
been lexecuted by the said Public Construction Company; now there-
fore .be it
RESOLVED BY THE CI~ COUNCIL OF 'l~IE CITY OF DENTON,
that ,the fo~m and substance of the contract and contract documents
here$ofome executed by Public Construction CompanY~providing for
the ~onst~uction of the improvements above descmibed be and the
same~ a~e hereby approved, and the City Manager is hereby authorized
and ~irected to execute the same on behalf of the City of Denton;
and be it further
RESOLVED, that the perfommance bond aeoompanying said
contract and executed by Public Construction Company be and the
same is hereby accepted and approved; and be it further
RESOLVED, that the Director of Public Works of the City of
Denton~be and he is hereby directed to pPepare and file with
the City Council estimates and Polls as required by law fop
each Street Unit to be so improved, showing therein the total
estimated cost of the improvements in each such unit, and
showing in detail the description of each parcel of property
abutting thereon, together with the names of the apparent ownePs
thereo~, the number of front feet of each parcel of propePt~,
the amount to be assessed against the same, and such other perti-
nent i~formation as may be required by law.

WH~EAS, it is contemplated that the City of_ Denton
will Construct certain sewage transmission and treatment facilities
with an estimated total cost of _

WN~EAS, it is found that the City of _ Den*on
is unable to provide the total cost of such improvements; and
WHEREAS, it is deemed necessary and proper to apply for Federal
grant under the Federal Wat~. Pollution Control Act, Public Law 660,
84th Congress in c~de~ to have sufficient funds to complete these
much needed improvements;
NCW THFREFORE BE IT RESOLVFD BY THE CITY COUNCIL OF THE

Under Public Law 660, 84th Cnngress; to be apolled to the cost of the

to the Federal Water Pollution Control Act, the City will pay the
remaining, costs of the approved project.

that a fee for the excavation of graves in the City Cemeteries
in the amount of Thirty-five Dollars (935.00) shall be charged
for each grave opening.

~EREAS, Lone Star Gas Company has offered the City of
Denton a contract for f~rntshing industrial natural gas ser-
vice to the City of Dentonts electric power generating plants
for a period of three (3) years; and
WHEREAS, '~he proposed initial rate for saia inaustrial
natural gas service is in accordance with Lone Star Gas Com-
pany,s publishe~ Rate 4-E;
I~EEREAS, the Publlc Utilities Board of the City of Denton
has recommended the acceptance of the aforesai5 contract; and
I~HEREAS, it appea~s to the City Council that the best
interests of the City of Denton will be served by the accep-
tance of the contract; now therefore

WHEi~EA~, under the provisions of Article 1085b, Revised
CivilI StaTutes of the State of Texas, Home Rule cities have the
power~ and authority to g~ant a portion of the streets and side-
walksl of such cities for private purposes, for such consideration,
and upon such texwas as they may prescribe; provided such use shall
not interfere with the public use of such streets and sidewalks,
or create any hazardous or dangerous condition thereon; and
WHEREAS, the First State Bank of Denton has applied to the
City Council of the City of Denton, Texas, for an easement per-
mitring the const~ction of an underground passageway and tunnel
unde~ certain portions of Walnut Street in the City c~ Denton; and
WHEREAS, the provisions of the easement attached to this
resolution are approved by the City Council of the Clt2 cf Denton,
Texasl; now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON,
TEXA~, that Mauor Frank Bamrow be and he is hereby authorized
to execute on behalf of the City of Denton an easement for an
unde~gr~and passageway and tunnel and necessary entrances thereto
and exits therefrom in, upon and across a tract of land more
pamt~culamly described in the copy of the easement attached hereto.

regular meeting place, w~th the following members thereof present, to-w~t

constituting a quorum, at which time the followzng proceedings were had
Councilman ~ ~ presented for the con-
sideration of the City Council a resolution and moved that it be adopted.
The motion was seconded by Councilman ~ennz~ . The resolutzon
was read in ~11 by the City Secretary.
The motion carrying with it the adoptzon of the
)resolution prevailed by the following vote
AYES: Councilmen Brooks, Noel, ~, Taylor and
Mayor Barrow.
NOES. None.
The Mayor announced that the resolution had been adopted.

