RESOLUTION
WHEREAS, under the provzszons of Section 23 of the
Unzted States Housing Act of 1937, as amended, the United
States of Amermca, acting through the Secretary of Houszng
and Urban Development, is authorized to provzde fznanczal
asszstance to local public housing agencies ~n providing
low-rent houszng by leasing dwelling units zn przvately-
owned structures, and
WHEREAS, said Section 23 provides that the provzslons
thereof shall not apply to any locality unless the governing
body of the locality has by resolution approved the applz-
cation of su%h provzsions to such localmty
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF DENTON, TEXAS AS FOLLOWS
That the applicatzon of the provzszons of Sectzon 23
of the United States Housing Act of 1937, as amended to Denton,
Texas is approved

WHEREAS, zt zs the desire of this localzty to improve
houszng presently available, and take strzdes toward the goal
of provzdzng a decent home in a suztable lzvzng envzronment for
all o~ its citzzens, and
WHEREAS, under the provzszons of the Unzted States Hous-
zng Act of 1937, as amended, the Department of Housing and Urban
Development has been authorized to provide financial assistance
to local communitzes toward partial fulfillment of the above
stated goal, and
WHEREAS, the Housing Authority of the City of Denton,
Texas has been created and designated to be a publzc housing
agency for applzcation and receipt of such fznanczal asszstance,
now therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DENTON,
TEXAS
That the Czty Counczl and staff strongly endorse sazd
public housing pro3ect and by evidence of the executzon of this
znstrument express their deszre to cooperate, facilitate and
work expeditiously with the involved Federal agenczes admzntster-
zng this program toward its completzon, and
That said Council acknowledges zts approval and zntent
to make available the professzonal and admznistrative personnel
wzthzn its staff to asszst and direct such program, zncludzng
the use of required office space and faczlztzes

RESOLUTION
WHEREAS, on the 22nd day of June, 1971, and the 2nd day of
July, 1973, by przor Resolutzons of thzs Council,
the Mayor of sazd Czty was authorzzed to pledge
the proceeds due the City of Denton under Paving
Assessment Program No 6, and the assessment for
Universzty Drzve West, and to execute a promis-
sory note for the total thereof payable to the
First State Bank of Denton, Texas, payable one
year from the date of executzon of sazd note, at
a rate of four (4%) per cent annual znterest, and
WHEREAS, payments have been made upon said note reducing
the balance thereon now due and payable at sazd
bankzng institution, and
WHEREAS, zt is determined that zt zs stzll zn the best zn-
retest of sazd City that sazd note prevzously exe-
cuted by the Mayor in behalf of sazd Czty extend
the terms of said note for an addztzonal one year
period, now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS
That sazd note previously executed and descrzbed
above be renewed and extended for an addztzonal one
year perzod at frye and one-half (5%) per cent
annual znterest thereon, and
That Bill Neu, Mayor of the City of Denton is here-
by authorzzed to execute sazd note and to pledge
said proceeds above descrzbed for the payment there-
of

9, 1973 until her antrmely death on June 27, 1974,

yond the mere efficient drscharge of her dutres
rn promotrng the welfare and prosperrty of the
c~trzens of Denton, and earned the full respect
and admrratron of her colleagues and assocrates,
and
WHEREAS, she was the krnd of ~ndrvrdual who gave not only
her trme and money but took a srncere rnterest ~n
the lrfe and we£1be~ng of all the people wrth whom
she came rnto contact and dedrcated herself to the
proposition of building a better lrfe wrthrn the
community.

