AT A RESULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DENTON,
TEXAS, HELD IN THE MUNICIPAL BUILDING OF SAID CITY ON THE 25TH
DAY OF FEBRUARY, A.D. 1964.
RESOLUTION
WHEREAS, the City of Denton, Texas, in order to promote the growth
and welfare of the community, is desirous of establlshmng
a Municipal Amrport of the h~ghest class possible; and
WHEREAS, full time management and promotion of said Azrport is
necessary to obtain that goal; and
WHEREASe the City of Denton deems it necessary to clarzfy,
immediately, its position concerning the said Airport in
order to negotzate for such management and promotion; and
WHEREAS~ from the permanent records of sazd City, including the
official minutes thereof, it appears that the Operations
Lease of the Airport, dated December 20, 1946, has
expired by its own terms on December 20, 1961, without
ever having been renewed or extended, and that no other
Operations Lease ~s in existence; and
WHEREAS, the big hanger constructed under the terms of the above
lease, at said Airport, has reverted to, and is now the
property of the City of Denton; and
WHEREASw Mr. P. F. Breen has a lease with the City of Denton
covering the ground area of certain "T" hangers
described in such lease dated March 25, 1958, for a
term beginning February 12, 1957, and ending February 12,
1972, (not an Operations Lease); and
WHEREAS, it has been decided that an Airport Board should be created
to study the airport s~tuatzon and give thezr recommendatzons
thereon; now therefore
BE IT P~SOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
that the carry-over tenancy, at sufferance, of the sa~d
P. F. Breen as operations manager under the Operations
Lease which expired on December 20, 1961, is hereby
terminated; and that all the Airport property, including
hangers, other structures, runways and fixtures, not
expressly covered by a valid, existing agreement to the
contrary, ~s now under the exclusive ownershlp and control
of the City of Denton, Texas; and be ~t further
RESOLVED, that an Airport Board for the City of Denton, ~exas, is
hereby created, which Board shall consist of ~u~ _
members appointed by, and shall serve at the pleasure of
the City Council, and be zt further
RESOLVED, that the C~ty Attorney is hereby ordered to initiate,
defend, or otherwise handle any legal proceedlng he may
deem necessary to carry out the ~ntent of th~s Resolution.

RE SOLUTI~
WHEREAS~ the Texas Highway Department by M~nute Order Number 54084,
passed February 26, 1964, has agreed to assist the City
of Denton in the widening of pavement on State Highway 24
including incidental items thereto from Locust Street
West to Malone Street, a d~stance of approxmmately 1.0
mile; and
WHEREASl said Minute Order is sub]ect to the below l~sted three
provismons; and
WHEREAS~ such widening of pavement will materially add to traffic
safety on sa~d highway; now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
that the proposal of the State H~ghway Engineer under
said Minute Number is hereby accepted, and in connection
therewith the City of Denton agrees to
1. Provide for the immediate construction of contin-
uous curb and gutter, utility ad3ustments, storm
sewers, etc., all as may be necessary for a
complete pro]ect with the exception of pavement
widening.
2. Assume responsibmllty for the constructmon of
driveways and s~dewalks should they be deemed
necessary now or in the future and agree to make
such installations in accordance w~th governing
policies and regulations of the Department.
3. Maintain that port~on of the work which ~s mts
construction responsibility and agree to regulate
traffmc, provide for parallel parking and prevent
encroachment on the right of way, all ~n accordance
w~th governing pollcles and regulatmons of the
Department.