DIRECTING THE DEPOSIT OF FUNDS WITH THE
TREASUREN OF THE STATE OF TEXAS IN AN
AMOUNT SUFFICIENT TO PROVIDE FOR PAYMENT
OF $810,000 CITY OF DENTON WATER A~D SEWER
RE%rENUE BONDS, DATED NOV~ER 1, 1946, AS
AUTHORIZND BY ARTICLE ~118n-5 of V.A.C.S.,
AS A~DED, AND RESOLVING OTH~ MATTT~RS
RELATING TO '.'~E SUBJECT.
W/i~EAS, the C~ty has heretofore authorized and there are
now outstanding $810,000 City of Denton Water and Sewer Revenue Bonds, dated
November 1, 1946, bearing interest at the rate of Two and three-fourths
(2-3/4~) per cent per annum, maturing serzally on November 1 throughout the
years 1960 to 1976, both inclusive, and
WHEREAS~ all of sa~d bonds become due or oot~onal for
prior redemption withlu three (3) years from the date of thzs resolutzoa
and the date of the proposed refunding bonds, to-w~t, July 15, 1960, and
WHEREAS~ by resolution duly adopted June 14, 1960 the
Czty Council authorized and directed that its optzon to redeem sa~d optional
bonds be exercised in accordance with the terms of sa~d retamued option as
set forth in the ordinance authorizing the zssuance of said above descrzbed
bonds, and
WHEREAS~ the notice required to be given prior to the
optiou date~ to-wit November l, 1961, wa~ published zn the Boud Buyer, a
financ~al publication published ~n the City of New York, on the 6th day of
July, 1960~ whzch is at least thirty days prior to sa~d option date and
said notice in writing was filed with the First Natzonal Bank in Dallas~
Dallas, Texas (the paying agent named in each of said bonds), on June 28,
L960, and
WHEREAS~ the City has authorized and sold refunding bonds
· n au amount~ which together with other funds of the City avazlable for sazd
purpose, will provide money sufficient to redeem or provide for redemptzoa of
all of the outstanding bonds of said issue, as authorized by Article 1118a-5 of
Veruon's Annotated Civil Statutes of Texas, as amended, and
WHEREAS~ ~t is deemed proper that the deposit of i~nds
with the State Treasurer be made, as contemplated by sa~d Statute~
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DENTON, TEXAS
1. That the sum of $863,898.16 be deposited wzth the
Treasurer of the State of Texas as authorzzed by Article 1[]8n-5 of Verno~s
A~notated Civil Statutes of Texas, as amended by the 5[~th Legislature, Acts
1955, P. 972, sa~d sum being equal to the principal amount of sa~d above des-
cr~bed outstanding boads~ plus the amount of znterest whzch w~ll accrue on each
of said bonds calculated to the date on which it is to become due or on
which it may be redeemed and the amount of the contract premium together
with an amount sufficient to pay the State Treasurer for his services and
to reimburse hzm for his expenses zn performing his duties under sa~d
statute.
2. The s~m above provided to be deposited with the State
Treasurer is calculated, as follows

hold and disburse the money herein ordered to be deposited with him at the
times, In the manner and for the purpose provided ~u said Article lllSn-), as
amended.
5. The officers, employees and agents of the C~ty are
authorized and directed to take such steps and to execute such documents~ check~
and certificates as may be required to give full effect to the purposes of thzs
resolution.