RESOLUTION AUTHORIZING AND DIRECTING SUBMISSION OF
APPLICATION FOR A LOW-RENT HOUSING PROGRAM
WHEREAS, the Unzted States Housing Act of 1937 provides that
there shall be local determination of the need for low-rent hous-
ing to meet needs not being adequately met by private enterprise,
and
WHEREAS, under the provisions of the Unzted States Housing
Act of 1937, the Secretary of Housing and Urban Development is
authorzzed to provide financial assistance to publzc houszng
agencies for low-rent housing,
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS OF THE
PUBLIC HOUSING AUTHORITY OF THE CITY OF DENTON, TEXAS AS FOLLOWS
(1) That the Public Housing Authorzty of the City of Denton
Texas hereby determines that within its area of operatzon there
zs a need for low-rent housing to meet needs not bezng adequately
met by private enterprise
(2) That the Executzve Director shall cause to be prepared
and the Chairman shall sign and send to the Secretary of Housing
and Urban Development an application for financial assistance for
one hm%dred sixty (160) dwelling units to be provided by leasing
privately owned housing under Sectzon 23 of the Unzted States
Housing Act of 1937
(3) In connection with the development and operation of any
program or actlvzty receiving Federal financial asszstance under
the United States Housing Act of 1937, regardless of when such
pro= gram or activzty or any portion thereof was or zs initially
covered by any contract, the Public Houszng Authorzty of the City
of Denton, Texas will comply wzth all requirements imposed by
Tztle VI of the Civzl P. zghts Act of 1964, Public Law 88-352, 78
Stat 241, the regulations of the Department of Housing and Urban
Development issued thereunder, 24 CFR, Subtztle A, Part 1, and
the requirements of said Department thereunder

RESOLUTION
WHEREAS, the State of Texas proposes to offer for sale a certain
tract of highway right-of-way being 17.818 square feet
of land more or less~ smtuated mn the Nathan Wade Survey,
Abstract 1407, and being a portmon of a 4.82 acre tract
of land conveyed to the State of Texas by deed recorded
in Volume 400, Page 103, Deed Records of Denton County,
Texas, said 17,818 square feet of land being more parti-
cularly described by metes and bounds as follows
BEGINNING at a point In the exmstmng West right-of-way
line of I.H.35 South 02 Deg. 57 min. East 344 feet and
South 01 deg. 29 min. 00 sec. West 258.77 feet from
Northeast corner of a tract of land conveyed to Richard
A. Harrms by deed recorded in Volume 380, Page 271, Deed
Records of said County;
THENCE South 07 deg. 56 mln 20 sec. East for a distance
of 469.74 feet to a point mn the South line of said State
of Texas tract of land;
THENCE North 88 deg. 31 min. 00 sec. West for a distance
of 76.90 feet to the Southwest corner of said State tract,
THENCE North 01 deg. 29 min. 00 sec. East for a distance
of 463.40 feet to the place of begmnnlng, and
WHEREAS, the State of Texas through its Highway Department has re-
quested a determination of whether that certamn tract of
land is needed by the citizens of the City of Denton for
use as a road; and
WHEREAS, an lndependant determination has been made by the C~ty
of Denton that said parcel of land ms neither presently
used nor anticipated to be used or requmred to be used
to meet the traffic requirements of the citizens of Denton,
now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
that the C~ty of Denton approves of the proposed action of
the State of Texas for the sale of the aforementmoned pro-
perty.

WHEREAS, Floyd Graham d~ed Sunday the 18th day of August,
1974 at the age of 71 years, and
WHEREAS, Professor Floyd Graham durrng the course of hfs
l~fe contributed greatly to hfs country and com-
munrty through unselfrsh professronal and
munrty servrce as the creator of a world renowned
musrc program and a less well known, but equally
successful £eader of hfs communrty which he served
as both Chref of the Denton Volunteer Frre Depart-
ment and later as Frre Chref EmerrtuS of the Denton
Frre Department, and
WHEREAS, Floyd Graham~ awards and honors durrng hfs lrfetrme
were many, a Irfetrme rs not a s uffr~ent length
of ~me to honor such a man