RESOLUTION
WHEREAS, the City of Carrollton, Texas, under date of November 12,
1963, transmitted to the Texas Water Commission an appli-
cation for a permit to appropriate public waters from
Garza-Little Elm Reservoir and the proposed Aubrey
Reservoir; and
WHEREAS, the application was received by the Texas Water Commission
November 14, 1963, but has not been accepted for filing; and
WHEREAS, the City of Carrollton makes application for the diversion
of 53,000 acre feet annually; and
WHEREAS, under Paragraph J, which reads as follows: "If a permit
for the appropriation ~s granted, e~ther in whole or ~n
part, construction work w~ll be begun w~th~n 365 days
after such permlt is issued. The proposed work w~ll be
prosecuted diligently and continuously and w~ll be completed
w~thln 3 years from date of issuance of permit. If all
or part of these waters ~s obtained from proposed Garza-
Little Elm or Aubrey Reservoir, construction would
necessarily need to be delayed until construction of these
projects begins."; and
WHEREAS, there is attached to said application a supplement which
reads as follows: "The C~ty of Carrollton ~n this
application applies for a permit to appropriate public
water from the unappropriated waters ~n the existing and
proposed enlarged Garza-L~ttle Elm Reservoir and the proposed
Aubrey Reservoir. These are a part of the available waters
and reservoirs proposed ~n%he Corps of Engineers Compre-
hensive Survey Report on Trinity R~ver and Tributarles -
Texas, dated June, 1962. The subject water ~s to be from
the available conservation storage as existing and addi-
tionally proposed conservation storage ~n these reservoirs.
The first portion of the appropriation of 53,000 acre
feet per year is to be taken from the unappropriated yield
of Garza-Little Elm reservoir, as existing and additionally
proposed wlth necessary additional water, for a total
appropriation of 53,000 acre feet per year being taken from
the proposed Aubrey Reservoir. Necessary water from the
Aubrey Reservoir would be released to the downstream Garza-
L~ttle Elm Reservoir, and then released from Garza-Little
Elm Reservoir lnto the suction line of a pump station at
location shown in application. .Final location of diversion
dam and pump station is subject to m~nor change to correspond
with channel ~mprovements planned ~n the above mentioned
Corps of Engineers Report."; and
WHEREAS, the City of Denton, Texas, under Application No. 1590,
filed November 24, 1948, was granted a Permit, No. 1706,
dated June 21, 1954, by the Texas Water Commasslon for the
annual diversion of 11,000 acre feet annually and the
storage of 21,000 acre feet an Garza-Lattle Elm Reservoir;
and
WHEREAS, the City of Denton, Texas, under date of December 11, 1953,
entered into a contract with the U. S. Government, No.
DA-41-443-eng-1098, for the right to use an undavlded 4.8%
of the conservation storage space ~n the Garza-Little Elm
Reservoir; and
WHEREAS, the City of Dallas, Texas, under a s~m~lar contract and
permit, has the rights to 95.2% of the conservataon storage
space in the Garza-Little Elm Reservoir; and
WHEREAS, under date of January 7, 1955, the Texas Water Commlss~on
accepted for faling Presentation No. 1331 by the City of
Denton covering the proposed Aubrey Dam Site and Reservoir,
which presentation was continued an full force untal
January 7, 1958, the full legal period an whlch the
presentation could be maintained in effect; and
WHEREAS, under date of June, 1962, the Corps of Englneers comp~ted
a "Comprehensive Survey Report on ~rin~ty River and
Tributaries - Texas" which report ancludes as a Federal
project the proposed Aubrey Reservoar together wath the
modification of the existing Garza-Lattle Elm Reservoar;
and
WHEREAS, at a public hearing held ~n Austin, Texas, July 30, 1963,
by the Texas Water Commission on the above captioned report
the C~ty of Denton publicly advised the Texas Water
Co~ission and all other anterested partaes of Denton's
need, anterest in, and contemplated plans for the Aubrey
Reservoir and modifled Garza-L~ttle Elm Reservoir; and
WHEREAS, at the same public hearang the Clty of Denton made specific
requests of the Texas Water Commission to take such action
as would ~nsure "Denton's right to negotiate wlth the Corps
of Engineers for the purchase and ownershap of not less
than 26% of the conservatlon storage space to be made
available by the construction of the Aburey Reservoar; and
WHEREAS, the Cities of Dallas and Denton, the owners of 100% of the
conservation storage space ~n Garza-L~ttle Elm Reservoir,
recognaz~ng the need and desarab~l~ty to have the proposed
Aubrey Reservoir constructed to its optimum potential which
development necessitates an exchange of storage space an
the Garza-Llttle Elm Reservoir and the proposed Aubrey
Reservoir, entered into a contract under date of November 19,
1962, whereby the City of Denton agrees to pay for and own
26% and the City of Dallas s~m~larly agrees to pay for and
own 74% of the additional conservataon storage space to be
made available by the construction of the Aubrey Reservoar
together with the necessary interchange of storage space
in that reservoir with that ~n the exastlng Garza-Little
Elm Reservoir; and
WHEREAS, the C~ty of Denton in its long range planning depends upon
the Garze-L~ttle Elm Reservoir and the proposed Aubrey
Reservoir all as set forth in the above mentioned contract
with the C~ty of Dallas; and
WHEREAS, there is no unappropriated water or storage space ~n the
Garza-L~ttle Elm Reservoir; and
WHEREAS, the proposed Aubrey Reservoir w~ll be constructed by the
Corps of Engineers; and
WHEREAS, the proposed Aubrey Reservoir w~ll not be constructed
until 1980; and
WHEREAS, the C~ty of Carrollton recognizes under Paragraph J of
their appllcation, which paragraph is quoted above, that
it would be impossible to commence construction in the
immediate future; now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
that the City of Denton formally requests the Texas Water
Commission to reject the application of the City of
Carrollton, Texas, for the storage of water in reservoirs
existing and to be constructed on the Elm Fork of the
Trinity R~ver and divert therefrom 53,000 acre feet
annually, all as set forth in the application of the City
of Carrollton, Texas, received by the Texas Water
Commission November 14, 1964; and
BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded
to the City of Dallas, Texas.