~R~E S~O L U T I 0 N
~ETEREAS, heretofore the City of Denton, Texas, requested
the construction of safety lighting on Interstate Highway 35~
at the interchanges with South Business Route, F. M. Road 2185,
U. S. ,Highway 377, McCormick Street, Avenue D, Avenue I, West
Oak Street, and State Highway No. 24 under the provisions of
Minute Order 45302 of the Texas State Highway Commission; and
t~EEREAS, the Texas State Highway Commission by Minute No.
~8220!approved the aforesaid safety lighting and directed the
installation at the expense of the State Highway Department all
necessary equipment to complete the same at an estimated cost
of $61,000; and
WHEREAS, the aforesaid Minute Order ~8,220 provides that
as a condition to the expenditure of the aforesaid funds by the
State of Texas the City of Denton shall pay for the electrical
energy and all costs of maintenance necessary to the operation
of the safety lighting system in an efficient and sightly con-
ditioa; now therefore
~$E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON,
TEXAS~ that Minute No. 48220 of the Texas State Highway Commission
passed and approved on August 23, 1960, be and the same is hereby
accepted by the City of Denton, Texas.

RESOLUTION
IWHEREAS, the ~urgeon General of the Public Health Service,
actigg in behalf of the United States of America has offered
to make a federal grant t,o the City of Denton, Texas, in the
amount of Two Eundred and Fifty Thousand Dollars ($250,000),
in order to aid in finane~ing the construction of sewage treat-
ment .works pursuant to the Federal Water Polution Control Act;
and
iWHEREAS, as a condition to the aforesaid grant the Surgeon
General of the Public Health Service is required to receive
certain assurances from the applicant and recipient of the
aforesaid funds, said assurances being those listed in a docu-
ment !entitled 'bffer and Acceptance of Federal Grant for Sewage
Treatment Works Under 33 U.E.C. ~66 et seq."; now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DEN~ ON,
TEXASi, that the City Manager, Homer Bly, be and he is hereby
authorized to accept the aforesaid offer of the Surgeon Gene ral
of th~ United States ~blic Health Service and to make on behalf
of th9 City of Denton, Texas, the assurances contained in the
document entitled "Offer and Acceptance of Federal Grant for
8ewag~ Treatment Works Under 33 U.S.C. 466 et seq."

by the said Board of Equalization; now therefore

TEXAS~ that the Tax Assessment Rolls for the year 1960 as
approved by the Board of Equalization of said City be and the

RE.~OLU T I ON
WHEREAS, on the 27th day of September, 1960, an ordinance
annexing certain territory to the City o£ Denton, Texas, was
introduced to the City Council at a special meeting held on
said ~date; and
%~HEREA$, theretofore the town of Argyle, Texas, purported
to ineorporat under the provisiens of Chapter ll, Title 28
of tho Revised Civil Statutes of Texas, 1925, as amended; and
WEEREAS, the boundaries of the purported incorporated
town of Argyle exceed two square miles and include a population
of more than two hundred inhabitants and less than two thousand
inhablitants in conflict with the general laws of the State of
Texasl; and
WHEREAS, the aforesaid ordinance of annexation includes
a portion of the purported town of Argyle, Texas; and
iWHEREAS, the claim of municipal corporation Jurisdiction
by the town of Argyle, Texas, over the territory included in
the ordinance of annexation by the City of Denton, Texas, is
in dgrogatlon of the lawful right of the City of Denton, Texas,
to e~ercise exclusive Jurisdiction over the same; now therefore
be it
i RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
that the City Attorney of the City of Denton, Lee E. Holt, be
and he is hereby authorized and directed to prepare an Infor-
mation and Petition in the nature of Quo Warranto in order to
detel~mlne the Jurisdloti6n of the aforesaid territory; and be

' RESOLVED that Robert H. Caldwell, Jr., County Attorney
of Denton County, Texas, be and he is hereby requested to file
the same in the District Court of Denton County, Texas, in the

Texas~ were greatly saddened by the sudden passing of their
friend and associate, Glenn M. Geyer, on October l, 1960; and
WItEREAd, those who worked with Glenn M. Geyer knew him to
be a man of friendly, generous spirit and deep devotion to duty;
and
WHEREAB, the outstanding service of Glenn M. Geyer to the
City Of Denton as Electrical Superintendent from March 15, 1955
to July 24, 1959 and as Director of utilities from that date
to his passing on October 1, 1960 will be long and gratefully
remembered by all; now therefore be it

