RESOLUTION WHEREAS, it has been brought to the attention of the City Councll that former owners of property in the city block bounded by Scripture Street on the North and Oak Street on the South, and by Bryan Street on the East and Normal Street on the West, have by deeds of conveyance created an alley in sa~d block twent~ (20) feet ~n width running ~n a North-South d~rect~on; and WHEREAS, it appears that such alley has never been accepted by the C~ty of Denton by entry, use or improvement, and that there has never been a formal dedication of the said alley to the public; and WHEREAS, the sa~d alley ~s now enclosed by fences and other lmpr~vements and is impassable, and it further appears that the opening of the said alley would not substantially serve the public interest; and WHEREAS, it appears that the existence of the aforesaid alley in the Deed Records constitutes an encumbrance on the t~tle of all partzes owning property zn the aforesaid block; now there- fore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON~ TEX~S, that the alley running zn a North-South direction in the c~ty block bounded by Scrlpture Street on the North and Oak Strest on the South, and by Bryan Street on the East and Normal Street on the West be, and the same is hereby, abandoned by Next Document AT A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, HELD AT THE MUNICIPAL BUILDING OF SAID CITY ON THE 9TH DAY OF APRIL, A.D. 1962. Next Document AT A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, HELD AT T~E MUNICIPAL BUILDING OF SAID CITY ON THE 29TH DAY OF MAY, A.D. 1962. RESOLUTION WHEREAS, by Ordinance No. 62-13 duly passed on April 24, 1962, the City Council of the City of Denton, Texas, ordered the permanent improvement of certain portions of public streets des- ignated therein, by excavating, grading and paving the same, and by the construction of curbs and gutters where required, in ac- cordance with plans and specifications on file with and approved by the City Council; and WHEREAS, pursuant to said ordinance, the City Counclt ad- vertised for bids for the construction of such improvements, and bids were received and opened, all as provided by the Charter of the City of Denton, Texas, and the laws of the State of Texas~ and WHEREAS, the bid of Public Construction Company in the amount of $288,380.57, was the lowest and best responsible bid, and the City Council has awarded the contract for the construction of such improvements to Public Construction Company; and WHEREAS, the con~=act form and contract documents, including the performance bond required by the agreement and by law, have been executed by the said Public Construction Company; now there- fore be it RESOL%~ED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, that the form and substance of the contract and contract documents heretofore executed by Public Construction Company providing for the construction of the improvements above described be and the same are hereby approved, and the City Manager is hereby authorized and directed to execute the same on behalf of the City of Denton~ and be it further RESOLVED, that the performance bond accompanying said con- tract and executed by Public construction Company be and the same is hereby accepted and approved~ and be it further RESOLVED, that the Director of Public Works of the City of Denton be and he is hereby directed to prepare and file with the City Council estimates and rolls as required by law for each Street Unit to be so improved, showing therein the total estima,ted cost of the improvements in each such unit, and showing in detail the description of each parcel of property abutting thereon, together w~h the names of the apparent owners thereof, the number of front feet of each parcel of property, the amount to be assessed against the same, and such other perti- nent £nformation as may be required by law. Next Document RESOLUTION PROVIDING FOR MEETING OF AND PUBLIC HEARING BEFORE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, CONCERNING PROPOSED ACTIONS UNDER THE URBAN RENEWAL LAW OF TEXAS AND PROVIDING FOR NOTICE OF SUCH MEETING AND H~ARING. WHEREAS, the Urban Renewal Law of the State of Texas finds and declares the existence an the %ncorporated cities, towns and villages of said State of slum and blighted areas, as therein deflned, and that such areas constitute a serious and growing menace, in3urious and inlmical to the public health, safety, morals, and welfare of the residents of the State; and WHEREAS, said Urban Renewal Law authorizes the exercise of certaln powers thereunder by any such c~ty, town or v~llage and by an urban renewal agency as provided for in said Urban Renewal Law, for the elimination and prevention of the spread of such slum and blighted areas, provided that the governing body of such city, town or village shall have: (a) Caused to be published at least twice ~n the news- paper officially designated by such governing body, a not,ce that on a date certain, which date shall be stated · n the not~ce and shall be not le~s than s~xty days after the pu~l~cation of the first of such notices, such governing body will consider the ~uest%on of whether or not it w~ll order an elect~on to determine if it should adopt a resolution substantially in the form set forth ~n Section 1 hereof; (b) Determined (on or after the date spec~fled ~n such not~ce) to call such election, (c) Given (after its determination to call such election) , at least thirty days' not~ce of such election, and provided furtner that at such election so called and held, at which only ~uallfled voters residing in such city, town or vzllage, owning taxable property within the corporahe lzm%ts thereof, who have duly rendered the same for taxation, shall be entitled to vote, a ma3ority of those voting thereat shall vote in favor of such governing body's adoption of, and