1. The City Secretary is directed to issue a Notice
of ~ale of Bonds in substantially the following form:

The City Council of the City of Denton, Denton County, Texas,
will receive sealed bids at the Municipal Building in the
-City of Denton until:
10:30 AM, CST, Tuesday, June 9, 1964,
for the purchase of:
~800~000 General Oolisation Bonds, to be dated July 15, 1964,
and to mature serially July 15 each year 1965 through 1982,
inclusive;
$200~000 Park Improvement Bonds, to be dated July 15, 1964,
and to mature serially July 15 each year 1965 through 1982,
inclusive, and
~250~000 Water and Sewer System Revenue Bonds, to be dated
July 15, 1964, and to mature serially on July 15 each year
1965 through 1984, inclusive.
Sealed bids, plainly marked "Bid for Bonds", should be
addressed to "Honorable Mayor and City Council, Czty of
Denton, Texas", and must be submitted on the "Official Bid
Form" to be provided by the Czty przor to the date of sale.
Ail sealed bids will be publicly opened and tabulated before
the Council.
Copies of the "Official Statement" and "Official Bid Form"
are being prepared and will be mailed to prospective bidders
on or about May 18, 1964, by First Southwest Company, 927
Mercantile Bank Building, Dallas 1, Texas, Financial
Advisors to the City.
The City reserves the right to reject any and all bids and
to waive any and all irregularities.

WHEREAS, the City Englneer recommends the use of the Delta-Seal

Standard Specifmcatlons for Water, Sewer and Streets mn

to read as follows:
7-4 Joints: Sewer pmpe 3olnts shall be factory fabricated

properties. These propertmes must conform to all
specifications of A.S.T.M., Desmgnatmon C-42~'-60T.
This p~pe shall be laid strmctly mn accordance with
the manufacturer's recommendations. The contractor
must have suitable experience mn laying th~s type
of joint.
No type joint shall be made when water ms mn the trench,
nor shall water be allowed to r~se around the p~pe before
the ]oint has set. The pipe and bells shall be cleaned
when laid and shall be so laid and centered as ~ form a
concentrlc ]oint wlthout offsettmng the mntermor of the
pipe;
now therefore