gaining an awareness of the problems assocIated with Narcotics and
Dangerous Drugs and the necessity of c~t~zen participation an their
control,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DENTON, TEXAS
That the City Council of the C~ty of Denton strongly endorse
the Narcotics and Dangerous Drug Unit of the Denton Police Department
and pledge its continuing support to this program at the same level
as its current operation beyond the Unit's present two year funding
and for so long as the Unit shall serve as an effective instrument ~n
combating the unauthorized possession, purchase and use of dangerous
drugs

and the rules and regulations pursuant thereto
NOW, THEREFORE, BE IT RESOLVED by the C~ty of Denton that
Edwin Earl Jones, Water and Sewer Superintendent, or his suc-
cessor, is hereby authorized and d~rected to make application
for a grant under Public Law 92-500 and the rules and regula-
tions pursuant thereto, and to s~gn the acceptance of the grant,
when made, and any other necessary documents required to com-

WHEREAS, the City of Denton, Texas, has made application to
the Texas Water Quality Board and the Environmental Protection
Agency for a federal grant pursuant to the Federal Water Pollu-
tion Control Act Amendments of 1972, Public Law 92-500, and the
rules and regulations thereto
NOW, THEREFORE, BE IT RESOLVED by the City of Denton that the
application for which federal grant assistance has been requested
pursuant to the Federal Water Pollution Control Act Amendments of
1972, Public Law 92-500, will be constructed to completion in
accordance wlth the laws, rules, and regulations and wlth the

WHE~AS, the design of present law enforcement radio communications
systems does not permit efficient restructuring of the net-
work, and
WHE~AS, the structure of the statewide system has been determined
nd implementation of regional systems will continue on the
basis of the statewide concept established by the Texas
Criminal Justice Division, Office of the Governor, State of
Texas, and
WHE~AS, the North Central Texas Co~cil of Governments has submitted
bidding specifications to prospective vendors, and the Execu-
tive Board, after considering the bids, has determined the
low compliant bidder, and
WHE~AS, it is the opinion of this City Co~cil that the best interest
of the citizens of the City of Denton will be served by par-
ticipating in this cooperative program
NOW, THEREFORE~ BE IT RESOLED BY THE CITY COUNCIL OF THE CITY OF DENTON,
TEXAS, THAT
(1) The City of Denton desires to participate in the
cooperative purchase of law enforcement radio com-
munications equipment, Phase III
(2) The North Central Texas Co~cil of Governments is
authorized to enter into binding contract with the
low compliant vendor and to purchase comm~ications
equipment in behalf of the City of Denton
(3) This City understands that the Texas Criminal Justice
Division is providing seventy-five (75%) percent fund-
ing and that the amount of Fourteen Thousand Three Hun-
dred Eighty-Five and 12/100 ($14,385.12) Dollars is our
matching share of the purchase of the equipment and the
a~inistrative and engineering cost of the project
(4) To indicate the City's desire to participate in this

mately 0 8 miles, and
WHEREAS, said minute order delineated therein certain provi-
sions that the State Highway Department will carry
out regarding said project, and
WHEREAS, said order further listed specific responsibilities
to become the obligation of the City of Denton upon
implementation of said project,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DENTON, TEXAS
That the City of Denton, Texas, through this Resolu-
tion, acknowledgesits acceptance of the proposal
tendered to it by the State Highway Commmssion, as
evidenced by its Minute Order No 69406, and the terms
and conditions contained therein, to which reference
is made for all purposes, and again reiterates its in-
tent and desire to enter into an agreement with said
highway department to forthwith initiate and implement