such governing body there- after adopts, such resolution; and WHEREAS, the City Council of the City of Denton, Texas, deems ~t to be desirable that said City avail itself of the pro- vzslons of sazd Urban Renewal Law, zncludlng the provzsions thereof pertaining to an urban renewal agency created in sa%d City by sa~d law; and WHEREAS, it is the purpose and intent of the City Counczl, on the date and at the time and place specified in the form of notice contained zn Section 1 hereof, to hold a public hearing on the ~uestion of, and to consider and determine, whether or not it w~ll order an election to determzne zf it should adopt a resolution substantially zn the form set forth zn sazd form of notice NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, as follows. Section 1. The City Secretary zs hereby authorized and directed to cause to be publzshed zn the October 14th, 1962 and the October 29th, 1962, editions of the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, the followzng notzce: "NOTICE OF MEETING OF AND PUBLIC HEARING BY CITY COUNCIL OF CITY OF DENTON, TEXAS, CONCERNING CERTAIN PROPOSED ACTIONS UNDER THE URBAN RENEWAL LAW OF TEXAS "Pursuant to the provisions of the 'Urban Renewal Law' of the State of Texas, notice is hereby gzven that the City council of the City of Denton, Texas, will meet at the Municipal Building in sa~d City, on the 18th day of December, 1962, at 8:00 o'clock A.M., C.S.T., at which time and place said Council will conduct a public hearing on the question of, and will conslder and determine, whether or not.it will order an election by the ~ual~fled voters residing · n sa~d City, owning taxable property within the boundaries thereof, who have duly rendered the same for taxat£on, to determine if the City Councll should adopt a resolution substantially as follows: ~RESOLUTION MAKING CERTAIN FINDINGS, DETERMINATIONS, AND ELECTIONS UNDER ~ PURSUANT TO THE URBAN RENEWAL LAW OF TEXAS. 'BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, as follows: 'Section 1o It is hereby found and determined that one or more slum or blighted areas ex~st in the C~ty of Denton. 'Section 2o It is hereby further found and determined that the rehabil~tatlon, conservation, or slum clearance and redevelopment, or a combtnat~on thereof, of such slum or blighted area or areas, is necessary ~n the interest of public health, safety, morals or welfare of the residents of said City. 'Sectlon 3. It is hereby further determined that the C~ty of Denton, Texas, shall exercise the powers granted to the City by the Urban Renewal Law of the State of Texas, except the Urban Renewal Pro3ect Powers as defined ~n said Urban Renewal Law. 'Section 4o It is hereby further determined to be necessary and in the public interest that the City of Denton elect, and accordingly, the City hereby elects to have said Urban Renewal Pro3ect Powers exercised by the Urban Renewal Agency of the City of Denton, which Agency ~s created by sa~d Urban Renewal Law. ISection 5o The findings, determinations, and elections herein made are made in accordance with and the various terms used herein are used in the same sense as used or defined in said Urban Renewal Law°' "At the aforesaid public hearing, each person will be given full opportunity to be heard, either in person or by his counsel, relative to the sub3ect being considered, and likewise to present to an~ file with the City Council, for its consideration, his written comments and recommendations relative to such subject. ESSOL TtON WHEREAS, in order to secure to the citizens of Denton the benefits proposed by the Master Plan of said City, the City Council of the City of Denton, Texas, proposes to acquire certain lots, tracts and parcels of land ~ying North of East McKinney Street and between North Locust Street and Bell Avenue in the City of Denton~ Texas, for use as a Civic Center~ and WHEREAS, the City of Denton intends to finance the said land acquisitions through the issuance of time warrants, and it will be to the advantage of the City of Denton to issue all of such time warrants at one timer and WNEP~S, the FirSt State Bank of Denton has agreed to purchase the aforesaid lots, tracts or parcels of land to be included in the said proposed Civic center with the under- standing that the City of Denton, Texas, will, at the time all of such land is so acquired, purchase the same from First State Ba~k of Denton by the issuance of time warrants~ for the same total consideration paid by the First State Bank for said properties, plus interest on said total consideration at the rate of three (3) per cent per annum calculated from the date of acquisition of said lots, tracts or parcels of land, n~w therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTUN, T~XAS, that the aforesaid agreements by and between the FirSt State ~ank of Denton and the City of Denton be, and the same are hereby, ratified, approved and confirmed~ and be it further RESOLVED, that the FirSt State Bank of Denton be, and it is hereby, authorized to purchase under the terms of the aforesaid agreements any and all of such lots, tracts or parcels of land, in the area above described, as may be requested in writing by the City Manager, for such con- sideration as may be set forth in such written request of the City Managerl and be it further RESOLVED, that any and all ~urchases of land made pursuant to t~he &~oresaid agreen~uts by the First State Bank of Denton prior to the date of this Resolution be, and the same are hereby, ratified, approved and confirmed as of the date of any of such purchases. Section 7,., That said election shall be held at the Municipal Building in the City of Denton, Texas, and Jewel Smith is hereby appointed Presiding Judge of said election, and the said Jewel Smith shall appoint such assistants as may be neces- sary to conduct said special election.