BEFORE THE CITY COMMISSION OF THE CITY OF DENTON, TEXAS, A
MUNICIPAL CORPORATION
WHEREAS, heretofore the then owners of a certain
tract of land out of the B.B.B. & C.R.R. Company Survey,
Abstract No. 186, subdivided a small port,on of a tract of
land and filed a plat in the Office of the county Clerk of
D~nton County, Texas, designating said subdivision as OAKWOOD
ADDITION to the City of Denton, Texas; and
WHEREAS, said purported subdivision and addition
contained only nxneteen (19) lots lying immediately East of
North Locust Street in the City of Denton, Texas, being Lots
O~e through N~ne in Block "A# and Lots One through Ten in
BlOck #B# of Oakwood Addition to sa~d City of Denton, Texas~ and
WHEREAS, said plat left a sixty-foot strip lying
between said Blocks "A" and "B" of said Addition, which sixty-
foot strip began at North Locust Street and extended for a
distance of 800 feet where it terminated; and
WHEREAS, by reason of the leaving of sa~d sixty-
foot strip it might be construed by some to indicate that
said sixty-foot strip was intended to be dedicated as a public
street; and
WHEREAS, said sixty-foot strip xs wholly undesirable
as a stEeet and did not, and does not, comply with the
requirements of the City of Denton, Texas, for public street
purposes; and
WHEREAS, said sixty-foot str~p aforesaid and which
is hereinafter described has never been accepted, recognized or
used by said City of Denton, Texas, as a public street and sa~d
City of Denton, Texas has no need for the same, and does not and
has never approved or accepted the same; and
WHEREAS, the filing of said plat with said strip
located aforesaid is a cloud against the title to such tracts,
and the tract herein described, and the present owner of sa~d
t~acts of land desires that said cloud be removed; and
WHEREAS, the City of Denton, Texas, a municipal
corporation, makes no claim to said str~p of land as a public
street or otherwise, and has no ownership therein~
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF DENTON, TEXAS, and xt is hereby determxned that
the strip of land hereinafter described has never been

voters of Denton County, Texas, approximately $50,000
from other surplus funds, and partly by federal
funds yet to be obtained; and,
WHEREAS, it is necessary that the Chazrman of sa~d Board of
Managers be ~uthorized to s~gn all papers in connec-
tion wlth the application for and securing federal
funds as well as entering mnto various contracts for
the bumlding and equipping of the hospital plant
facilities;

RESOLUTION
WHEREAS, the City of Denton, a municipal corporation, and the
County of Denton, a political subdivision of the State
of Texas, are the legal owners of a tract of land
conveyed by W. C. Potter and w~fe to the C~ty of Denton
and the County of Denton, Texas, by deed dated December
18, 1952, recorded in Volume 383, Page 187, of the
Deed Records of Denton County, Texas, and a tract of
land conveyed by W. C. Potter and wife to the C~ty of
Denton and the County of Denton, Texas, by deed dated
May 3, 1960, and recorded in Volume 456, Page 26, of
the Deed Records of Denton County, Texas; and,
WHEREAS, the Texas Highway Department, working in conjunction
wath the Un~ted States Bureau of Public Roads, has
duly designated and ls planning for the construction
of a new segment of the National Interstate and Defense
Highway System connecting the C~ty of Denton and
Denton County w~th the C~ty of Fort Worth and Tarrant
County to be and become a part of Interstate Highway 35W
and the Texas Highway Department as at this time nego-
tiating wath land owners to acquire the necessary right
of way for the construction of the aforesaid h~ghway; and
WHEREAS, the Texas H~ghway Department has formally notified the
City and the County of Denton that 2.772 of an acre
and 0.456 of the land leased to the Texas Nataonal
Guard A~aory Board (2.772 of an acre for highway right
of way purposes and 0.456 of an acre for a channel
drainage easement) wall be ~nvolved in the plan for
construction of the new segment of Interstate Highway 35W
and must be acquired from the City and County of Denton
by the Texas Haghway Department; and
WHEREAS, the Council of the C~ty of Denton, Texas, has duly
considered and discussed the request of the Texas
Highway Department for the aforesald land and fands
that saad request is reasonable and proper and that
the land Ks necessary to meet and comply w~th the ex~s-
ting plans and designs for sa~d Hlghway and f~nds that
the offer of ~h~ty Thousand, Two Hundred E~ghty Seven
($30,287.00) Dollars is reasonable, just and constitutes
adequate and fair compensataon for the sa~d land, and
the said Council has determined that the said offer
should be accepted;
now therefore
BE IT RE~OLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
t~a~ the request of the Texas H~ghway Department for
the grant and conveyance of a tract of land consisting
of 2.772 of an acre for haghway purposes and a tract