THIS AGREEMENT, made this /3 day of ~~2. 1976, -
by and between the City of Denton, Texas, hereinafter called the
"City", Party of the First Part, acting by and. through its City
Council and the State of Texas, hereinafter called the "State",.
Party of the Second Part, acting by and through its State Highway
and Public Transportation Commission.
WHEREAS, the .City desires the construction of concrete curb
and gutter, storm sewers and incidental items within the lie:its
from U. S. Highway No. 377, north approximately 0.9 mile to Hickory
Street on Metropolitan Highway No. 155, which is solely the City's
responsibility and the City has requested the State_to construct
or have constructed this work. The State will construct or have ..
constructed this work for and on behalf of the City and at the
City's sole expense, excluding preli-urinary engineering. The
estimated construction cost of this work is Four Hunflred Ninety
Four Thousand Two Hundred and No/100 Dollars ($494,200.00), in-
eluding contingencies and construction engineering,-and
WHEREAS, the City by the execution of this agreement agrees
to the terms and conditions of Commission Minute No. 69406, as it
applies to the City, a copy of which is attached hereto and narked
"Exhibit A" and made a part of this agreement..

' NOW THEREFORE, it is understood that this proposed work will
be constructed by the State and the. City will transmit to the State
with the return of this agreement, executed by the City, a warrant
or check made payable to the State Treasurer, Account. of-Trust Fund
No. 927 in the amount. of Four Hundred Ninety Four Thousand Two
Hundred and. No/100 Dollars ($494,200.00), to,be used in paying for
the proposed work required-by-the-City in the-City-of Denton'.=-It-"-=~~_"
is further understood that the State will construct only those
items for the City as requested and required by the, City and the

entire cost of such :.items, excluding preliminary engineering, will
be borne by the City. If the State elects to receive bids and if
upon receipt of bids by the State and/or the actual construction
and/or approved changes in the contemplated.-improvements it is
found that this amount is insufficient to pay the City's portion,
then the City upon request of the State will forthwith supplement
this amount by an amount equal to the City's full estimated or'
actual share of the cost of this work less the amount previously
paid into Trust Fund No. 927. In the event the amount as paid is

,--- - WHEREAS, in DENTON COUNTY, the City of Denton has requested assis-
_- tance in reconstruction of grading, structures and surfacing on Carroll
Street from Hickory Street to U.S. Highway 377, a distance of approxi-
metely 0.8 mile; and
WHEREAS; it is anticipated that Carroll Street will be included
in the Urban System; and
WHEREAS, it is~the desire of the Texas Highway Department to
assist the City of Denton in such work; .
NOW, 1HEREFURE, the State Highway En;ineer is directed ±e te.^.der

Provided the City will:
1. Furnish all required right of way clear of obstructions with -
acquisition procedures to be in accordance with applicable
Federal and State laws governing the acquisitiort~policies for
acquiring real property.
2. Provide for the adjustment of utilities, the construction of
continuous curb and gutter, storm sewers, driveways and side-
walks, all as may be required-and all in.accordance with gov-
erning policies and regulations of the Highway_Department:
3. Maintain all of the work constructed as part of .the project
and agree to regulate traffic, prohibit parking. and prevent
encroachment on the right of way,,all in accordance with gov-
erning policies and regulations of the Department.
Subject to the availability of Federal-aid Urban System funds and
the eligibility of the proposed work for financing with .said funds, the
Texas Highway Department will:
1.,_Prepare construction plans and specifications.
2. Provide-for reconstruction of grading, structures and surfacing
at an estimated cost of 5834,000.00 as authorized in the Texas
Highway Department 1974 Urban System Program.
Upon acceptance of the provisions of this Order by -the appropriate
officials of the City of Denton, the State Highway Engineer is directed to
enter into agreement with the City covering the details of the proposed
improvements, to proceed with the engineering development of the project
and after the City has fulfilled its responsibilities, to proceed with
construction as authorized herein in the most feasible and economical
manner.

It is under;aood that the"City may discharge its construction
obligations as outlined herein in any manner as they may elect. In the
event the City desires the State to include its portion of the vrork in
the State's construction contract, the State Highway Engineer is hereby
authorized to enter into agreement with the City for such work and its

• This Order shall become operative upon acceptance by,,the City of
Denton and if not accepted within 90"days of the date hereof; `t he action

economzes by poolzng the use of reserve electrzc capaczty zn thezr
respective systems and by joint development and/or construction