~IEREAS, on the 27th day of March, 19~6, there was pre-
sente8 to the City Commission of the City of Denton, Texas, an
instrument entitled "Dedication of Amended Plat of the Wylie
H. Bavnes Addition to the City of Denton, Texas," which pro-
posedi to dedicate to the City of Denton, Texas, all of the
streets shown on a certain "Amended Plat of the Wylie H. Barnes
Additllon," which had theretofore been filed for record in Volume
2, p~ge 65 of the Plat Records of Denton County, Texas; and
iWHEHEAS, the City Cemmission of the City of Denton, TexaS,
on the recommendation of the Planning and Zoning Commission of
the Olty of Denton, Texas, accepted the said dedicatzon only
as it applied to Blocks A, B, the West 1/2 of Block C containing
LotslNos. 1 thru 7, inclusive, and Block D containing Lots Nos.
i thru 12, inclusive all as shown on the aforesaid plat filed
in Volume 2, Page 65 of the Plat Records of Denton County,
TexaS, as aforesaid; and
i WHEREAS, notwithstanding the partial approval of the pro-
pose~ dedication by the City Commission of the City of Denton,
Tex~S, as aforesaid, the i~trument dedicating the entire
"Amelnded Plat of the Wylie H. Barnes Addition" as shown of
record in Volume 2, Page 65 of the Plat Records of Denton
County, Texas, and erroneously bearing an unrestricted "Certifi-
cat~ of Approval by the City planning Commission of the Czty of
Den$on, Texas," was thereafter flied for record in Volume ~20,
Pag~ 327 of the Deed Records of Denton County, T~xas; and
WHEREAS, the City 6f Denton, Texas, has never, in fact,
accgpted the dedication of the following streets shown in the
"Amended Plat of the Wylie H. Barnes Addition" recorded in
Volum~ 2, Page 65 of the Plat Records of Denton County, Texas,
to wi!, Oakwood Drive East of Lot 14 in Block D, Barnes Lane,
and W~lie Street; and
WHEREA~, the City of Denton, Texas, has not made actual
appropriation of the aforesaid streets, or portions of streets,
by entry, use or improvement; and
WHEREAS, the City of Denton, Texas, does not intend to
make any appropriation of the aforesaid streets, or portions
of stpeets, by entry, use or improvement, or otherwise, for
the r~ason that the Plat of said streets, or portions of
streets, and of Lots Nos. 8 thru 12 of Block C, Lots Nos. 15
thru 20 of Block D, Block E containing Lots Nos. I thru 14,
and Block F containing Lots Nos. i thru 4, all as shown mn
the said "Amended Plat of the Wylie H. Barnes Addition" re-

County, Texas, has neither been accepted nor approved by the

TEXAS,, that Mayor Prank Barrow be and he is hereby authorized
to sign on behalf of the City of Denton, Texas, a quit claim
deed to R. H. Turnbull, and wife, Violet Turnbull, of the afore-
said streets in the "Amenaed Plat of the Wylie H. Barnes Addz-
tion"l which have never been accepted by the City of Denton,
Texasl; and the action of the Mayor in signing such quit claim
deed prior to the date of this resolution is hereby in all
things ratified, confirmed and approved.

of Willis Street North of Mingo Road; and

own property adjacent to Willis Street or who depend
upon said street for access to their property other

~REAS, a public hearing was heretofore advertised for

views on said proposed closing of Willis Street and

Dear Sir:
Sc~etime ago the University purchamed certain property off Schmitz
Street, Mingo Road and Willis Street -- this property being part
of the R. M. Evers, et al, est&te; W. E. Willis, Jr , Etux;
J A. Ellis; and Grover Graham, et al.
Sines Willis Street splits part of this property and dead ends on
the rest of thru University property (Golf Course), we would like
to recluest that the City's utility poles now along this street be
taken down and the street officially colosed. The light poles on
this strmet formerly served the Willis House at 1301 Willis Street,
the Graham house at 1205 Willis Street, the Graham rock house, and
the small house at 1205 Mingo Road. All of these houses are being
sold and diamantled.
We shall appreciate your sul~nitting to the City Council this matter
in or~er that this street may be officially closed and we may pro-
ceed to fence it in and level off the grounds