Security Act has been amended to permit participation
of firemen in positions covered by a retirement system;
and
WHEREAS, the firemen of the City of Denton, Texas, through
co~ff~,ittee representation, have requested this Council
to ask the Texas State Department of Public Welfare
to hold an election by the firemen of said City of
Denton who are members of the Firemen's Relief and
Retirement System to determine whether or not they
wish to have Federal Old Age, Survivors, and Disa-
bility Insurance coverage an addition to the ex~sting
retirement system;
now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
in order to meet the requirements of Section 218(p) of
Title II of the Federal Social Securmty Act, as amended,
this Council requests the Texas State Department of
Public Welfare to hold as expeditiously as possible a
referendum of the firemen members of the retirement
system, as required mn said law and mn House Bill 603,
Acts of the 52nd Legmslature of the State of Texas, 1951.

WHEREAS, J. Newton Rayzor has unselfishly donated two park
and recreation areas to the City of Denton, Texas,
and its people for the sole purpose of the Honorable
Mr. Rayzor~s interest in the welfare and progress

WHER~S, one of the said park and recreation areas is situated
in the Asa Hickman Survey, Abstract %521, adjoining
the intersection of Bernard Street and Roselawn Drive,
containing 23.044 acres and the other park being
situated in the T. Toby Survey, Abstract %1285, being

RESOLUTION
WHEREAs, D. D. Vaughn Constructmon Company is now engaged an
work under private contract and desires, in order to
complete such work, to conduct blasting operatmons in
an area in the City of Denton, Texas, on the north
side of Highway 24 from 1400 feet east of Bonnie Brae
Street to 440 feet east of R. E. A. office; and
WHEREAS, the said D. D. Vaughn Construction Company has applmed
to the City Council for permmssion to conduct the
aforesamd blasting operatmons, as requmred by the
ordmnances of the City of Denton; now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TE~S,
that D. D. Vaughn Construction Company be, and at Ks
hereby, granted permmssion to conduct such blasting
operations on the north side of Hmghway 24 from 1400
feet east of Bonnie Brae Street to 440 feet east of
R. E. A. office in the City of Denton, Texas, as may
be absolutely essential to the proper and workmanlmke
performance of their contract as aforesamd; and be it
further
RESOLVED, that the permission given under thms Resolution to
conduct such blasting operatmon be, and the same Ks
hereby, made conditional upon the agreement by the
aforesaId D. D. Vaughn Construction Company to hold
and save the City of Denton harmless from any and all
causes of action for personal in]urles, mncluding
death, or property damages of whatever kmnd or nature
that may arise in any way out of such blastmng oper-
ations, and the acceptance of terms of this Resolution
shall be evidenced by the smgnature of an authorized
agent or employee of the said D. D. Vaughn Construction
Company before the permission granted hereunder shall
become operative.

Company,~ proposes to place a n 8" Water pipe line within the right-of-
way of S~ate Highway No. Loop 288 in Danton County,
Texas as follows: Beginning at a point 50' from the intersection of the West
ROW line,of State Hwy. Loop 288 and the North ROW line of Farm-Market Road 426;
said point b~ing 5m East of the West ROW line of State Hwy. Loop 288.
Thence East across State Hwy. Loop 288 to a point 5' West of the East ROW
line of said Loop 288.
Thence North 5m West of and parallel with the East ROW line of Loop 288 100m.
Pipe to be bored under Hwy. INSIDE CITY LIMITS .................
~The location and description of the proposed line and appurtenances is
more fully shown by four copies of drawings attached to this
notice. The line will be constructed and maintained on the highway right-of-way
as directed by the State Highway Department in accordance with governing laws.
Construction of this line will begin on or after the 30th day of
November 19 64.
