RE~OLUTION APPROVING PARTICIPATION BY FAIRHAVEN INTHE FEDERAL RENT SUPPLEMENT PROGRAM WHE~EAs~ under the prOVlS~Ons of Section 101 of the Housing and Urbam Development Act of 1965, the Secretary of Housing and Urban Development is authorlze~ to enter 1nrc contracts to make rent supplement payments to certain qualified hous- ing owners on behalf of qualified low-~ncome families who are elderly, hand~capped, displaced, victims of natural disaster, or occupants of substandard housing; and WHERE~S~ the provisions of said Section 101 can not be made avazlable to housing owners in certain localities unless the governing body of the locality has by resolutxon given approval for such participation ~n the Federal Rent Supplement Program; now therefore BE I~RESOLVED BY THE COUNCIL OF THE CITY OF DENTON, TEXAS, AS FOLLOWS: approval is hereby granted for participation in the Federal Rent Supplement Program by FAIRHAVEN, a Texas non-profit corporation, with the under- standing that the C~ty of Denton ~s not ~n any manner obligated by reason of th~s approval or by any Houslng Owners partlclpat~on in the Federal Rent Supplement Program. D. 1967. ~ R ~ $ Q,L U T ~ 0 ,~ WHEREAS, ~t ~s contemplated that the C~ty of Denton, Texas w~ll construct certain sewage treatment fac~llt~s with an estimated total cost of $907,230; and WHEREAS, it is found that the City of Denton, Texas is un- able to provide the total cost of such improvements; and WHEREAS, it is deemed necessary and proper to apply for federal grant under the Federal Water Pollution Control Act, Public Law 660, as amended, ~n order to have suffxcient funds to complete these much needed improvements; now therefore BE IT RESOLVED BY THE MAYORAND CITY COUNCIL OF THE CITY OF DENTON, TEXAS that Warren Whltson, Jr., Mayor of the City of Denton be and is hereby authorized and directed to make applxcatxon and s~gn the necessary documents requir- ed to complete the pro]ect on behalf of the Cmty of Denton, for a federal grant under Public Law 660, as amended; to be applied to the cost of the con- structlon of said sewage facilities. The City of Denton hereby agrees that xf a federal grant for the pro3ect xs made pursuant to the Federal Water Pollution Control Act, the City will pay the remamn- lng costs of the approved pro3ect. RESOLUTION BE IT RESOLVED ~HAT THE FOLLOWING REMARKS BE ENTERED UPON THE MINUTES OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS: On behalf of the people of the City of Denton, Texas, the Mayor and City Council hereby public- ly express their sincere thanks and appreciation to Mark Hannah for his valuable and unselfish public services as a member of the Flow Memorial Hospital Board from his ~nlt~al appointment by Clty Con~niss~on on December 8, 1958, until reslgnat~on effective May 9, 1967. The said Mark Hannah, a leading and outstanding citizen of this con. unity, who served and gave his talents as Mayor of the City prior to his appointment to the Flow Memorial Hospital Board, has served as a member thereon continuously, and was chairman thereof at the time of h~s resignation. Before e~ther party shall enter ~nto any agreement w~th any third party for the attachment of any facxl~t~es to,any 3o~ntuse pole covered xn th~s contract, a mutually agreeable arrangement for these facllxtxes shall be made by and between both part~es to th~s contract. In n, event shall any CATV facility be ~nstalled w~thout the express permss~o: ~n writing of the C~ty of Denton, Texas. ARTICLE II pC(PLANATION OP TERMS For the purpose of th~s Agreement, the following terms shall have tho follow~n~ meanzngs. NORMAL ;PACE on a lo~nt pole zs the following described space for the ~ exclusive u;e of each party, respectively, except that certain attad~nents of one party m~y, in accordance w~th specifications mentioned ~n Artzcle III, be located ~n ;pace assigned to the other party. For the C~ty, the uppermost ten (10) feet measured from the top of the pole. For the Telephone Company, space for forty [40) ~nches at a distance below the space of the C~ty of Denton to prowde, at all t~mes, themnnnum clearance required by the specific- athens mentioned ~n Article III A NOI~ J, JOINT POLE under th~s agreement shall be a forty-five (45) foot, class three (3) wood poles as covered by the American Standards Association spec~f~cat~ OhS. COST as applied to new poles shall mean the cost in place As applied to ex,stun poles, "Cost" shall mean the reproduction cost less depreciation. NET SS as applied to pole replacements shall mean the reproduction cost less depre( ~at~on, plus the cost of removal m~nus the salvage value of the pole repla~ .ed.
